City Attorney 240 West Huntington Drive Arcadia, California RECEIVED JUL C 197:;; Re: Kipp -' Shandrick property Chicago Park Area CITY OF ARCADIA CITY AlTORNEY Dear Mr. Ogle: Enclosed is a Grant Deed conveying an easement for street purposes over portions of the lots owned by Virgie o. Kipp and Sylvia Shandrick in the Chicago Park Area in the City of Arcadia. As we have discussed in our telephone conversations during the last few days, dedication of this easement to the City of Arcadia will reduce the total area of the lots owned by Mrs. Shandrick and Mrs. Kipp'close to or below the 15,000 square foot minimum as required by the City of Arcadia Municipal Code S9266~2.3. We have been assured that should dedication of this easement to the City reduce their holdings below the 15,000 square foot minimum that such dedication would not render their holdings non-conforming by virtue of Municipal Code S9247.4. Should this dedication reduce their holdings below the 15,000 square foot minimum then Section 9266.2.3 of the Municipal Code would have no application. Accordingly, the enclosed deed is tendered to you on the following conditions: 1) That dedicatio~ of this easement to the City of Ar~~dia will not have the effect of rendering Mrs. Kipp' sand Mrs. ShandrilX'siremaining holdings non-conforming under S9266.2.3 of the Municipal Code. 2) That S9247.4 of the Municipal Code operates to nuInfy the effect of S9266.2.3 of the Municipal Code. 3) That should dedication of this easement render the remaining holdings non-conforming for purposes of M-l development, then the City of Arcadia will re- convey this easement to Mrs. Shandrick and Mrs. Kipp and, at its own expense, restore the land covered by the easement to the condition the land was in prior to dedication thereof.
