INC.. a corporation, hereinafter referred to simply as "Patricia", and PROFESSIONAL SQUARE. INC.. a corporation, hereinafter referred to simply as "Professional", WIT N E SSE T H: WHEREAS. Patricia is the owner of that certain real prop- erty in the County of Los Angeles, state of California, described as follows: Lot 5. Tract No. 4090, per map recorded in Book 43, page 47, of Maps, Records of Los Angeles County; anti, WHEREAS, Professional is the owner of that certain real property in the County of Los Angeles, State of California, de- scribed as follows: The easterly one-half of Lot 6 and the West- erly one-half of Lot 4, Tract No. 4090, per map recorded in Book 43, page 47, of Maps, Records of Los Angeles County; and, WHEREAS, said Patricia and Professional have constructed and erected certain professional commercial buildings in and upon their respective above described properties; and. WHEREAS, Ordinance No. 760 of the City of Arcadia requires in part that one parking space of at least 250 square feet shall be provided for each 500 square feet of floor space for all commercial bUildings; and further, that when the required off-street parking space is provided on a separate lot from the main building or is provided by the collective use of adjacent properties, such collec- tively used space must ".LOIiDING Rf~rm al be equal to the sum of the requirements of ~.ittl t."";' 6 ......"..."J~'" -1- k=-~"h~,,-~_ _,..,,_ ....,- ~ .. .' ". .., SoaK M161 PAGE'i51 each individual establishment participating in such collective use, provided there be recorded in the office of the County Recorder of Los Angeles County a covenant by the owner or owners of said col- lectively used space that said owner or owners will continue to maintain such collectively used parking space so long as said build- ings are maintained and that said covenant is for the benefit of the City of Arcadia; and, WHEREAS, said Patricia and Professional desire to provide the required parking space for their respective buildings by col- lectively using their properties as provided in said Ordinance No. 760; NOW, THEREFORE. Patricia and Professional by and through their respective duly authorized corporate officers do hereby de- clare, covenant and agree for themselves, their heirs and assigns that no further buildings, other than those already constructed and erected thereon at this time, shall be constructed or erected upon the above described Lot 5, nor upon the easterly one-half of Lot 6, nor upon the southerly 300 feet of the above described westerly one-half of Lot 4. Said parties further declare, covenant and agree that the above described portions of their properties shall be maintained and kept as collectively used parking space as required by the above mentioned Arcadia Ordinance No. 760, so long as the present bUildings heretofore constructed are maintained. This covenant shall inure to the benefit of and be enforc~ ab~e by the City of Arcadia and may be released only by the City of A:t'cadia. '.:... .,'. '. .,....:...~~. :~. ../ ,',' ~ ' , " .. ...... -3- QUITCLAIM OF COVENANT The CITY OF ARCADIA, a municipal corporation. does hereby remise. release and quitclaim all right, title and interest in and to the following described real property in the County of Los Angeles, state of California, to wit: The westerly one-half of Lot 4, all of Lot 5, and the easterly one-half of Lot 6, Tract No. 4090, as shown on map recorded in Book 43, page 47, of Maps, in the office of the County Recorder of said County, acquired by the City of Arcadia solely under or by virtue of that certain Declaration of Covenant executed November 17, 1958, by Professional Square, Inc. and Patricia Medical Square, Inc., and recorded on November 20, 1958, in Book M 161. page 750. as Document No. 4124.
