HomeMy WebLinkAbout3973 RESOLUTION NO. 3973 12 3;16 !Zj-uLv ;e c3tJ3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY, OF ARCADIA, CALIFORNIA, APPOINTING REX H. MINTER. CITY ATTORNEY AND SPECIFYING THE TERMS AND CONDITIONS OF HIS SAID, EMPLOYMENT AND REPEALING RESOLUTION.NO. 2327. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That effective January 1, 1968 Rex H. Minter be and he is hereby appointed and employed as the City Attorney of the City of Arcadia, to serve in such capacity at the pleasure of the City Council. SECTION 2. That effective January 1, 1968, said appoin- tee shall receive as full compensation for all services rendered by him to, for or on behalf of the City of Arcadia the sum of One Thousand FOur Hundred Sixteen and 66/100 Dollars ($1,416.66) per month, payable in twenty-six (26) equal installments as specified in Resolution No. 3947 adopted June 28, 1967. Said duties shall include all duties imposed upon the City Attorney by the City Charter as well as all additional duties as may from time to time be assigned to him by the City Council, including proceedings taken under sta- tutory Improvement Acts, municipal bond proceedings, services ren- dered in actions in Court and the preparation therefor, the prose- cution of violations of the Municipal Code, for appearances in hear- ings before all City Boards and Commissions, and for appearances in hearings before administrative Boards and Commissions and legisla- tive Boards and Committees thereof. -1- 3973 ,- SECTION 3. Said appointee shall be entitled to all vacation, sick leave and other employee benefits, accumulated and paid for upon the same basis as for other department heads in the City employ. SECTION 4. Said City Attorney shall engage in no other business or occupation, and shall not otherwise engage in the prac- tice of law with respect to any matter that does or is likely to conflict with the performance of his duties as City Attorney as hereinbefore specified, or which is likely to result in contested litiga.tion, nor shall he engage in contested litigation except that to which the City is a party or in which the City has a direct or indirect interest, or which will interfere with his attendance at meetings of the City Council, or at meetings of any City Boards or Commissions which he is requested to attend. Said appointee shall not engage in any other practice of the law which will require his absence from City Ha.ll during regular working hours, SECTION 5. Nothing in this Resolution shall take from the City Council the control of all legal business and proceedings nor prohibit or restrict the City Council from employing other attorneys to take charge of any litigation or matter or to assist the City Attorney therein, as provided in Section 602 of the Arcadia City Charter. SECTION 6. That all former resolutions inconsistent or in conflict herewith are hereby amended to the extent necessary to conform herewith. SECTION 7. The City Clerk shall certify to the adoption of this Resolution. -2- 3973 .
