WHEREAS, the Arcadia City Planning Commission has approved
and
adopted
Resolution
No.
1381
conditionally
granting
Conditional Use Permit 88-018; and
WHEREAS, the purpose of this approval was to allow applicant
to maintain the current use of the property for one (1)
additional year for purposes of student transition; and
WHEREAS, the current use is not the legal use pursuant to
previously enacted Resolutions granting Conditional Use Permits
for subject property; and
WHEREAS, Conditional Use Permit 88-018 is to expire no later
than September 1, 1989 for the reasons set forth above; and
WHEREAS, a major condition of Conditional Use Permit 88-018
is that the property owners agree to this term and execute any
and all agreements required by the City Attorney.
NOW, THEREFORE, THE CITY AND APPLICANT AGREE AS FOLLOWS:
1. Applicant as property owner agrees and affirms that the
current use on the property, which was acknowledged by his
application for CUP 88-018 shall terminate no later than
September 1, 1989 at which time the pre-existing Conditional Use
Permit (83-9) shall continue and thereby allow a preschool with
an enrollment of forty-eight (48) students. The use approved by
Resolution No. 1381 to allow kindergarden through eighth grade

eight (58) children shall be for one (1) year only with
termination to be no later than September 1, 1989.
2. Applicant agrees that this document is binding on any
successors in interest, and applicant shall document to the
satisfaction of the Arcadia Planning Director, that all students
and their guardians or parents are notified of the September 1,
1989 termination date.
3. Applicant shall provide proof of ownership of subject
property satisfactory to the Arcadia City Attorney, and shall
execute any other documents or covenants required by the City
Attorney.
4. Pursuant to execution of this Agreement and applicant's
full compliance with the terms hereof, the City shall forebear
from bringing revocation proceedings regarding Conditional Use
Permit 83-9.
Failure to abide by the terms of the agreement and
the provisions of Conditional Use Permit 88-018 shall cause the

City to bring proceedings to revoke Conditional Use Permit 83-9

and terminate the preschool use.
