HomeMy WebLinkAbout4091 '-J 1 RESOLUTION NOo 4091 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT UPON AN APPEAL FROM THE PLANNING COMMISSION -- 218 EAST HUNTINGTON DRIVEo WHEREAS, Robert F. Kleckner is the owner of Lot 1, Tract 5205 and presently operates a drive-in eating establishment on said lot, except the easterly 6405 feet thereof, known as 218 East Huntington Drive; and WHEREAS, said owner has duly filed an application for a conditional use permit for the purpose of conducting said drive-in eating establishment in an altered and remodeled form, Planning Department Case No. CUP 69-7; and WHEREAS, the Planning Commission denied the permit for the reason that the eating establishment as remodeled would not comply in certain respects with the City's development standards; and WHEREAS, the applicant has duly filed an appeal from the decision of the Planning Commission, and a public hearing on the appeal has been heard; and WHEREAS, the Council finds that the use of said property for an eating establishment on the conditions hereinafter set forth , will not be detrimental to the public health or welfare and will not be injurious to the property or improvements in the vicinity. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA RESOLVES AS FOLLOWS: SECTION 1. That a conditional use permit is granted for the use of said lot, except the easterly 64.5 feet thereof, for a drive-in eating establishment upon the following conditions: -1- 4091 . 1. The existing improvements shall be maintained except that alterations to the existing buildings shall be made in accord- ance with the plans on file in said Case No. CUP 69-7 and, in addition, restroom entrances and temporary outside storage areas shall be screened in an approved manner. 2. Landscaping shall be installed in accordance with said plans. Except as modified by the terms of this permit, said property shall be subject to all municipal regulations. 3. The existing concrete driveway located approximately in front of the existing kitchen shall be removed and replaced with concrete sidewalk, curb and gutter. SECTION 2. The City Clerk shall certify to the adoption of this resolution.
