DEfiNITION OF TERMS
The following terms when used In thIS
paltcy mean
(a) "land" the land desCrIbed, speCIfic-
ally or by rdetence, In Schedule C and
Improvements affixed thereto which by law
constitute real property,
(b) "public records" those r~cords
whICh Impart constructive notice of matters
relating to said land,
(e) "knowledge" actual knowledge, not
constructive knowledge or notICe which
may be Imputed to the Insured by reason
of any pubhc records,
(d) "date" the effewve date,
(e) "mortgage" mortgage, deed of trust,
trust deed, or other secunty instrument, and
(f) "Insured" the party or parties named
as Insured, and If the owner of [he in-
debtedness secured by a mortgage shown In
Schedule B 15 named as an Insured In
Schedule A, the Insured shall mc1ude (1)
each successor 10 Interest In ownership of
such mdebtedness, (2) any such owner who
acquires the estate or mterest refen:ed to

(b) Governmental nghts of police power

(c) Title to any property beyond the

Schedule C, or utle to streecs, roads, ave-
nues, lanes, ways or waterways on whIch

4. DEFENSE AND PROSECUTION OF ACTIONS
-NOTICE OF CLAIM TO BE GIVEN BY
THE INSURED
(a) The Company, at ItS own cost and
Without undue delay shall proVide (1) for
the defense of the Insured 10 all IItlgatlOn
conSlsong of actlons or proceedings com-
menced agamst the Insured, or defenses,
restnlJOlog orders, or injunctions lflterposed
agamst a foreclosure or sale of the mort-
gage and mdebtedness covered by thl'i policy
or a sale of the estate or Interest 10 stud
land, or (2) for such action as may be
appropnate to establish the utle of the
estate or IOterest or the hen of the more-

Gentlemen:
Mr. W, A. Mathewson, 55 So. Fifth Avenue,
property to the City for the sum of $13, 000.
Arcadia, has agreed to sell said
The property is described as follows:
"Those portions of Lot 9 of Tract No, 5205, in the City of Arcadia,
county of Los Angeles, state of California, as per map recorded
in book 54 page 61 of Maps, in the office of the county recorder of
said county, and of block 52 of Santa Anita tract, as per map
recorded in book 34 page 41 of Miscellaneous Records, of said
county, lying northerly of a line distant 25 feet north~asterly
(measured radially) from, and concentric with, the northeasterly
line of the 50 foot right of way of the Atchison, Topeka and Santa
Fe Railway Company, as described 1ll the deed dated May 2, 1890,
and recorded in book 661 page 198 of Deeds, records of said county.
EXCEPT therefrom the north 712 feet of said lot 9 of Tract No. 5205"
It is therefore recommended that the City Council authorize the purchase of the above
described property for the sum of $13, 000 and that the City pay closing costs, exclud-
ing any ta;<es due, with the right of the seller to occupy said property up to October 1,
1964, and, further authorize the City Manager to execute escrow instructions on
behalf of the City on a form prepared by the City Attorney,
It is further recommended that the sum of $13, 200 be 'appropriated from Reserve for
Capital Projects Account No. 285 in the General Fund and transferred to Capital
Improvement Projects Account No. 302 - Property Purchase, Combined City Yards.
