Commencing at the southwest corner of said lot; thence North 251.10 feet,
more or less, to the northwest corner thereof; thence east along the north
line of said lot, a distance of 70 feet to a point; thence south parallel
with the west line of said lot to a point on the southerly line of said lot;
thence westerly along said southerly line 70.285 feet, more or less, to the
point of beginning.
The remaining property described in said Deed of Trust shall continue to be held by said Trustee under

Dear Mr. Johnston:
I have discussed with you on several occasions the widening and improve-
ment of Duarte Road as it will affect your property located at 833 West Duarte
Road.
The Agreement between you and the City, to which this letter is attached
and made a part, sets forth certain items. In addition the City further
agrees:
(1) To pay the sum of $524.12 to compensate you for the elimination of one
parking stall and the improvements thereof.
(2) Construct a cement concrete curb across the frontage of your lot adjacent
to the new street property line, the height to be the difference between
the new property line grade of the street and the present grade of your
property at said property line.
(3) Grade and replace with asphalt concrete your private driveway to compen-
sate for any difference in elevation or grade due to reconstruction of
the new standard cement concrete driveway apron, which is being replaced
by the City.

The owner agrees to furnish to the City upon demand a grant deed to said property,
and to execute all requests for partial reconveyances from holders of trust deeds and
other encumbrances, and to cooperate with the City in obtaining same. Owner warrants
, that he has title to said property, and whether a partial reconveyance is in face ob-
tained or not, owner agrees to hold City harmless for any defect of title, including
such payments, expenses and disbursements as the City may be required to make to clear
the title thereto, the total of such items to be deducted from the gross price above
stated. There shall be no proration of taxes or insurance. The City further agrees
that if it accepts the deed to the property hereinabove described, City will install
curbs, gutters and pavement therein and replace existing sidewalk and concrete drive-
ways, such initial installation and replacement to be at City's sole cost and expense.

This agreement and all terms and conditions thereof shall inure to the benefit
of and shall be binding upon each party hereto and the heirs, executors, administra-
tors, legal representatives, successors and assigns of each party hereto.
