HomeMy WebLinkAbout4032 RESOLUTION NO. 4032 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA DECLARING ITS INTENTION TO FORM A LIGHTING MAINTENANCE DISTRICT NO. 31, WHICH DISTRICT IS TO PAY THE COST AND EXPENSES FOR THE MAINTENANCE AND OPERATION OF A STREET LIGHTING SYSTEM ON PORTIONS OF CERTAIN DESIGNATED STREETS IN SAID CITY AND FIXING A TIME AND PLACE FOR HEARING OBJECTIONS TO THE FORMATION OF SAID DISTRICT OR TO THE EXTENT THEREOF. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the public interest and convenience require and it is the intention of the City Council of the City of Arcadia to form a lighting maintenance district to be known as Lighting Maintenance District No. 31, for the purpose of assessing said district to pay a portion of the cost and expenses of main- taining and operating a street lighting system consisting of fourteen 2,500 lumen lamps, seventy-eight 7,000 lumen lamps, and twenty-one 20,000 lumen lamps in said district on portions of the following designated streets: Baldwin Ave. Holly Ave. Las Tunas Drive Live Oak Ave. Ninth Ave. Tenth Ave. Verner Circle Winnie Way SECTION 2. The items of expense of maintenance and opera- tion of the said lighting system to be furnished and to be assessed in part against the lands within the district (exclusive of improve- ments) are the rate charge by the utility company for electric power (which rate includes the cost of repairs, replacements, maintenance, labor and materials) and the cost of publication, posting of notices, and engineering costs in the formation of the District. The esti- mat~d amount of electric power necessary for said system for each -1- 4032 year is 114,839 kilowatt hours and the estimated cost of said electric power for the first year of maintenance and operation is the sum of $5,434.20 and the estimated cost of other items of maintenance and operation for the first year is $965.80. That the total estimated cost of the first year's maintenance and operation is $6,400.00. SECTION 3. That the said contemplated maintenance and operation of said lighting system in the opinion of the City Council of the City of Arcadia is of more than local or ordinary public bene- fit and said City Council hereby makes the expense of said mainten- ance and operation, exclusive of the amount to be paid by said City as stated in Section 5 hereof, chargeable upon a district, which district said City Council hereby declares to be the district bene- fited by said maintenance and operation and to be assessed to pay the cost and expense thereof; which said district shall, in general, include all of those lots fronting on said portions of said streets. A plat or map of said district, indicating by a boundary line the extent of the lands included in the proposed district, and indi- cating by symbol showing the type of lighting, was approved and adopted by the City Council of said City of Arcadia, and is on file in the office of the City Clerk of the City of Arcadia. Reference is hereby made to said plat or map for further full and complete description of said Lighting Maintenance District No. 31, and said map so on file shall govern for all details as to the extent of such district. SECTION 4. That said maintenance and operation shall be furnished for said system for a period from the date of the forma- tion of said district to and including December 31, 1970. -2- 4032 SECTION 5. The City Council of the City of Arcadia hereby orders that 50% of the total maintenance and operation cost and ex- penses of said system be paid out of the treasury of said City from the General Fund of said City. SECTION 6. Notice is hereby given that on Tuesday, the 3rd day of December, 1968, at the hour of 8:00 o'clock p.m. of said day, in the Council Chamber of said City Council of said City of Arcadia, in the City Hall of said City, 240 West Huntington Drive, any and all persons owning land or having any interest in lands with- in the district liable to be assessed for the expenses of said main- tenance and operation or any portion thereof, may be heard and any of said persons may present any objections that they may have by protest. SECTION 7. All the proceedings for the aforesaid main- tenance and operation of said system shall be had and taken under and in accordance with the provisions of an act of the Legislature of the State of California, known and designated as the Municipal Lighting Maintenance District Act of 1927, being Division 14, Part 3, of the Streets and Highways Code of the State of California. SECTION 8. The Superintendent of Streets shall post or cause to be posted, copies of this resolution headed "Notice of Formation of Lighting Maintenance District" along all open streets within said district liable to be assessed, in the manner and form required by law. SECTION 9. The City Clerk shall certify to the adoption of this resolution and shall cause the same to be published twice, to wit: on November 10, 1968 and on November 17, 1968, in the -3- 4032 Arcadia Tribune, a newspaper of general circulation published and circulated in the City of Arcadia and hereby designated for that purpose. I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Council of the City of Arcadia held on the lst day of October , 1968, by the affirmative vote of at least three Councilmen, to wit: AYES: Councilmen Arth, Butterworth, Considine, Helms and Hage NOES: None ABSENT: None SIGNED AND APPROVED this lst day of October , 1968. ...
