RESOLUTION NO. 3249
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
CLASSIFYING THE BUSINESS OF
CONSTRUCTING, MAINTAINING AND
OPERATING A DEMONSTRATION HOME AS A
USE PERMISSIBLE IN ZONE C-M UNDER
ORDINANCE NO. 760 OF THE CITY OF
ARCADIA.
WHEREAS, the business of constructing, maintaining and
operating a demonstration home is nowhere specifically listed as
a use permissible in any zone under Ordinance No. 760 of the City
of Arcadia; and,
WHEREAS, there has been requested a classification of
such a business under Ordinance No. 760 of, the City of Arcadia;
and,
WHEREAS, ambiguity has arisen concerning the appropriate
classification of such use within the meaning arid intent of Ordi-
nance No. 760 of the City of Arcadia; and,
WHEREAS" Section l5-A-l of said Ordinance No. 760 pro-
vides in part ". . . if ambiguity arises concerning the appropriate
classification of a particular use within the meaning and intent
of this Ordinance
."; and,
WHEREAS, at a regular meeting of the City Planning Com-
mission, said Commission ascertained the pertinent facts concern-
ing the business of constructing, maintaining and operating a
demonstration home and thereupon made its determinations and recom-
mendations under its certain Resolution No. 371, adopted April 12,
1960; and,
WHEREAS, the City Council has reviewed said recommenda-
tions and fully considered the matter;
NOW, THEREFORE, THE CITY COUNCIL DOES HEREBY DETERMINE
AND RESOLVE AS FOLLOWS:
SECTION 1. That under adequate conditions and restric-
tions, the construction, maintenance and operation of a demonstration

home would be no more objectionable or detrimental than other uses
permitted in Zone C-M and should be classified as a proper use in
the C-M Zone.
SECTION 2. That for the foregoing reasons, the business
of constructing, maintaining and operating a demonstration home
should be and the same is hereby classified as a,use permissible
in Zone C-M under Ordinance No. 760 upon the following conditions:
1. That the demonstration home shall not be used as liv-
ing quarters or for business purposes other than the demonstration
or sale of a home to be constructed elsewhere.
2. That the demonstration home shall be constructed on
concrete piers rather than a continuous concrete foundation.
3. That the demonstration home shall not be connected
to a water supply or to the sanitary sewer or any other sanitary
facility.
4: That notwithstanding any contrary regulations con-
tained in the Building Code, a demonstration home may be constructed
of any materials approved by the Building Code.
5. That no demonstration home may be constructed less
than five (5) feet from any property line.
SECTION 3. The City Clerk shall certify to the adoption
of this resolution.
I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting of the City Council of the City of Arcadia held
on the 19th day of April; 1960, by the affirmative vote of at least
three Councilmen, to wit:
