HomeMy WebLinkAbout3250 RESOLUTION NO. 3250 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DECLARING ITS INTENTION TO VACATE AND ABANDON A PORTION OF FIFTH AVENUE, A PUBLIC STREET IN SAID CITY AND TO EXCEPT AND RESERVE EASEMENTS THEREIN, AND FIXING A TIME AND PLACE FOR THE HEARING OF OBJECTIONS TO SUCH PROPOSED VACATION AND ABANDONMENT. :<> THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Arcadia is in- formed and believes and hereby finds and determines that the herein- after described portion of Fifth Avenue, a public street in the City of Arcadia, is no longer required for the public convenience, neces- sity, use and welfare, and that the public health, necessity and safety will be better served by the vacation and abandonment for street purposes of the hereinafter described property, and does here- by declare its intention to vacate, abandon and terminate, pursuant to Chapters l, 2 and 3, Part 3, of Division 9 of the Streets and Highways Code of the State of California, the following portion of a public street officially named and commonly known as Fifth Avenue in the City of Arcadia, County of Los Angeles, State of california, described as follows: That portion of Lot 9, Tract No. 5205, as shown on map recorded in Book 54, page 61, of Maps, in the office of the County Recorder of said County, described as follows: Beginning at a point in the easterly line of Lot 9, Tract No. 5205, in Book 54, page 61, of Maps, said point being 40 feet South from the northeast corner of said lot; thence South 0002' West l36.0 feet along the east line of said lot; thence North 29013'35" West, 114.57 feet; thence North 36011' l5" West, 69.39 feet to the south line of Huntington Drive; thence East along the south line of said Huntington Drive, 67.0 feet; thenc,e South 45000 I East 28.28 feet; thence East lO.OO feet to the point of beginning. SECTION 2. That the public convenience and necessity re- quire the reservation of easements and rights of way for the various -1- 3250 structures enumerated in Section 8330 of the streets and Highways Code of the state of California. The City shall therefore reserve and exclude from the proposed vacation a permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove and renew sanitary sewers, storm drains and appurtenant structures in, upon, over and across any part of said portions of street proposed to be vacated and, pursuant to any existing franchises or renewals thereof or otherwise, to con- struct, maintain, operate, replace, remove, renew or enlarge lines of pipe, conduits, cables, wires, poles and other convenient struc- tures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, railroad lines and for the trans- portation and distribution of electrjc energy, petroleum and its products, water, and incidental purposes, including access thereto and therefrom, and the right to keep the property free from inflam- mable materials, wood growth and structures of any nature, and otherwise protect the same from all hazards in, upon and over such portions of said street proposed to be vacated as the City Council may determine to be reasonably necessary or convenient and the within proceedings are taken subject to such reservation and ex- ception. SECTION 3. A map or plan indicating by boundary lines the location and extent of the property included in the proposed vaca- tion, abandonment and termination is on file in the office of the City Clerk and reference is hereby made to said map or plan for a particular and for a further, full and complete description of all the properties comprising the aforesaid portions of properties. SECTION 4. That Wednesday, the 8th day of June, 1960, at 8:00 o'clock p.m. on said day, in the Council Chambers of said City Council in the City Hall, 240 West Huntington Drive, Arcadia, California, is hereby fixed as the hour, day and place at which any and all persons interested in or objecting to the said proposed -2- 3250 vacation, abandonment and termination may appear before this Council and show cause why said portion of said street should not be vacated, abandoned and terminated as hereinbefore set forth. SECTION 5. The Superintendent of Streets shall cause to be posted notices of the passage of this resolution and of the afore- said hearing at the places and in the manner required by law. SECTION 6. The City Clerk shall certify to the adoption of this resolution and shall cause the same to be published once in the Arcadia Tribune and Arcadia News, a newspaper of general cir- culation published and circulated in the City of Arcadia.
