A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
DENYING AN APPLICATION FOR A ZONE
VARIANCE AND/OR SPECIAL USE PERMIT
TO ,ALLOW THE CONSTRUCTION AND
OPERATION OF A 57-BED CONVALESCENT
HOME AT 1601 SOUTH BALDWIN AVENUE
IN SAID CITY. l\

The North 138,286 feet of Lot 4, Block G,
Santa Anit~/Lan4 Company's Tract, as shown
on map recorded in Book 6, page 137, of
Maps, Reco~d$ of Los Angeles County, ex-

That after notic~ as~equired by Ordinance No. 760 of said City, as

amended, a public ~a~1ng was duly held by and before said Commission
on the 22nd day of March, 1960, at which time all interested persons
were given a full opportunity to be heard and to present evidence.
That on April 12, 1960, said Commission adopted its certain Resolu-
tion No. 370, wherein and whereby certain findings, determinations
and recommendations were made.
SECTION 2. That there were numerous, oral protests to the
granting of the requested zone variance and/or special use permit,
all from neighboring property owners. That only the attorney for
applicants and, a member of the American College for Hospital Adrninis-
trators spoke in favor of the application.

SECTION 3. That subject application is a revision of a
previous request denied by the Planning Commission on November 10,
1959 by its Resolution No. 350 and later denied by this Council on
December 15, 1959, by Resolution No. 3199. That although this ap-
plication does show architectural changes that would make the build-
ing more desirable and allow for more parking, the basic reasons for
denying the previous application still remain. That the question
is not whether the plans presented are desirable and whether there
is need for more convalescent facilities in Arcadia, but rather the
use of property at the particular location for the purpose of a
convalescent home.
SECTION 4. That it was not shown in connection with the
previous application that there are exceptional or extraordinary
circumstances or conditions applicable to the property involved or
to the intended use of the property that do not apply generally to
other property in the same zone or vicinity, nor that such variance
and/or special use permit is necessary for ~he preservation and en-
joyment of a substantial property right of the applicant po'ssessed
by other property in the same zone or vicinity. That it has not
now been shown that there is any change in the conditions appli-
cable to subject property that would cause exceptional or extra-
ordinary circumstances or make necessary the granting of any such
variancesibr protection of property rights.
SECTION 5. That it has not been shown that the granting
of the requested variance would not be detrimental to property or
improvements in the neighborhood or would not adversely affect the
comprehensive general plan. On the other hand, the 'granting of a
variance and/or special use permit for a convalescent home at the
above location at a time when the rezoning of Annexation 14 and
Annexation 17-A is under consideration by this Council could well

be materially detrimental and injurious to the property and improve-
ments in the vicinity in which subject property is located; and at
a time when the widening of Baldwin Avenue 'is being planned to
handle peak periods of vehicular travel between freeways, would
undoubtedly affect the comprehensive general plan. '
SECTION 6. That for the foregoing reasons, the application
of Sophia P. Johnson and Orlando Clarizio for a zone variance and/or
special use permit to allow the construGtion and operation of a 57-bed
convalescent home on the property hereinabove described, be and the
same is hereby denied.
SECTION 7. The City Clerk shall certify to the adoption
of this resolution.
I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting of the City Council of the City of Arcadia, 'held
on the day of , 1960, by the affirmative vote of
at least three Councilmen, to wit:
