("Covenantor") and municipal corporation ("City"). "Agreement") is made and 1990 by and between the City of Arcadia, a RECITALS A. Covenantor is the owner of the following described real property: 1. 215 N. SECOND AVENUE (the "Development Parcel") LOTS 17 AND 18 IN BLOCK 79 OF "A PART OF ARCADIA SANTA ANITA TRACT", IN THE CITY OF ARCADIA, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, AS PER MAP RECORDED IN BOOK 15 PAGES 89 AND 90 OF MISCELLANEOUS RECORDS, IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY. EXCEPT THE SOUTH 28.00 FEET OF SAID LOT 17. ALSO EXCEPT THAT PORTION OF SAID LAND DESCRIBED IN THE DEED TO THE CITY OF ARCADIA, RECORDED JUNE 19, 1970 AS INSTRUMENT NO. 21, RECORDS OF SAID COUNTY. 2. 205 N. SECOND AVENUE (the "Business Parcel") LOTS 16 AND 17 IN BLOCK 79 OF "A PART OF ARCADIA SANTA ANITA TRACT", IN THE CITY OF ARCADIA, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, AS PER MAP RECORDED IN BOOK 15 PAGES 89 AND 90 OF MISCELLANEOUS RECORDS, IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY. EXCEPT THE NORTH 27.00 FEET OF SAID LOT 17. B. All of the foregoing real property is subject. to that certain Agreement to Purchase and Develop entered into by and between the Arcadia Redevelopment Agency and the Covenantor dated , " {'-, Mav 21 , 1990, which is incorporated herein by reference. C. In consideration of the City's grant of a building permit to construct a parking lot on the Development Parcel and further for the purpose of providing assurance of adequate parking for the Business Parcel consistent with standards and requirements in the ci ty I S Zoning Ordinance, pursuant to Arcadia Municipal Code Section 9269.6, Covenantor hereby covenants and agrees as follows. AGREEMENT 1. The Covenantor covenants and agrees that the Development Parcel shall be used for the purposes of providing parking for the benefit of the Business Parcel, and that a minimum of twenty (20) spaces shall be maintained, kept, and used on the Development Parcel exclusively for vehicle parking for the benefit of the Business Parcel. 2. The Covenantor covenants and agrees that parking spaces on the Development Parcel shall at all times be kept open and unobstructed for access for vehicle parking. 3. The Covenantor further covenants and agrees that all improvements on the Development Parcel including without limitation, paving, landscaping and other structures, shall at all times be maintained in a first-class condition, weed-free, and so as not to constitute a nuisance under the Arcadia Municipal Code. 4. The Covenantor understands that this Covenant and Agreement shall promptly be recorded in the Office of the Recorder for the County of Los Angeles. 5. The Covenantor further understands and agrees that the City of Arcadia is the owner of interests in rights-of-way abutting both the Development Parcel and the Business Parcel and, therefore, has an interest in and derives benefits from the covenants made by the covenantor herein. 6. This Covenant and Agreement shall run with the land, shall be binding upon Covenantor, its heirs, successors, assigns, and encumbrances, and shall inure to the benefit of, be enforceable by and may be released only by both the owner of the Business Parcel and by the city.
