HighJand Dvelopment P-?..r...3 CORPORATION QUITCLAIM DEED WHEREAS, on July 7, 1955, CAMDEN WILSHIRE COMPANY, a cor- p~ration, granted to the CITY OF ARCADIA, a municipal corporation, a perpetual easement and/or right-of-way for waterline purposes, to- gether with the right to construct, maintain, operate, repair and renew a watermain therein, over and across those certain parcels of land in said CITY OF ARCADIA, County of Los Angeles, State of Cali- fornia, described as follows: PARCEL 1: That portion of the Northwest one quarter of fractional Section 15, Township 1 North, Range 11 West, San Bernardino Base and Meridian in said City of Arcadia, described as follows: , A strip of land 40.00 feet in width, lying 20.00 feet on each side of the following described centerline: Beginning at the point of intersection of the North line of Tract No. 20211, as shown on map recorded in Book 562, Pages 43 and 44, of Maps, records of said County, with the centerline of Canyon Road, 60.00 feet in width, as shown on said map of Tract No. 20211; thence North 2054'55" East, along the Northerly prolongation of the center- line of Canyon Road, 7.58 feet to the begin- ning of a tangent curve concave to the West and having a radius of 290.00 feet; thence Northerl~ alon~ said curve 158.21 feet; thence North 28 20'36 West, 364.77 feet to the be- ginning of a tangent curve concave to the Southwest and having a radius of 370.00 feet; thence Northwesterly along said curve 119.23 feet; thence North 46048'25" West tangent to said last mentioned curve 81.79 feet, to the beginning of a tangent curve concave to the Southeast and having a radius of 100.00 feet; thence Northwesterly, Easterly and Southeast- erly along said curve 305.71 feet; thence South 51038'46" East, 33.20 feet to a point hereinafter designated as point "A"; thence South 51038146" East, 20.00 feet. The sidelines of said 40.00 foot strip to be lengthened or shortened so as to terminate in the North line of saiu Tract No. 20211. The grantees herein, hereby agree that upon demand from the grantors, their successors or assigns, they will join in the dedication of said easement to the public use without ,. -1- .\ . ) \'! - - further consideration, provided, however, that the grantors, their successors or assigns shall improve said easement as required by the sub- division ordinances of said City of Arcadia. PARCEL 2: That portion of the Northwest one quarter of fractional Section 15, Township 1 North, Range 11 West, San Bernardino Base and Meridian in said City of Arcadia, de- scribed as follows: A strip of land 20.00 feet in width, lying 10.00 feet on each side of the following de- scribed centerline: Be~inning at the hereinbe- fore described point "A'; thence North 38021114" East, 20.29 feet to the beginning of a tangent curve concave to the West and having a radius of 98.00 feet; thence Northerly along said curve 123.84 feet; thence North 34002'55" West, 274.30 feet to the beginning of a tangent curve concave to the East and having a radius of 75.00 feet; thence Northeasterly along said curve 84.62 feet to a point hereinafter de- signated as point "B". A radial bearing to said Point "B" bears North 59024'17" west. The sidelines of said strip of land to be length- ened or shortened so as to terminate on the South in the North line of Parcel I, described herein, and on the North in the Southwesterly line of the hereinafter described Parcel 3. The grantors herein agree to grade and pave said easement with a pavement 12.00 feet in width to the satisfaction and approval of said City of Arcadia. PARCEL 3: The undersigned also hereby grant to Ba~d City of Arcadia for valuable consideration, receipt of which is hereby acknowledged, that certain parcel of land described as follows: That portion of the Northwest one quarter of fractional Section 15, Township 1 North, Range 11 West, San Bernardino Base and Meridian in said City of Arcadia, described as follows: Be~inning at the hereinbefore described ~oint "B in Parcel 2, hereof; thence North 50 12'04" West, 302.95 feet; thence North 39047'56" East, 110.00 feet; thence North 31026'22" West, 332.68 feet; thence South 39047156" West, 217.00 feet; thence South 50012'04" East, 12.05 feet to the point of beginning. -2- .~ - - It is further stipulated that the said Parcel 3, described herein shall be used solely for reservoir, water distribution and re- lated purposes, and not otherwise, and shall not be sold or leased for any other purpose and said City of Arcadia shall not place nor suffer nor permit to be placed on said parcel of land any building of whatever nature except as may be necessary for construction and/ or maintenance of one or more water reservoirs or water tanks, water distribution mains and other related water facilities, and it is further stipulated and agreed that if at any time the herein de- scribed Parcel 3 shall be used for any purpose other than those here- inabove specified, then in that case the aforesaid Parcel 3 deeded herein shall immediately revert to the grantors, their successors or assigns, and shall become vested in the said grantors, their suc- cessors or assigns, the same as if they had never been conveyed by this deed. The grantors herein agree to excavate, fill and grade part of said Reservoir Site to an elevation of 1100 feet above U.S.G.S. Datum Plane, said part to be graded to contain a uniform, fairly level area approximately 260 by 120 feet and as shown on plans for said reservoir site on file in the office of the Water Super- intendent of said City of Arcadia; and, WHEREAS, said grant deed, has never been recorded and does not appear of record; and, WlIEREAS, said CAMDEN WILSHIRE COMPANY and said CITY OF ARCADIA are now desirous of establishing as a matter of record the true status of said grant deed; NOW, THEREFORE, for a valuable consideration, receipt of which is hereby acknowledged, the CITY OF ARCADIA, a municipal corpo- ration, organized under the laws of the State of California, hereby DEMISES, RELEASES and QUITCLAIMS to CAMDEN WILSHIRE COMPANY all of said CITY OF ARCADIA'S rights, title and interest in and to the above-described Parcel 2 and Parcel 3. -3- / J ( j - - IN WITNESS WHEREOF. said corporation has caused its cor- porate name and seal to be affixed hereto and this instrument to be executed by its Mayor and City Clerk thereunto dUly authorized.
