HomeMy WebLinkAbout4011 RESOLUTION NO. 4011 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, GRANTING A MODIFICATION OF A ZONE VARIANCE GRANTED BY RESOLUTION 3876 RELATING TO A PET CLINIC AT SECOND AVENUE AND FOOTHILL BOULEVARD. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That pursuant to an application of M. D. Schmutz, D.V.M., as Lessee, for modification of a variance granted by Resolution No. 3876 to permit the operation of a household pet clinic in the Highlander Shopping Center on property more specifi- cally described as follows: Lot 9, Tract No. 23972, per map recorded in Book 748, pages 63, 64 and 65, of Maps, in the office of the Courity Recorder of said County, a public hearing was held on June 4, 1968. That the application requested elimination of conditions number 1 and 3 of said variance. Planning Commission held a public hearing on May 14, 1968 on this application and at the conclusion thereof recommended to the City Council that conditions 1 and 3 of said variance be deleted. SECTION 2. That the City Council finds that all of its findings made in said Resolution Noo 3876 are still applicable to said property; that the structure within which the use of the prop- erty is made is thoroughly soundproof and no noise emanates there- from to the outside of the building; that said findings are still applicable if small animals undergoing medical treatment are kept on the premises overnight and that there is no further need for reviewing from year-to-year the use of the property pursuant to the terms of the variance and the modification herewith made. -1- 4011 SECTION 3. That for the foregoing reasons Variance No. 3876 is hereby modified so as to permit the operation of a household pet clinic on the above described property upon the following con- ditions: 1. That no animals shall be kept or maintained on the premises overnight except those undergoing medical treatment. 2. That no animal shall be left unattended on the prem- ises, and a licensed veterinarian shall be assigned full time to and be on call for duty at said location at all times during which said pet clinic is open for business or any animal is kept or main- tained therein. 3. That the duration of this variance shall be for an indefinite time, subject to applicable regulations, ordinances and laws of the City of Arcadia and the state of California. SECTION 4. The City Clerk shall certify to the adoption of this resolution.
