CAl./F. 9100<3 .,0 .,.,...,- --u LFREE A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, VACATING A PORTION OF CERTAIN AIR RIGHTS OF A PORTION OF HUNTINGTON DRIVE RESOLUTION NO. 5277 ~ 7 WHEREAS, the City Council of the City of Arcadia, California, at its meeting of January 21, 1986, adopted Resolution No. 5275, "A Resolution of the City Council of the City of Arcadia, California, declaring its Intention to Vacate a Portion of Certain Air Rights of a Portion of Huntington Drive," and ordered a Public Hearing on this matter to be held on February 4, 1986; and WHEREAS, subject air rights involves an elevation of 16 feet as described in Resolution 5275 attached and incorporated as part of this Resolution; and I: WHEREAS, a Public Hearing was held in the Council Chambers of the City of Arcadia at 7:30 o'clock p.m. on February 4, 1986 - where any and all persons interested in or objecting to the ' proposed vacation of a portion of certain air rights of a portion of Huntington Drive were heard; and WHEREAS, the Public Streets, Highways and Service Easements Vacation Law provides that the ~esolution of vacation may provide that the vacation occurs only after conditions required by the legislative body have been sati~f{ed and may instruct the Clerk that the resolution of vacation not be recorded until the conditions have been satisfiEd. That the public interest and convenience require, and based on all evidence submitted, that the portion of the air rights of a portion of Huntington Drive as further described in Resolution 5275 are unnecessary for present or prospective public street purposes. SECTION 2. That all conditions of approval including all those incorporated by prior Resolution 5210, and other conditions that may be imposed by the City prior to recordation of this ", Resolution be completed to the satisfaction of the City Attorney and City Director of Public Works, including but not necessarily limited to the following: a. The provision of proof to the City Attorney that all amendments that may be necessary to any agreements regarding the vacated airspace. pedestrian bridge, and easements have been executed. b. provision of insuronce protection and any other liability protection deemed necessary by the City Attorney, applicable to the vacated air rights and bridge, as per this Resolution. SECTION 3. J RESOLUTION NO. 5275 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCAOIA, CALIFORNIA, DECLARING ITS INTENTION TO VACATE A PORTION OF CERTAIN AIR RIGHTS OF A PORTION OF HUNTINGTON DRIVE THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The public interest and convenience require and it is the intention of the City Council of the City of Arcadia to vacate for public street purposes a portion of' certain air rights of a portion of Huntington Drive, in the City of Arcadia, County of Los Angeles, State of California, more particularly described as follows: That portion of the air space of Huntington Orive (westbound) in the City of Arcadia, County of Los Angeles, State of California, lying above a horizontal plane having an elevation of 460.55 feet (a minimum vertical distance of 16.00 feet above the top of pavement of Huntington Drive as, existed on November 30, 1984), said elevation being based on the official Datum Plane adopted by the City of Arcadia, California, and lying below a horiZJntal plane having an elevation of 474.88 feet based on the official Datum Plane and having a horizontal width of 14 feet laying 7 feet on e~ch side of a center line described as follows: Beginning at the pOint of intersection of the westerly right-of- way line of Huntin9ton Drive (westbound) and the northerly line of the Los Angeles County Flood Control District easement per official records 52232-0198; thence northeasterly along aforementioned westerly right-of-way line of Huntington Drive (westbound) a distance of 413.37 feet to the true point of beginning; thence at right angles to the westerly right of way line of said Huntington Drive (westbound) a distance of 80.00 feet to the easterly right of way line of Huntington Drive (westbound). Reference is made to Plan No. VAS 84-1 (revised .. l/2l/86l, now on file in the office of the City Clerk of the City of Arcadia for further particulars of the proposed' vacation. SECTION 3. Notice is given that the 4th day of February, 1986, at 7:30 o'clock p.m. in the Council Chambers of the City of Arcadia, any and all persons interested in or objecting to the proposed vacation of a portion of certain air rights of a portion of Huntington Drive, may appear before said City Council and show cause why said vacation should not be carried out in accordance with this Resolution of Intention. SECTION 4. The proceedings for the aforesaid vacation shall be taken under an in accordance with an act of the Legislature of the State of California designated and known as the "Public Streets, High\~ays, and Service Easements Vacation Law," as amended. SECTION 5. The Director of Public Works of the City of Arcadia shall cause to be conspicuously posted along the line of the.proposed vacation Notices of Street vacation in the manner and form required by said Law.
