after referred to as "Declarants", hereby declare that they
are the owners of that certain real property commonly known
as 841 Singing Wood Drive, Arcadia, California, (hereinafter
referred to as "Property") and legally described as follows:

Parcell:
That portion of Lot 46 of Tract No, 13184 in the city
of Arcadia, as per map recorded in book 423 pages 11,
12 and 13 of maps in the office of the county recorder
of said county; lying westerly of the following des-
cribed line:
Beginning at a point in the northerly line of said Lot
46 distant thereon North 88 degrees 53' 40" East 150
feet from the northwest corner of said lot; thence
south 1 degree 6' 20" east 130 feet; thence southerly
in a direct line to a point in the southerly line of
said lot, distant easterly along said southerly line,
30 feet from the southwest corner of said lot.
Parcel 2:
That portion of Lot 46 of Tract 13184 in the city of
Arcadia, as per map recorded in book 423, pages 11,
12 and 13 of maps in the office of the county recorder
of said county lying easterly of the following described
line:
Beginning at a point in the northerly line of said lot
46 distant thereon north 88 degrees 53' 40" east 150.00
feet from the northwest corner of said lot 46; thence
south 1 degree 6' 20" East 130.00 feet; thence southerly
in a direct line to a point in the southerly line of
said lot distant easterly along said southerly line 30.00
feet from the southwest corner of said lot.
In consideration of the waiver by the City of Arcadia of
Section 7211 of the Arcadia Municipal Code to allow a drive-
way apron grade higher than that allowed by City specification,
Declarants hereby covenant and agree as follows:

1, Declarants agree to redesign and modify, at their
expense, such portions of their landscapping, driveways and
other improvements on "Property" as City's Director of Public
Works determines to be necessary to meet future sidewalk en-
gineering requirements established by the City of Arcadia,
at such time that the City of Arcadia determines that side-
walks are necessary on the public right of way contiguous to
Property. The public right of way lying between a projection
of the East and West property lines of Property and between
the curb and South property line of said Property shall be
similarly modified at the expense of Declarants to design re-
quirements established by the City of Arcadia, within sixty
(60) days after receipt of a written notice from the Director
of Public Works of the City of Arcadia.
2. Declarants agree to notify their assignees or
successors in interest in said property of this covenant,
3. Declarants agree to defend and hold the City of
Arcadia, its officers, agents and employees, harmless from
liability of any nature or kind arising out of the granting
of the waiver specified in paragraph 1 herein and pay any
damages, judgments, attorney's fees, costs and expenses
whatsoever arising in connection with said waiver.
4. This Covenant shall run with the land and be bind-
ing upon the Declarants, their heirs, successors and assigns
and inure to the benefit of, be enforceable by, and may be
released only in writing by the City of Arcadia.
5. 'Notice shall be deemed received by Declarants, as
specified in paragraph 1 herein, when posted in the mail with
the address of Property.

enacted pursuant thereto, hereby certifies:
1. That the real property or the division thereof described
herein complies with the applicable provisions of the Subdivision Map
Act and local ordinances enacted pursuant thereto; and
2. That any conditions imposed in granting this Certificate of
Compliance bave been fulfilled and implemented by the Applicant or
Applicant's grantee, and that no conditions remain to be fulfilled and
implemented; and
3. That the issuance and recordation of this Certificate of
Compliance bas been duly authorized and approved by the Planning
