LEE" County Recorder r."ct!::<~:"'0, ...~' . ~(,-\~:X ['\; ~~'~J"":"\... ,{_.J 1 DECLARATION OF COVENANT ,~'!i rl!i:;~ Q t~~J WILLIAM HOVANITZ and BARBARA JEAN HOVANITZ, husband and wife, hereinafter ~eferred to as Declarants, hereby declare that they are the owners as joint tenants of that certain real property in the City of Arcadia, County of Los Angeles, State of California, described as follows: PARCEL 1: Lots on map recorded of Maps, in the said County; PARCEL 2: That portion of Lot 2 of Tract No. 948, pe~ map recorded in Book 17, page 21, of Maps, in the office of the County Recorder of said County, described as follows: 6 and 7, Tract No. 30284, as,,',shown in Book D-3146 ,pages 205 office of the County Recorder of , Beginning at the northwest corner of said Lot 2; thence North 89042'25" East along the north line of said Lot 2, a distance of 500 feet; thence South 0005' West along a line parallel to the west line of said Lot 2, a distance of 435.60 feet; thence South 89042'25" West along a line parallel to the north line of said Lot 2, a distance of 500 feet to the west line of said Lot 2; thence North 0005' East along said west line, a distance of 435.60 feet to the point of beginning; EXCEPT therefrom the east 350 feet thereof; ALSO EXCEPT therefrom the southerly 115 feet. That in consideration of the approval of the Final Map of Tract No. 30284, hereinabove described as Parcell, Declarants covenant ~ and agree, for themselves, their heirs, successors and assigns, that when Lot 7 of said Tract No. 30284 is sold or offered for sale or when any portion of Parcel 2 as above described is sold or offered for sale, whichever fi~st occurs, an additional twenty-five (25) feet shall be added to the rear of said Lot 7 in order that the rear lot lines of Lots 6 and 7 shall coincide. ~~, -, ! -1- " : . I .. ~~ , BKM2086pc380 Declarants further covenant and agree that within thirty (30) days after the recordation of the final map of said Tract No. 30284, the northerly twenty (20) feet of the masonry wall on Parcel 2 hereinabove described, shall be removed and restricted to a height of two (2) feet above the existing wall footing, and that at such time as the north- easterly corner of Orange Grove and Michillinda Avenue is improved by the City of Sierra Madre and the existing stop bar is relocated, the northerly sixty (60) feet of the remaining masonry wall on Parcel 2 hereinabove described, shall be removed and restricted to a height of two (2) feet above the existing wall footing. The within Declaration of Covenant shall inure to the benefit of, be enforceable by and may be released only by the City of Arcadia.
