J~ O"~cJcJO RESOLUTION NO. 5590 91066- 0060 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, ORDERING THE VACATION AND ABANDONMENT OF PARCELS ONE (1) AND TWO (2), PORTIONS OF SECOND AVENUE NORTH OF HUNTINGTON DRIVE AND SOUTH OF SANTA CLARA STREET F_~ I FREE THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That on recommendation of the Department of Publ ic Works of the City of Arcadia, Resolution No. 5583 was adopted declaring the intention of the Arcadia City Council to vacate and abandon Parcels One (1) and Two (2), portions of Second Avenue north of Huntington Drive and south of Santa Clara Street, in the City of Arcadia, County of Los Angeles, State of California, more ~ 8wi!: .....uz 0:: u: ::) ;2 -J... 0$ ;::) aou~ .., -l/)(/) t:::o::~ ~ OL&JI,U "-... :!:1i1CJB ~ Q8~ .' ~Wl/) zlii 0::0::0 -OIl; 8 .... :t 0.; ; ~ I ::r-I , _n~~t;cularly shown in Exhibit A attached hereto and described as follows: I THAT PORTION OF LOT 1, BLOCK 84 AND A PORTION OF SECuND AVlNUE A~ SHOW~ ON 0; MAP OF " A PART OF ARCADIA SANTA ANITA TRACT", IN THE CITY OF ARCADIA, ~ COUNTY OF LOS ANGELES, STATE OF CALIFORNIA AS SHOWN ON MAP RECORDED IN BOOK 34, PAGES 41 AND 42, OF MISCELLANEOUS RECORDS IN THE OFFICE OF THE " RECORDER OF SAID COUNTY DESCRIBED WITHIN THE FOLLOWING DESCRIBED LINES: r-- THAT PORTION OF SAID LOT 1 AND SAID SECOND AVENUE LYING NORTHEASTERLY OF THE NORTHEASTERLY LINE OF THE ATCHISON, TOPEKA AND SANTA FE RAILROAD RIGHT OF WAY, FORMERLY KNOWN AS LA & SGV RR AS SHOWN ON SAID TRACT AND SOUTHWESTERLY OF A LINE PARALLEL WITH AND 80.00 FEET WESTERLY, MEASURED AT RIGHT ANGLES FROM OR RADIALLY TO THE EASTERLY LINE OF THAT CERTAIN PARCEL OF LAND ACQUIRED IN PARCEL 2 OF RESOLUTION NO. 4100 OF THE CITY COUNCIL OF THE CITY OF ARCADIA RECORDED DECEMBER 4, 1990, AS INSTRUMENT NO. 90- 2003262, OFFICIAL RECORDS AND AS DESCRIBED IN THAT CERTAIN GRANT DEED TO THE CITY OF ARCADIA, RECORDED AS DOCUMENT NO. lIS, ON SEPTEMBER 29, 1970, IN BOOK 04844, PAGE 90S, OF OFFICIAL RECORDS IN THE OFFICE OF THE RECORDER OF SAID COUNTY. A publiC hearing was duly held on June 4, 1991, or. posted notice and publication of said Resolution 5583, at the hour of 7:30 p.m. in the Council Chamber of Arcadia City Hall, 240 West Huntington Drive, Arcadia, Cal ifornia, for the purpose of hearing all persons interested in or objecting to the proposed vacation and abandonment of Parcels One (1) and Two (2), portions of Second Avenue. At said publ ic hearing, the City Council accepted and received all - 1 - testimony offered in support of, or in objection to the proposed vacation. SECTION 2. That the vacation of Parcels One (1) and Two (2), portions of Second Avenue are being made in accordance with Chapter 3 of Part 3 of Division 9 of the California Streets and Highways Code (Streets and Highways Code Section 8320 et. seq.). SECTION 3. That the City Council finds from all the evidence submitted that Parcels One (1) and Two (2), portions of Second Avenue, as included in the description in the Resolution of Intention to Vacate and Abandon (Resolution 5583), are unnecessary for present or prospective street purposes, and therefore, it is ordered that the above described portion of street be vacated, subject to reserving and excepting from the vacation: a) to the City of Arcadia, a permanent easement and right at any time, or from time to time to con~truct maintain, operate, replace, remove, -'and renew sanitary sewers and storm drains, culverts, water lines and appurtenant structures in, upon, over and across the street, or part thereof proposed to be vacated; and, b) to the Southern California Edison Company the permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove, renew, and enlarge 1 ines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment and fixtures for the transportation or distribution of electric energy, and incidental .' purposes in, upon and over the street, or part thereof proposed to be vacated; and c) to CableVision a permanent easement and right at any time, or from time to time to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles and other convenient structures, equipment and fixtures for the operation of cable in, upon and over the street, or part thereof proposed to be vacated. - 2 - 91. 891336 SECTION 4. Pursuant to Streets and Highways Code Section 8324, the City' Council finds from all evidence submitted that Parcels One (1) and Two (2), portions of Second Avenue hereinabove described, and included in the description in the Resolutio~ of Intention to Vacate and Abandon (Resolution 5583), are unnecessary for present or prospective public use, and therefore, it is ordered that Parcels One (1) and Two (2), portions of Second Avenue be vacated. SECTION 5. Pursuant to the provisions of Section 2381 of the Streets and Highways Code of the State of Cal ifornia, this Council does hereby find and determine that Parcels One (1) and Two (2), portions of Second Avenue, nor parts thereof are useful as bicycle paths or routes. SECTION 6. That the City Council hereby approves the Negative Declaration for the vacation and abandonment of Parcels One (1) and Two (2), portions of Second Avenue, and find~ it will not ha~e a sigr.ificant effect on "the envi ronment. SECTION 7. Subject street vacation is within the scope of the Northwest Corner Redevelopment Project. SECTION 8. That from and after the date that Resolution No. 5590 is recorded, the vacated Parcels One (1) and Two (2), portions of Second Avenue will no longer constitute a public street. SECTION 9. That the City Clerk shall certify to the adoption of this Resolution and shall cause a certified copy thereof to be recorded in the Office " of the County Recorder of Los Angeles County. - 3 - 91 891336 Passed, approved and adopted this 4th day of June , 1991. ~ ..
