I THIS AGREEMENT, nade and entered into this 8th day of
2 October, 1934, by and between ANNA R. TAYLOR (a widow), of the City of
3 Alameda, County of Alameda, State of California, the party of the first
4 part, and CITY OF ARCADIA, a municipal corporation, organized and existing
5 under and by virtue of the laws of the State of California, the party of
6 the second part;
7 W I T N E S S E T H
8 WHEREAS, the party of the first part is the owner of the real
9 property described as follows, to -wit:
10 That portion of Lot 1 of Tract No. 951, in the City of
Arcadia, County of Los Angeles, State of California, as
11 per map recorded in Book 17, Page 28 of Naps, in the
office of the County Recorder of said County, described
12 as follows:

Beginning at the northeasterly corner of said Lot 1;
thence south along the east line thereof 2414.07 feet,
14
more or less, to the westerly prolongation of the center
line of Valnett Street, formerly an unnam street, ly-
15
ing between Lots 20 and 27 of Santa Anita Colony, as
shown on map recorded in Book 42 Page 87 of Miscellan-
16
eous Records of said County; thence North 81 deg. 23
west 2182.59 feet, more or less, to the intersection of
17
the west line of said Lot 1 with the easterly prolonga-
tion of the center line of Camino Real avenue, as shown
18
on blap of Tract No. 6509, recorded in Book 70, Page 10
of Maps, Records of said County; thence north along said
19
west line, 1132.10 feet, more or less, to the southwest-
erly corner of the land described in deed to Arcadia City
20
School District, recorded in Book 6624, Page 68, Official
Records of said County; thence east, along the south line
21
thereof, 335.85 feet to the southeasterly corner thereof;
thence north, along the east line thereof, 666.50 feet,
22
more or less, to the northerly line of said lot: thence
north 81 deg. 00' east, along said northerly line 1844.90

feet, more or less, to the point of beginning; and con-
taining 98.102 acres of land, a little more or less, ex-
24
cepting, however, certain parcels thereof heretofore sold
by said party of the first part, which parcels contain in
25
the aggregate, approximately fourteen acres of land;
and

RBEREAS, for the purpose of subdividing and selling the portions
27
of said real
property still owned by her, said party of the first part is
28
desirous of
opening and improving through said real property a private road
29
or street of
a uniform width of 60 feet extending from the east line of
30
Holly Avenue
to the west line of E1 P;onte Avenue, the north line of which
31
private road
or street shall be the south line of the public school property,

1 located at the southeast corner of said Holly Avenue and Duarte Road,
2 as said south line is projected, east to an intersection with said west
3 line of said E1 Monte Avenue, - the portion of the said real property to
4 be opened as such private road or street, being more particularly described
5 as follows, to -wit:
6 The north 60 feet of that portion of said Lot 1 lying south
of a straight line extending easterly from a point in the
7 west line of said Lot 1 distant southerly thereon 613.50
feet from the northwest corner of said Lot 1 to a point in
8 the east line of said Lot 1, distant southerly thereon
954.31 feet from the northeast corner of said Lot 1, and,

AHEREAS, the party of the first part is likewise desirous of
10
securing a public utility service of water for all purposes upon all portions
11
of the said real property that may be served with water from pipes and a
12
main to be laid in said private road or street, and to that end proposes
13
to lay an eight -inch main along said proposed private road or street, and
14
extending from said Holly Avenue east a distance of approximately fifteen
15
hundred (1500) feet; and,
16
"lHERZLS, said party of the first part is likewise desirous of
17
securing a similar public utility service of water for all purposes upon
18
the portions of said real property bounded on the west by said Holly Avenue;
19
and
20
WHEREAS, said City of Arcadia is willing to furnish such public
21
utility service of water upon the terms and conditions herein set forth;
22
N0 THEREFORE, IT IS IIEREBY AGREED by and between the parties
23
hereto as follows, to -wit:

25 (1) The party of the first part shall lay out and open said
26 private road or street and shall, at her own expense, lay and construct
27 therein a cast iron water main of a diameter of eight (8) inches, extending
28 from the master -main along Holly Avenue, to be laid and constructed as
29 hereinafter provided, to a point in said private road or street approximately
30 fifteen hundred (1500) feet east from said roster -main. Said eight -inch
31 main and the laying and construction thereof and the connection of the same
3 2 with said master -main shall in all respects conform to the following spec -

The said 8" water main shall be new 8" Class 150 centrifugally
cast not less than 16* in length with bell and spigot ends.
All tees or other fittings in main line to be of Class D.
All cast iron pipe to be jointed with dry ,jute and leadite or
cement.
All fire hydrants to be constructed of 4" double dipped black
standard screw pipe with iron body, double disk, bronze mounted gate at the
main and Jones 4" a 22" (Fig. 344) angle fire plug valve on riser.
Circulating line to be of new 2" std. S. double dipped black
pipe with 2" gate valve at each end.
All valves to be of iron body, bronze mounted, double disk valves,
tested for a working pressure of 125 pounds.
That any and all ditches dug for the purpose of said water mains
by the party of the first part and any and all pipe or pipes laid and all
fire hydrants or any other work done in connection with said water mains
mentioned in this Agreement shall be in accordance with any and all ordinances
and resolutions of the City of Arcadia and in accordance with the plans and
specifications attached hereto and made a part hereof, and on file with the
Superintendent of the Water Department of the City of Arcadia, and shall be
to the satisfaction of the Superintendent of the Water Department of said
City of Arcadia.
The said party of the first part will before entering upon or
engaging in any of said work, procure compensation insurance for the protec-
tion of any workman, laborer or person or persons injured upon said work or
in the course of said work or improvement.
(2) The party of the second part shall lay a master -main of a
diameter of twelve (12) inches along said Holly Avenue connected with the
present water main in said Duarte Road, and running south on sod Holly Avenue
approximately six hundred seventy -three (673) feet to a point in the inter-
section of said private road or street with said Holly Avenue, and shall connect
the as with the said eight -inch main constructed by said party of the first

part as hereinbefore provided, all of said work to be done at the charge and
expense of said party of the second part.
(3) The party of the first part shall, without other consideration
than the execution and performance of this agreement by the party of the second
part, grant to the party of the second part a perpetual easement, for the
purpose of entering upon the same and laying, constructing, maintaining and
using water -pipes and mains for the rendition of a public utility water service
for all purposes in, over and across that portion of said real property
described as follows, to -wit:
The west 30 feet of that portion of said Lot 1, bounded
on the north by a straight line extending easterly from
a point in the west line of said Lot 1, distant boutherly
thereon 673.50 feet from the northwest corner of said
Lot 1 to a point in the east line of said Lot 1 distant
southerly thereon 1014.31 feet from the northeast corner
of said Lot 1, and bounded on the south by the easterly
prolongation of the north line of Naomi Avenue, as said
avenue is shown on the map of Tract No. 6509, recorded
in Book 70, Page 10 of Maps in the Office of the County
Recorder of said County.
The party of the first part shall also transfer and grant to said party of
the second part, when the same shall be completed, the said eight -inch main
by her constructed hereunder in said proposed private road or street, together
with a perpetual easement in and over said private road or street for the
purpose of entering upon the same, and repairing, replacing, taking up, mainta
ing and using water pipes and mains for the purpose of rendering such public
utility water service to said real property of said party of the first part,
her successors or assigns, and elsewhere within said City of Arcadia.
(4) After the due performance by the several parties hereto of
their respective promises and agreements hereinbefore set forth, the party of
the second part shall immediately initiate, and shall thereafter continuously
maintain, a public utility service of water through the several mains herein -
before mentioned to all portions of said real property first hereinbefore
described abutting on said Holly Avenue or on said proposed private road or
street, whereon such service is desired by the party of the first part and /or
by any and /or all of her several successors in interest, upon the same terms
and conditions as said party of the second part shall at the time be rendering

such public utility water service elsewhere within said City of Arcadia from
a main located in a street adjacent to the property to be served, and shall
thereafter at its own charge and expense maintain and operate the said master -
main on Holly Avenue and the said eight -inch main along said private road or
street; and shall likewise, whenever thereunto requested, render a public
utility water service from its present four-inch main in Holly Avenue to any
parcel or parcels of said real property first hereinbefore described abutting
on the west thirty (30) feet of that portion of said Lot 1, described in
paragraph three (3) hereof, to a depth not to exceed 335.85 feet east of
Holly Avenue.
(5) All cost and expense of opening, improving and maintaining
said proposed private road or street, as such private road and street, shall
be borne and paid by the party of the first part; provided, however, that after
said eight -inch main therein and said easement therein and thereover shall be
so transferred and granted by her to said party of the second part as herein -
before provided, any and all expense necessary to maintain and operate said
eight -inch main, including the expense of relaying pavement removed for any
purpose in connection with the maintenance and use of said main, shall be borne
by said party of the second part; provided said party of the second part is
permitted to relay or replace such pavement which may be removed for the purpose
of repairing, replacing and maintaining and operating said eight -inch water
main.
(6) The proposed private road or street shall not be deemed a
public street of the City of Arcadia, until such time as the City Council of
the City of Arcadia by ordinance or resolution accepts the same as such.
The party of the first part, shall at all times while such road
or street is a private road or street, maintain at each point where said private
road or street opens onto a public street a sign reading "Private Street ".
(7) The respective parties hereto shall, within 90 days after
the date of this agreement, commence the work by them respectively to be done
and performed hereunder in respect of the laying of said eight -inch main and
said master -main in Holly Avenue and the connection of the same at the point

thereafter in such manner as to permit said such public utility service of
water to be rendered therethrough.
(8) In the event the party of the first part, her heirs or
assigns, shall hereafter lay out and open one or more private roads or streets
through that portion of the real property first hereinbefore described lying
south of the private road or street referred to in paragraph (1) hereof, and
extending parallel therewith east from the easterly line of Holly Avenue, and
shall thereupon desire a public utility service of water to lands abutting on
such one or more private roads or streets first hereinbefore in this paragraph
mentioned, then and in such event the party of the second part shall extend
said master main, in paragraph (2) hereof provided for, south on said Holly
Avenue to the center line of the private road or street by the party of the
first part opened and laid out under the terms of this paragraph (or, if there
be more than one of such private roads or streets, to the center line of the
most southerly one thereof); and the party of the first part hereby agrees that
she will contribute to the cost and expense of extending said master main, as
aforesaid, a portion thereof equal to the cost of laying an eight (8) inch main
in said Holly Avenue of the same length as such extension, including the cost
of pipes and the expense of laying the same, all in accordance with the plans
and specifications set forth in paragraph (1) of this agreement. The entire
cost of making the extension of said master main in this paragraph provided

for, over and above the portion thereof so to be contributed by the party of I
the first part, shall be borne by the party of the second part.

RESOLUTION NO. 759.
THE CITY COUNCIL OF THE CITY OF ARCADIA DO RESOLVE
AS FOLLO'413 :
That that certain Easement dated March 2nd, 1935,
executed by Anna R. Taylor, granting to the City of Arcadia, a
municipal corporation, a perpetual easement for the purpose of
entering upon, laying, constructing, repairing, replacing, taking
up and maintaining water mains and water pipes and for the pur-
pose of using said water pipes and water mains for the rendition
of a water service or a public utility water service for all
purposes, in, over, across and upon all that certain real
property situated in the City of Arcadia, County of Los Angeles,
State of California, and more particularly described as follows:
The North 60 feet of that portion of said Lot 1 lying
south of a straight line extending easterly from a point
in the west line of said Lot 1 distant southerly thereon
613.50 feet from the northwest corner of said Lot 1 to a
point in the east line of said Lot 1, distant southerly
thereon 954.31 feet from the northeast corner of said
Lot l;this is part of Lot 1, Tract No. 951, as per map re-
corded in Book 17, page 28 of Naps of Los Angeles County;
be and the same is hereby accepted by said City of Arcadia.
The City Clerk shall certify to the adoption of this
Resolution.

adopted at a regular meeting of the City Council of the City of
Arcadia held on the 19th day of March, 1935, by the affirma-
tive vote of at least three councilmen, to -wit:

9 perpetual easement, for the purpose of entering upon the same,
