gage as IOsured, which litIgatIOn or actIOn
In any of su<:h events IS founded upon an
alleged defect, lten or encumbrance in-
sured agalOst by thiS polKY, and may pur-
sue any lItIgatIOn to flOal determlOatlOn In
the court of last reson
(b) In case any such actIOn or proceed-
Ing shall be begun, or defense Interposed,
or to case knowledge shall come to the In-
sured of any claim of tHle or Interest WhiCh
1S adverse to the title of the estate or 10-
terest or hen of the mortgage as IOsured,
or which might <:ause loss or damage for
whICh the Company shall or may be liable

Gentlemen:
Mrs. Ehzabeth Panks of 53 South F1fth Avenue, has agreed to sell her property to
the City for the sum of $11, 150.
The property is described as follows:
PARCEL XIII
"The south 34 feet of the north 712 feet of lot 9, of Tract No. 5205,
in the City of Arcadia, county of Los Angeles, State of California,
as per map recorded in book 54 page 61 of Maps, in the office of
the county recorder of said county,
EXCEPT that portion lying southerly of a line distant 25 feet north-
easterly (measured radially) from and concentric with the northeasterly
line of the 50 foot right of way of the Atchison, Topeka and Santa Fe
Railway Company, as described in the deed dated May 2, 1890, and
recorded in book 661 page 198 of Deeds, records of said county."
This purchase, if approved, completes the acquisition of the 24 parcels involved in
the acquisItion of the combined yards.
It is therefore recommended that the City Council authorize the purchase of the
described property for the sum of $11, 150 with the right of the seller to occupy said
property up to November I, 1964, and the City to pay closmg costs.
It IS further recommended that the City Manager and City Attorney be authorIzed to
take the neces sary steps to acquire said property and that the sum of $11, 300 be
appropriated from Reserve for Capital Projects Account No. 285 in tl-ie General Fund
and transferred to CapItal Improvement Projects Account No. 302 - Property Purchase,
Combined Yard.
