The Grantee shall indemnify and keep harmless the Rancho Santa Anita, Inc., its successors or assigns, against and from any and all claims, demands, suits, cost of suit, and liabilities of every kind, arising out of or in any way connected with or based upon the construction, maintenance, repair and operation of said pipe line, or any injury resulting therefrom, whether to person or property, and also against all legal costs and charges includ- ing reasonable counsel fees, reasonably incurred in and about said matters and the defense of any action arising out of the same, and will hold the grantor and its property harmless from any liens on account of any of the work, materials or labor pertaining to said pipe lines, and will not permit any such liens to attach. e.. The easement is located within the bounds of a future street, the alignment and location and width of which have been approved by the City Council and Planning Commission of said City of Arcadia. The Grantor, its successors or assigns, reserves the 'right to dedicate all or any portion of said easement to the pub- lic use for public street purposes, and the Grantee shall accept such dedication, provided, however, that the street or portion thereof so offered for dedication shall be improved or guaranteed to be improved in accordance with the then existing subdivision ordinances of said City of Arcadia. f. The Grantor, its successors, or assigns, reserves the right to relocate said pipe line and easement at its own expense. Said relocation to be made under the ,direction and supervision of the Superintendent of the Water Department of the City of Arcadia. g. The Grantee agrees that upon demand of the Grantor, its successors or assigns, it will make the usual connection of service lines at the prevailing fees therefor to any house, building, sub- division, or parcel of land located on either or both sides of said -4- pipe line lying in said easement. WITNESS my hand and official seal the day and year in this certificate first above written. ~ ?Jt MuJat Notary Public in and for the County of Los Angeles, State of California. - -5- section with the Southerly line of Colorado Street (80 feet in width), as the same is described in deed to said City of Arcadia, and recorded in Book 9396, page 145 of Official Records of said County; The Grantor also hereby grants to the said Grantee the right to excavate for, install, maintain and re-place one water main for said purposes (to connect with said first mentioned water main) over a portion of that portion of said Lot 6 bounded on the South by the herein described easement, on the North by the South line of the parcel of land conveyed to said City of , Arcadia and described in deed recorded in Book 18040, page 345 of Official Records of said County, on the East by the Southerly prolongation of the Easterly line of said land so conveyed to the City of Arcadia, and on the West by the Westerly line of said Lot 6 of said Tract No. 949. The easement herein contained is granted and given upon the following terms and conditions, and compliance with and per- formance of said terms and conditions by the Grantee is hereby expressly made a condition hereof: a. The rights and easements hereby granted are subject to all conditions, restrictions, reservations, easements, rights, and rights of way of record or in use. b. The Grantee shall construct, maintain and operate said pipe line in such a manner as not to damage or interfere with ex- isting pipe lines, power lines, telephone lines, drainage ditches or channels, or other works on said premises, or with the use of any thereof, and in such a manner as will not obstruct or in any way interfere with the use and enjoyment of said premises. c.
