DEFENSE AND PROSECUTION OF ACTIONS -NOTICE OF CLAIM TO BE GIVEN BY THE INSURED (a) The Company, at its own cost and without undue delay shall provide (I) for the defense of the Insured in all litigation consisting of actions or proceedings com- menced against the Insured, or defenses, restraining orders, or injunctions interposed against a foreclosure or sale of the mort- gage and indebtedness covered by thiS policy or a sale of the estate or interest in said land; or (2) for such action as may be appropriate to establish the title of the esrate or interest or the lien of the mort- gage as insured, which litIgatIon or action in any of such events is founded upon an alleged defect, lien or encumbrance in- sured against by thiS policy, and may pur- sue any litiration to final determination in [he court 0 last reson. FROM THE OFFICE OF THE CITY MANAGER July 29, 1964 HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL Arcadia, California Re: Acquisition of Property - Combined Yard Site 29 South Fifth Avenue Gentlemen: Mr. Vincent Venuta, owner of subject property, has agreed to sell same to the City for the sum of $14, 500 which has been approved by the Land Disposal and Acquisition Committee of the City Council. The property is described as follows: Parcel VII "That portion of lot 9 of Tract No. 5205, in the City of Arcadia, County of Los Angeles, State of California, as per map recorded in book 54 page 61 of Maps, in the office of the County Recorder of said County, described as follows: Beginning at a point in the easterly line of said lot 9 distant southerly thereon 350 feet from the northeast corner of said lot; thence southerly along said easterly line 50 feet; thence westerly parallel with the north line of said lot 195.35 feet to the westerly line of said lot 9; thence northerly along the said westerly line 50 feet to a point which bears westerly parallel with the northerly line from the point of beginning; thence easterly parallel with the northerly line 195. 35 feet to the point of beginning. " It is therefore recommended that the City Council authorize the purchase of the above described property for the sum of $14, 500 and that the seller have the right to occupy said property up to October 1, 1964 and further authorize the City Manager and City Attorney to take the necessary steps to acquire said ~ ~ -Jf-b/f . . property.
