I I' I ,I I I 1'1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA: ,I DECLARING ITS INTENTION TO IMPROVE A PORTION OF LEMON AVENUE IN 2 I: SAID CITY OF ARCADIA AND DECLARING SAID WORK OR IMPROVEMENT TO BE } I' OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT AND DESCRIBING THE DISTRICT TO BE BENEFITTED BY SAID WORK OR IMPROVEMENT AND TO BE , ASSESSED TO PAY THE COSTS AND EXPENSES THEREOF AND DETERMINmNG 4 I THAT SERIAL BONDS SHALL BE ISSUED TO REPRESENT SAID COSTS AND EX- : PENSES AND FIXING A TIME AND PLACE FOR HEARING OBJECTIONS TO SAID , 5 I WORK OR IMPROVEMENT OR TO THE EXTENT OF THE DISTRICT TO BE ASSESSED , OR BOTH. I I I I , 61 7 i , I THE CITY COUNCIL OF THE CITY OF ARCADIA DO RESOLVE AS FOLLOWS: , 8 I, SECTION 1: That the public interest and convenience " 9! require and it is the intention of the City Council of said City 10 i of Arcadia to order the following work and improvement to be done , 11 I in said City of Arcadia, to-wit: 12 FIRST: That a concrete curb be constructed in said I} Lemon Avenue from the Westerly line of Holly Avenue to the East- 14 erly line of Baldwin Avenue in said City of Arcadia along aline twelve (12) feet Northerly of and parallel to the Southerly line 15 16 of said Lemon Avenue, including returns at Holly Avenue and Lemon 17 Avenue. 18 SECOND: That a concrete curb be constructed in said por- 19 tion of Lemon Avenue along a line twelve (12) feet Southerly of 20 and parallel to the Northerly line of said Lemon Avenue, includ- i 21:! ing returns at Holly Avenue and Lemon Avenue. 22 \ THIRD: That that portion of the roadway of said Lemon 2}: Avenue from the Westerly line of the existing pavement on Holly I 241' Avenue to the Easterly :!.ine of the existing pavement on Baldwin 25 ! Avenue, situate eighteen (18) feet on each side of the existing 26 i center line of said Lemon Avenue, be graded and paved with an oil 27 II macadam pavement four (4) inches thick, except where an oil macad 28 pavement not less than four (4) inches thick is already constructed 29 in said portion of Lemon Avenue. SECTION 3: All of the foregoing work shall be done in accordance with said Profile and Improvement Plan No. C-l~7, on file in the office of the City Engineer of said City of Ar- c adia. Said work shall also be in accordance with the follow- ing Specifications on file in the office of the City Clerk of said City of Arcadia, to-wit: II Standard Specifications No. 0 for the construction of curbs, sidewalks, gutters, oil macadam pavement and concrete pave- mentll. Said Profile and Improvement Plan No. C-l~7 and Spec- ificationB hereinabove referred to, were adopted by Resolution No. ~59 of said City Council and the same are hereby made a part of this Resolution and are hereby referred to for a more part i- cular description of said work. All Streets and Avenues referred to in this Resolu- tion are Public Streets and Avenues of said City of Arcadia. SECTION~: That said contemplated work and improve- ment in the opinion of the City Council of said City of Arcadia, is of more than local or ordinary public benefit and said City Council hereby makes the expense of said work and improvement chargeable upon a District, which District said City Council here- by declares to be the District benefited by said work and improve- ment, and to be assessed to pay the costs and expenses thereof, which said District is bounded and described as follows: All th~t portion of said City of Arcadia included within the following described exterior boundary lines, to-wit: Beginning at the Northeast corner of Lot 59, Tract No. 4S69, in the City of Arcadia, County of Los Angeles, State of -2- ~, --- I' II , 1 I California, as per Map recorded in Book 52, Page 13, Miscellaneous I ': Records of said County; thence Westerly along the Northerly line I 3 I of Lots 59 to 42, both inclusive, and of Lot 40 in said Tract No. 4 i 4869 to the Northwest corner of said Lot 40; thence in a South- 5 easterly direction along the Westerly line of Lots 40, 41, 77 and 78 in said Tract No. 4869 to the Southwest corner of said Lot 78; thence along the Southerly line of said Lot 78 and of Lots 76 to 60, both inclusive, in said Tract No. 4869 to the Southeast cor- ner of said Lot 60; thence in a Northerly direction along the Easterly line of Lots 60 and 59, in said Tract No. 4869 to the point of beginning. The above description is general only. The said Plat or Map so on file shall J 18 govern for all details as to the extent of such Assessment Dis- 19 trict. 20 I HI SECTION 5: Said City Council also determines and de- clares that Serial Bonds shall be issued to represent each assess- ment of Twenty-five ($25.00) Dollars or more, remaining unpaid for thirty (30) days after the d ate of the Warrant to represent the Z2 Z3 24 expenses of said work and improvement. Said Serial Bonds shall 25 extend over a period ending nine (9) years from the second day 26 of January next succeeding the fifteenth day of the next November 27 following their date and an even annual proportion of the ~rincipal 28 sum thereof shall be payable by coupon on the second day of Jan- 29 uary every year after the fifteenth day of the next November fo~- 30 I lowing their date, until the whole is paid and the interest shall 31 be payable semi-annually by coupon, on the second days of January 32 and July, respectively of each year after their date at the rate of I J -3- . SECTION 6: Notice is hereby given that on Wednesaay the sixteenth day of May. 1928, at the hour of eight o.clock P.M. of said day, in the Council Chamber of the City Council of said I City of Arcadia, in the City Hall of said City, any and all persons having any objections to said proposed work or improvement or to [ I I I improvement should not be carried out in accordance with this Res- I I the extent of the District to be assessed, or both, may appear before said City Council and show cause why said proposed work or olution. SECTION 7: All of the proceedings for the aforesaid wor and improvement and for the issuance of said Bonds shall be had and taken under and in accordance with the provisions of an Act of the Legislature of the State of California, known and designated as the II Improvement Act of 1911'1, approved April 7, 1911 and of all Acts supplementary thereto or amendatory thereof. SECTION 8: The Superintendent of Streets shall post or cause to be posted, conspicuously along the line of said contem- 20 i I :~ I I: 231 24 [I 25 II 26 plated work or improvement and also along all the open Streets within the District liable to be assessed and hereinabove described notices of the passage of this Resolution in the manner and form required by law.
