THIS DEED, made the sixteenth day ,of April, 1930, between
CARL M. EINHART and,MARY A. EINHART, his wife, of w,s Angeles County,
California, grantor, and the CITY OF ARCADIA, a-municipal corporation,
grantee,

The grantor, without any consideration but upon and subject to
the conditions hereinafter specified and not otherwise, does hereby grant
to the grantee that certain parcel of land situate in the City of Aroadia,
County of Los Angeles, State of California, which is 'bounded and parti-
cularly described as follows:
Part of Lot Six (6) of Tract No. 948 as per
map Book 17, page 21, Records of said County,
Beginning at t~e Northeast corner of Tract No.
1729; Thence North 89 degrees, 36 minutes East,
288.62 feet; thence South 0 degrees 24 minutes
East 15 feet; thence South 89 degrees 36 minutes

West 288.62 feet; thence North 0 degrees 24
minutes West, 15 'feet to Point of ' Beginning, being
for highway and road purposes, being ,a part of
Foothill Boulevard.

subject to all taxes which may be levied on or assessed upon said land or
any part thereof or become a lisn thereon or any part thereof, aft~r the
date of this deed, and all taxes, State, County and Municipal, for the fiscal
year July 1, 1930 to June 30, 1931.
The grantee shall hold the above described parcel of land upon
the conditions hereinafter specified and upon breach of any of the conditions
by tho grantee the interest herein conveyed to the grantee in said parcel
shall immediately ~ease and terminate and title to said parcel shall irr~ediately

revert to and revest in the grantor.
Said conditions' are ~s follows:
(1) Within two years from the date of this deed the grantee shall commence and
within six IDO?ths thereafter complete the grading ~nd paving betvreen Sierra Madre
Avenue and Santa J.Jlita Avenue' in the City of ",nadcia of a fifty-six (56) foot

highway and curbs, being twenty-eight (28) feet on each side of the center line
of Foothill Boulevard as the same now exists and as it will be widened by the acquisitio:

of the land'hereby conveyed and by the acquisition of land of similar or greater
width from all other avenel'S of property abutting upon said Foothill Boulevard within
the ~orporate limits of the grantee, said highvray and the paved portion thereof

to follow the route speoified and be oonstruoted in aooordanoe with plans and
speoifica~ionB ?f th~ S~ate Highway Department ,of t~e state ~f California
already adopted for the irr.provement of said Foothill Boulevard.
(2) If at any time within ten years from the date of this deed any part
of said Foothill Boulevard other than the fifty-six (56) foot portion
thereof, whioh according to present plans of said State Highway Department c-
it is proposed to grade and pave, shall be graded and/or paved, neither
the grantor nor any of their property abutting upon Foothill Boulevard or
otherwise shall be oharged witll or held liable for any part of the oost of
grading and/or paving said portion of said Foothill Boulevard.
(3) The grading and/or improvement and/or other work connected with the
construction of said highway on the parcel above described shall be done
pursuant to and in acoordanoe ~ith the provisions of an Aot of the Legislature
of the State of California approved hpril 7, 1911,oommonly called the
"Improvement Aot of 1911", and af all Aots amendatory thereof or supplementary
thereto, and the cost of said grading and/or improvemen~ and/or other work
oonnected with the construction of said highway o~ the paroel above described
shall be ohargeab!e against the property of the grantor abutting upon said
Foothill Boulevard as widened and shall be assessed upon and against the
speoific lots into whioh the land of the grantor abutting upon said Foothill
BOUlevard as widened shall be subdivided at the time of Levy of such assessment.

In the event that 1t sahlI be neoessary to remove any trees, or relooate
any fenoes or other improvements from the ~~nd hereby oonveyed to the grantee
in order to complete the improvement of said Foothill Boulevard hereinbefore
desoribed, the expense inourred in making suoh removals or relooations or any
and all of them shall be borne primarily by the grantee and inoluded in the cost-
of the projeot, and the land of the grantor shall be assessed therefor in the

same manner as the land of other owners of land within the assessment distriot
and not further or otherwise.
Upon the oompl;tion of the improvement of the above desorihed highway
as hereinabove desoribed in oonformity with the oonditions hereina~ove specified,

all of said ~onditions shall be and be~ome absolutely null and void and title
to the land hereby ~o~veyed shall'vest in'the grantee, free and ~lear of all of said
~onditions and the grantor, upon the request of the grantee, shall exe~ute su~h
deed or other instrument as may be ne~essary or property to relinquish any
right, title and/or interest that may be reserved, to or retained by them in or to
the land hereby ~onveyed by virturo of said ~onditions.
