In connection with the proposed widening of Duarte Road in the City
of Arcadia, the City of Arcadia hereby agrees to purchase from the Owner, and
the undersigned property owner hereby agrees to sell to the City of Arcadia
for the sum and upon the terms and conditions hereinbelow set forth, all that
certain property situated in the City of Arcadia, County of Los Angeles, State
of California, described as follows:
AGREEMENT OF PURCHASE AND SALE

The parties hereto agree that said sum represents the full value
of all property and improvements to be transferred to the City, and includes
all severance damages in connection therewith. Said sum is computed as
fo llows:

Severance damage:
Owner warrants that he has fee title to said property except for
such encumbrances of record as are disclosed by the title report thereon
secured by the City. Concurrent herewith Owner executes and delivers to the
City a grant deed conveying the above-described property to the City, which
City is authorized to record upon payment to'Owner of the sum hereinabove
specified less such portion thereof as Owner agrees may be paid to any
mortgagee or trust deed beneficiary. City shall cooperate with Owner in
obtaining such title clearance, but the obtaining thereof shall be the obli-
gation of the Owner. When all mortgages and trust deeds are released or
reconveyed as to the property hereinabove described and the title report ~
thereon shows such property to be free and clear,. City shall pay to' Owner ~
the amount due hereunder less sums as may have been paid by City with the ~
consent of Owner; provided, however, that unless all required title clear- ~
ances are obtained within 30 days after date hereof, City shall be under no
further obligation hereunder, shall return to Owner any deed received from
him and may thereafter acquire title to aforesaid property by court action.

Upon recordation of the deed to City of the above-described
property in accordance with the terms hereof, City may enter upon such
portion of Owner's remaining land as may be necessary to construct the
proposed street improve~ents and to make the same meet with related im-
