COVENANT AND AGREEMENT TO INSTALL
AND CONSTRUCT CERTAIN IMPROVEMENTS
For good and adequate consideration, receipt of which is
hereby acknowledged, including the right to consolidate and use
subject property without immediate construction of required
public improvements as required by tentative Parcel Map 84-9 and
the City of Arcadia Municipal Code, this Covenant and Agreement
is made by and between Kardashian Enterprises, hereinafter
referred to as "COVENANTOR", and the City of Arcadia, a municipal
corporation, hereinafter referred to as "CITY". Covenantor
hereby certifies that it is the owner of the parcel of real
property hereinafter legally described:
Lot 5 of Parcel Map No. 16141
Covenantor (or any successor in interest) agrees to complete the
following improvements to the satisfaction of the Public Works
Director prior to issuance of any building permit by the City
with reference to subject property:
1. Construct P.C.C. sidewalk at the curb line along the frontage
on Clark Street, Goldring Road, and Kardashian Avenue according
to City of Arcadia Standard Drawing No. S-ll.
2. Construct ramps for the handicapped per City of Arcadia
Standard Drawing No. S-22 in the northeasterly, southwesterly,
and southeasterly corners at the intersection of Kardashian
Avenue with Goldring Road.
3. Install a six-inch sewer lateral to the property line to
serve Lot 5.
4. Install street lights with underground circuit in conjunction
with Edison. Location and number of lights subject to approval
by the City Engineer.
Covenantor agrees that this covenant shall be for the benefit of
aforedescribed Lot 5. Covenantor agrees that in the event
afore described construction is not performed in a manner
acceptable to the City of Arcadia that the City of Arcadia may
perform the construction hereinabove set forth and assess the
adjacent lots for the costs of said improvements. Covenantor
agrees said costs shall become a lien on aforedescribed lot in
the event the City is not reimbursed upon request for said costs.
This Covenant and Agreement herein shall run with the land, shall
be binding upon the parties hereto, future owners of Lot 5, their
heirs, successors and assigns, and encumbrancers, and shall
continue in effect without limitation until released by written
instrument executed by the appropriate officers of the City as
authorized by City Council of City. Covenantor agrees to inform
grantees of Lot 5 of this Covenant and Agreement.
