RESOLUTION NO. 3256
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
DENYING AN APPLICATION FOR A ZONE
VARIANCE FOR THE CONSTRUCTION AND
OPERATION OF A 16-UNIT, TWO-STORY
APARTMENT HOUSE AT 633-637 SOUTH
BALDWIN AVENUE IN SAID CITY.
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES
FIND, DETERMINE AND RESOLVE AS FOLLOWS:
SECTION 1. That there was filed with the City Planning
Commission on the 7th day of March, 1960, the application of David M.
Turner and others, as owners, for a zone variance to permit the con-
struction and operation of a 16-unit, two-story apartment house on
property located at 633-637 South Baldwin Avenue, in the City of
Arcadia, County of Los Angeles, State of California, described as
follows:
The South 108.065 feet of that portion of
Lot 6, Tract No. 949, per map recorded in
Book 17, page 13, of Maps, in the office of
the County Recorder of said County, described
as'fol1ows:
"
Beginning at a point in the east line of said
Lot 6, as established and shown on County
Surveyor's Map B-111, Sheet No.4, in the of-
fice of the surveyor of said county, distant
along said l1ne, north 2058'25" east 216.l2
feet from the north line of Huntington Drive,
as described in deed to City of Arcadia, County
of Los Angeles, State of California, as re-
corded in Book 9896, page 145,. of official
records; thence north 87001'35" west 260 feet;
thence north 2058'25" east 216.l3 feet; thence
south 87001'35" east 260 feet to a point in
the easterly line of said Lot 6, said point
being north 2058'25" east thereon 216.13 feet
from the point of beginning; thence south
2058'25" west 216.13 feet to the point of
beginning, excepting the easterly 40 feet
thereof.
That after notice as required by Ordinance No. 760 of said City, as
amended, a publiC hearing was duly held by and before said Commis-
sion on the 22nd day of March, 1960, at which time all interested

persons were given a full opportunity to be heard and to present
evidence; that on April 12, 1960, said Commission adopted its cer-
tain Resolution No. 368 wherein and whereby certain findings,
determinations and recommendations were made.
SECTION 2. That there were several oral protests to the
granting of the requested zone variance and eighteen property owners
signed a petition opposing it.
SECTION 3. That on June 16; 1953, this Council granted
a zone variance to permit subject property and other properties on
the west side of Baldwin Avenue, all zoned R-l, to be used for the
construction of one-story apartment houses upon specified conditions;
that all development in the entire block upon which the initial vari-
ance was granted has been with one-story apartments. That subject
property is zoned R-l with a lot area of 23,773 square feet; that
the plan submitted by applicant does not meet the present R-3 re-
quirements of the zoning ordinance which require 1500 square feet
of lot area per family and It parking spaces per unit, each 10 feet
wide.
SECTION 4. That it was not shown that there are excep-
tional or extraordinary circumstances or conditions applicable to
subject property or to the intended use of said property that do
not apply generally to other property in the same zone or vicinity;
that it was not shown that the requested zone variance is necessary
for the preservation and enjoyment of a substantial property right
of the applicant possessed by other property in the same zone or
vicinity, since the variance heretofore granted to subject property
is still available to applicant. That it was not shown that the
granting of the variance would not be materially detrimental to the
public health and welfare or injurious'to property or improvements

in the same zone or vicinity in which the property is located, but
rather that the granting of applicant's request would permit the
use of subject property in a manner totally different from and detri-
mental to similar adjacent properties.
SECTION 5. That for the foregoing reasons the application
of David M. Turner and others for a zone variance to permit the con-
struction and operation of a 16-unit, two-story apartment house on
the property hereinabove described be and the same is hereby denied.
SECTION 6. The City Clerk shall certify to the adoption
of this resolution.
I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting of the City Council of the City of Arcadia held
