THE CITY COUNCIL OF THE CITY OF ARCADIA DO RESOLVE AS
FOLLOWS:
That that certain Grant Deed, dated March 29, 1930, exe-

cuted by George ~dwin Burnell and Mary L. Burnell, his wife,
granting to the City of Arcadia, a municipal corporation, that
certain parcel of land, situate in the City of Arcadia, County
of Los Angeles, State of California, and more particularly de-
scribed in said Grant Deed, be and the same is hereby accepted
by said City of Arcadia.

The undersigned, City Clerk of the City'of Arcadia,
does hereby certify that the foregoing is a full, true and cor-
rect copy of a Resolution adopted by tpe City Council of the
City of Arcadia, at a regular meeting thereof, held September
17,,- 1930.
WITNESS my hand and the Corporate Seal of said City of

THIS DEED, made this twenty-nineth day of March, 1930, between GEORGE ElJi'lIN

grantor, and the CITY OF ARCADIA, a municipal corporation, grantee,

The grantor, without any consideration but upon and subjeot to the
oonditions hereinafter specified and not otherwise, does hereQy grant to
the grantee that certain parcel of land situate in the City of Arcadia,
County of Los Angeles, State of California, which is bounded and particularly
described as follows:
THE NORTHERLY FIFTEEN (15) FEET OF LOT "An,

2ll'RECO;fJS OF SJiID COUNTY, FOR HIGHWAY AND
ROAD PURPOSES, BEING A PORTION OF FOOTHILL
BOULEVARD,
subject to all taxes 'which may be levied on or assessed upon said land
or any part thereof or beoome a lien thereon or any part thereof, after
the date of this deed, and all taxes, State, County and Municipal, for
the fiscal year July 1, 1930 to June SO, 1931.
The grantee shall hold the above described parcel of land upon
the oonditions hereinafter specified and upon breaoh of any of the con-
ditions by the grantee the interest herein conveyed to the grantee in said
parcel shall immediately cease and terminate and title to said parcel shall
immediately revert to and revest in the grantor,
Said conditions are as followsl
(1) Within two years from the date of this deed the grantee shall commence
and within six months thereafter complete the grading and paving betvleen
Sierra Madre Avenue and Santa Anita Avenue in the City of Arcadia of a fifty-
six (56) foot highway and ~urbs, being twenty-eight (28) feet 'on each side
of the center line of Foothill Boulevard as the same now exists and as it will
be widened Qy the acquisition of the land hereby conveyed and by the acquisition
of land of similar or greater width from' all other owners of property abutting
upon said Foothill Boulevard within the corporate limits of the grantee, said
highway and the paved portion thereof to follow the route specified and be
constructed in accordance with plans and specifications of the State Highway
Department of ~he State of California already adoptedlbr the improvement of said
Foothill Boulevard.

(2) If: at any time within ten years f'rom the date of' this deed any
part of' said Foothill Boulevard other than the fifty-six (56) f'oot portion

(3) The grading and/or improvement and/or other work connected with
the constructions of said highway on the parcel above described shall be
done pursuant to and in accordance with the provisions of an Act of the
Legislature of the state of California approved April 7, 1911 connnonly
called the "Improvement Act of 1911". and of all Acts amendator thereof

or supplementary thereto, and the cost of said grading and/or improvement and/
or other work connected with the construction: of said highway on the parcel
above described shall be chargeable against the property of the grantor abutting
upon said Foothill Boulevard as widened and shall be assessed upon and
against the specif'ic lots into which the land of the grantor abutting upon
said Foothill Boulevllrd as widened shall be subdivided at the time of the'
Le'VY of such assessment, ~
(4) In the event that it shall be necessary to remove any trees. or relocate
any fences or other improvements from the land hereby conveyed to the grllntee
in order to complete the improvement of said Foothill Boulevard hereinbefore
described, the expense incurred in making such removals or relocations or any
and all of them shall be borne primarily by the grantee and included in the cost
of the project. and the land of the grantor shall be assessed therefor in the
same manner as the land of other owners of land within the assessment district
and not further or otherwise.

Upon the completion of the improvement of the above described highway
as hereinabove described in conformity with the conditions hereinabove specif'ied.
all of said conditions shall be and become absolutely null and void and title to
~he land hereby conveyed shall vest in the grantee.mfree and clear of all of
said conditions and the grantor. upon the request of the grllntee. shall execute
Buch deed or other instrument as may be necessary or proper to relinquish any right.
