Cit~&:n~f Amdla. v THIS DEED, made this fifteenth day of March, 1930, between LIONEL AID.~TRONG of Arcadia, Los Angeles County, California, grantor, and the CITY OF ARCADIA, a municipal corporation, grantee, w 1. T N E ~ SET H: The grantor, without any consideration but upon and subject to the conditions hereinafter specified and not otherwise, does hereby grant to the grantee that certain parcel of land situate in the City of Arcadia, County of Los Angeles, state of California, which is bounded and particularly described as follows: THE EORT~:RLY FIFTEEN (15) FEET OF LOT 9, OF LOS ROBLES DE SANTA TRACT, AS PER MAP BOOK 33, PAGE 20, RZCORDS OF SAID COmITY; FOR PUBLIC AND HIGH'.YAY PURPOSES, BEllm A PORTIO~ OF FOOTHILL BOULEVARD; subject to all taxes which may be levied on or assessed upon said land or any part thereof or become a lien thereon or any part thereof, after the date of this deed, and. all taxes, State, County and J.runicipal, for the fiscal year July 1, 1930 to June 30, 1931. The grantee shall hold the above described. parcel of land. upon the conditions hereinafter specified. and upon breach of any of the con- ditions by the grantee the interest herein conveyed to the grantee in said parcel shall immediately cease and terminate and. title to said parcel shall immediately revert to and revest in the grantor. Said conditions are as follows: (1) Jithin two years from the date of this deed. the grantee shall commence and within six months thereafter complete the grading and paving between Sierra Madre Avenue and Santa Anita Avenue in the City of Arcadia of a fifty-six (56) foot highway and curbs, being twenty-eight (28) feet on each side of the center line of Foothill Boulevard as the same now exists and as it will be widened by the ac- quisition of the land hereby conveyed and by the acquisition of land of similar or greater width from all other owners of property abut- ting upon said Foothill Boulevard within the corporate limits of the grantee, said highway and. the paved portion thereof to follow the 1. v .~ '" ."" . ~ ~. l' .. po. ~ . .. .- ........ .- ftC l.:." - ~ .."".. '.. ~ ' . . route specified and be constructed in accordance with plans and spec- ifications of the state Highway Department of the state of California already adopted for the improvement of said Foothill Boulevard. (2) If at any time within ten years from the date of this deed any part of said Foothill Boulevard other than the fifty-six (56) foot portion thereof, which according to present plans of said State Highway Department it is proposed to grade and pave, shall be graded and/or paved, neither the grantor nor any of his property abutting upon Foothill Boulevard or otherwise shall be charged with or held liable for any part of the cost of grading and/or paving said portion of said Foothill Boulevard. (3) The grading and/or improvement and/or other work con- nected with the construction of said highway on the parcel above described shall be done pursuant to and in accordance with the pro- visions of an Act of the Legislature of the state of California ap- proved April 7, 1911 commonly called the "Improvement Act of 1911", and of all Acts amendatory thereof or supplementary thereto, and the cost of said grading and/or improvement and/or other work connected with the construction of said highway on the parcel ~bove described shall be chargeable against the property of the grantor abutting upon said Foothill Boulevard as widened and shall be assessed upon and against the specific lots into which the land of the grantor abutting upon said Foothill Boulevard as widened shall be subdivided at the time of the levy of such assessment. (4) In the event that it shall be necessary to remove or relocate any trees, fences or other improvements from the land here- by conveyed to the grantee in order to complete the improvement of said Foothill Boulevard hereinbefore described, the expense incurred in making such removals or relocations or any and all of them shall be borne primarily by the grantee and included in the cost of the project, and the land of the grantor shall be assessed therefor in the same manner as the land of other owners of land within the assess- ment district and not further or otherwise. 2. Upon the completion of the improvement of the above described highw~ as hereinabove described in conformity with the conditions hereinabove specified, all of said conditions shall be and become absolutely null and void and title to the land hereby conveyed shall vest in the grantee, free and clear of all of said conditions and the grantor, upon the request of the grantee, shall execute such deed or other instrument as may be necessary or proper to re- linquish any right, title and/or interest that may be reserved to or retained by him in or to the land hereby conveyed by virtue of said conditions.
