HomeMy WebLinkAbout3245 RESOLUTION NO. 3245 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA FINDING THAT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE IMPROVEMENT OF WOODRUFF ~lAY IN THE CITY OF ARCADIA WHEREAS, pursuant to resolution No. 3236 and the laws and Constitution of the State of California, a public hearing has been held, dUly and regularly, on the proposed improvement of Woodruff Way between the center line of Woodruff Avenue and the southerly line of Tract No. 4870, Map Book 56, page 24, within the City of Arcadia, by the construction and installation of sanitary sewer line, resurfacing as necessary, and appurtenant work thereto; and WHEREAS, said improvement has been considered fully; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Arcadia hereby finds and determines that the public convenience and neces- sity ~equire the improvement of Woodruff Way betweenfue center line of Woodruff Avenue and the southerly line of Tract No. 4870, Map Book 56, page 24, within the City of Arcadia, by the construction and installation of sanitary sewer line, resurfacing as necessary, and appurtenant work thereto; and that the nature, location, and extent of the proposed improvement and the district to be assessed for the cost and expenses thereof are shown, respectively, on the profile and improvement plan, No. J.N. 254; specification entitled ~Improvement of Woodruff Way Northerly From Woodruff Avenue By The Installation of Sanitary Sewers;~ and assessment district map, No. W-92. SECTION 2. That the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931" shall not apply to the making of said improvement. SECTION 3. That this improvement shall be conducted under the Improvement Act of 1911, which is Division 7 of the Streets and Highways Code of the State of California. The City Engineer and -l- the City Attorney hereby are instructed to present to the City Council the Resolution of Intention required by the Improvement Act to initiate the proceedings for the improvement. SECTION 4. The City Clerk shall certify to the adoption of this resolution, and thenceforth and thereafter the same shall be in full force and effect.
