COND ITIONS AND STIPULATIONS
1. DEFINITION OF TERMS
The following terms when used in this
policy mean:
(a) "land": the land described. specific.
ally or by rdefence, in Schedule C and
improvements affixed thefeco which by law
constitute real property;
(b) "public records": those records
which impart constructive notice of matters
relating to said land;
(e) "knowledge": actual knowledge, not
constructive knowledge or notice which
may be imputed to the Insured by reason
of any public records;
(d) "date"; the effective date;
(e) "mortgage": mortgage, deed of trust,
trust deed, or other security instrument; and
(f) "insured": the party or parties named
as Insured, and If the owner of the In-
debtedness secured by a mortgage shown in
Schedule B is named ;lS. an Insured in
Schedule A, the Insured shall include (1)
each successor in interest in ownership of
such indebtedness, (2) any such owner who
acquires the estate or interest referred to
in this policy by foreclosure, trustee's sale,
or other legal manner in satisfaction of
said indebtedness, and (3) any federal
agency or instrumentality' which is an in-
surer or guarantor under an insurance con-
tract or guaranty insuring or guaranteeing
said indebtedness, or any part thereof,
whether named as an insored herein or not.

2. BENEFITS AFTER ACQIJISITION OF TITLE
If an insured owner of the indebtedness
secured by a mortgage described in Sched-

charge or lien on the estate or interest

in Schedule B unless such Insured acquires
title to said estate or interest in satisfaction

Whenever the Company shall have setrled
a claim under this policy, all right of sub.

Gentlemen:
Mr, Sherwood E. Wise, 17 South Fourth Avenue, Arcadia, the owner of
parcels 4 and 24, has agreed to sell the property described below to the
City for the sum of $43, 500, The property is described as follows:
Parcel 4
Lot 5 of Tract No, 5205 in the City of Arcadia, County of Los Angeles,
State of California, as per Map recorded in Book 54, Page 61 of Maps,
in the Office of the County Recorder of said County,
EXCEPT the northerly 235 feet thereof; and
EXCEPT the northeasterly 25 feet measured at right angels to and
radially from the southwesterly line thereof.

Lot 22 of Tract No. 8504, in the City of Arcadia, County of Los Angeles,
State of California, as per Map recorded in Book 107, Page 56 of Maps
in the office of the County Recorder of said County,

The appraised value of this property is in the amount of $38, 750, however,
the appraisal did not include approximately 4,400 sq ft of land wherein the
underlying fee title was in the name of Wise. This land was previously
dedicated for the sole purpose of an alley or street opening which never
occurred and in view of the fact that we do not propose as a part of the combined
yard site to open a public alley or street along the southerly line of the des-
cribed property, it is necessary that we remove the underlying fee title to
said lands.
We have extended the land value as contained in the appraisers report for the
property in question and such extension places the figure of $43, 500 within the
appraisals submitted.
It is therefore recommended that the City Council authorize the purchase of the
described property for the sum of $43, 500 and that the City of Arcadia pay
closing costs excluding any taxes due with the right of the seller to occupy said
property up to July 1, 1964, and further authorize the City Manager .to execute
escrow instruments on behalf of the City on a form prepared by the City Attorney.
It is further recommended that the sum of $44, 000 be appropriated from
Reserve for Capital Projects Account No. 285 in the General Fund to Capital
Improvement Projects Account No, 302, Property Purchase - Combined City
