DECLARATION OF COVENANT RE PARKING
day of
THIS DECLARATION OF COVENANT, made and executed this 17th
April , 1959 by THE PRATT CONSTRUCTION CO., a California
Corporation, of the City of Arcadia, County of Los Angeles, State
of California, hereinafter referred to as Declarant,
vIITNESSETH:
WHEREAS, Declarant is the owner of the South 182.4 feet of
the West 65 feet of Lot 7 and the South 182.4 feet of Lot 8, C. B.
Clapp's Subdivision, as shown on map recorded in Book 31, page 30,
of Miscellaneous Records in the office of the County Recorder of
Los Angeles County; and,
WHEREAS, Declarants propose to use said South 182,4 feet
of Lot 8, C. B. Clapp's Subdivision, for the construction of a com-
mercial building; and,
WHEREAS, Ordinance No. 760 of the City of Arcadia, as
amended, requires in part that one parking space of at least 250
square feet shall be provided for each 500 square feet of floor
space for all commercial buildings, and that when the required off-
street parking space is provided on a separate lot from the main
building, there shall be recorded in the office of the County Re-
corder of Los Angeles County, California, a covenant by the owner
or owners of said lot for the benefit of the City of Arcadia to the
effect that such owner or owners will continue to maintain such
parking space so long as said building is maintained; and,
\iHEREAS, Declarant proposes to maintain upon the South
182.4 feet of the West 65 feet of Lot 7, C. B. Clapp's Subdivision,
the parking spaces required by Ordinance No. 760, as amended, for
the commercial building on said South 182.4 feet of Lot 8, C. B.

NOvI, THEREFORE, KNOW ALL MEN BY THESE

PRESENTS, that De-

clarant hereby certifies, declares, covenants and agrees that it
will maintain upon the South 182.4 feet of the West 65 feet of Lot
7, C. B. Clapp's Subdivision, the parking spaces required by Ordi-
nance No. 760, as amended, for the commercial building located or
to be located on the South 182.4 feet of Lot 8, C. B. Clapp's Sub-
division, pursuant to the requirements, regulations or ordinances
of the said City of Arcadia; that no building will be erected on
said South 182.4 feet of the West 65 feet of said Lot 7 except the
5-foot extension of the marquee attached to the commercial building
erected on the South 182.4 feet of said Lot 8; that said South 182.4
feet of the West 65 feet of said Lot 7 will not be used for any pur-
pose which interferes with nor precludes the parking spaces required
by said Ordinance No. 760 of the City of Arcadia, as amended, and
this Declaration of Covenant.
This Covenant is expressly declared to be for the benefit
of the City of Arcadia and shall be enforceable by the City of Ar-
cadia. This Covenant is binding upon the heirs, executors and as-
signs of the undersigned Declarant.
IN WITNESS WHEREOF, the Declarant has caused its corporate
name and seal to be affixed hereto and this instrument to be exe-
cuted by its President, thereunto duly authorized.
