E.ASEMENT
In consideration of the sum of One Dollar ($1.00)
to the undersigned, in hand paid, receipt whereof 1s hereby
acknowledged, and in consideration of the benefits to the
property hereinafter described, RANCHO SANTA ANITA, INCOR-
PORATED, a corporation, organized and existing under and by
virtue of the laws of the State of California, does hereby
grant to the CITY OF ARCADIA, a municipal corporation, organ-
ized and existing under and by virtue of the laus of the state
of California, its successors or assigns, a perpetual easement
for the purpose of excavating for, constructing, maintaining,
inspecting and repairing a water channel for the conveyance
of flood waters and as a portion of the flood system of said
City of Arcadia, over, along and across all that certain real
property described as follows:
A portion of Lot 5, Tract No. 949, in the City
of Arcadia, County of Los Angeles, State of
California, as per map recorded in Book 17, Page
13 of Maps, records of said County; being a strip
of land twenty five feet (25') in ~idth, lying
Northerly of and adjacent to the Southerly line
of said Lot 5; the Southerly line of said strip
being described as follows:
Beginning at the intersection of the Southerly
line of said Lot 5 with the Easterly line of
Holly Avenue as described in deed to the City
of Arcadia recorded in Book 13158, Page 291 of
Official Records of said County; thence Easterly
and Northeasterly alone said Southerly line of

Lot 5 a distance of nine hundred twenty feet
(9201), more or less, to the Southwesterly
line of that certain channel commonly known
a~ the Arcadia Wash,
together ~ith the right to enter upon and to pass and repass
over and along said strip of land and to temporarily deposit
tools, implements and materials thereon by said City, its
officers, agents and employees, and by persons under contract
with said City and their employees, whenever and wherever
necessary for the purposes hereinabove or hereinafter specif-
ically set forth. Provided, houever, that all excavated
matter or materials in excess of an am0l41t ~equired to leave
the terrain in a level and presentable condition shall be
promptly removed from the lands of the grantor by the Cit~
of Arcadia, it being understood that said easement is in a
district adapted to high class residential ,purposes and that
no unnecessary or unsightly dirt, sand, gravel, rocks or
other materials shall be left piled or accumulated on or
along said right of uay.
Provided that all of said channel shall be excavated
and/or constructed in accordance with the Plans and Specifica-
tions now on file in the office of the City Engineer of said
City of Arcadia, said Plans being designated as Plan B-5-83.
Provided further, that in the event the grantee shall
at any time discontinue the use of said channel or structure
for a continuous period of one (1) year, or shall abandon the
same, or shall fail to keep, observe or perform any covenant
on granteo's part herein contained, all rights hereby granted
shall forthwith cease and ter~inate.
