HomeMy WebLinkAbout3271 RESOLUTION NO. 3271 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING A VARIANCE TO PERMIT THE STORAGE, DRESSING AND PROCESSING OF NUTRIA SKINS AT 126-128 WHEELER AVENUE IN SAID CITY. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That there was filed with the City Planning Commission on April 8, 1960 the application of Rico Land & Invest- ment, a California Corporation, as owner, signed by R. B. Rice, President, for a zone variance to allow the storage, dressing and processing of nutria skins upon the following described property located at 126-128 Wheeler Avenue in the City of Arcadia, County of Los Angeles, State of California, to wit: Lot 26, Block 75, Santa Anita Tract, as shown on map recorded in Book 15, pages 89 and 90, Miscellaneous Records of said County. That after notice as required by Ordinance No. 760 of the City of Arcadia, as amended, a public hearing was duly held by and before said Commission on April 26, 1960, which hearing was duly contin- ued to May 10, 1960, at each of which times all interested persons were given a full opportunity to be heard and to present evidence. That on May 24, 1960, said Commission adopted its certain Resolu- tion No. 374 wherein and whereby it recommended the granting of the requested variance upon certain specified conditions. SECTION 2. That while there were several property owners who filed written protests against the requested zone variance, there were others who spoke at the hearing favoring the variance. SECTION 3. That although subject property is zoned C-2, for the past few years it has been used for the manufacture of clothing. That the lot is 50 feet by 160 feet, contains 8000 square feet and abuts an alley at the rear. It is improved with -1- 3271 a masonry building erected in 1945 and enlarged in 1950, with two stories in front and one story in the rear. That subject property has a loading space at the rear but practically no parking space as it was constructed before parking was required by city ordinance for commercial buildings. That next door east is a public garage with a public parking lot east of the garage; to the west is the post office building, the post office parking lot and a public park- ing lot; across the street on the north side of Wheeler Avenue is a woodworking shop; and across the alley to the south are the com- mercial businesses facing Huntington Drive. SECTION 4. That while tanneries are specified as a use permissible in Zone M-2, the storage, dressing and processing of animal skins is nowhere specified as a use permissible in any zone. That the storage, dressing and processing of animal skins as pro- posed by applicant differs greatly from tanning, not only in the method of treatment in that in tanning the fur or hair is re- moved from the hide whereas in applicant's processing the fur will be retained, but principally in the ingredients used, for in the tanning process the materials used invariably cause excessive and obnoxious odors whereas the materials used in applicant's process are extremely mild and inoffensive. SECTION 5. That there are exceptional conditions appli- cable to the property that do not apply generally to the class of use in the same zone, in that there are no retail establishments in the entire block, and no businesses dependent upon nor gen- erating walk-in trade, and subject property is isolated by the normal retail commercial businesses. That the granting of a zone variance upon the conditions hereinafter specified will not be materially detrimental to the public health or welfare of injuri- ous to the property or improvements in the same zone or vicinity in which the property is located. That the requested variance is necessary for the preservation and enjoyment of substantial prop- erty rights of the applicant possessed by other property in the -2- 3271 same zone and general vicinity in that other properties in the same zone can be used for processing of materials such as tinsmiths, upholstering shops, taxidermy, plumbing shops, lithography and the like, and property across the street is zoned and used for indus- trial purposes. That such a variance will not be inconsistent with good planning practice nor with the present or prospective develop- ment of the neighborhood in which the property is located. SECTION 6. That for the foregoing reasons a variance is hereby granted to permit the storage, dressing and processing of nutria skins upon the above described property upon the following conditions: a. That all operations on the premises shall be conducted in such a manner that no obnoxious odors or dust shall be emitted. b. That no manufacturing or tanning processes shall be conducted on the premises. c. That the zone variance shall be limited to a period of not more than five (5) years, at which time the matter shall be reconsidered in the light of conditions at that time. SECTION 7. That the violation of anyone or more of the above conditions shall constitute a violation of Ordinance No. 760 of the City of Arcadia and shall constitute grounds for the modi- fication or revocation of the variance hereby granted. SECTION 8. The City Clerk shall certify to the adoption of this resolution.
