AS FOLLOWS:

SECTION 1. That the public health and welfare require the ac-
quisition by the City of Arcadia of the property hereinafter describ-
ed. and that the price of TWO THOUSAND FIVE HUNDRED AND NO/IOO ($2500.00)
DOLLARS, net to seller is a fair and reasonable price therefor.
SECTION 2. That the City of Arcadia does hereby accept from
Aloysius Wawra and Leila M. Waura, his wife, a grant deed dated April 14.
1953, covering the following described real property in the City of
Arcadia, County of Los Angeles. State of California, described as

follows:
The Westerly 153.92 feet of the Southerly 92.5
feet of Lot 25, Tract No.808. as per map record-
ed in Book 16. Page 82 of Maps. in the office of
the County Recorder of said County.

RACE RESTRICTIONS AGREEMENT COVERING VARIOUS PROPERTIES IN THE CITY OF ARCADIA.
AGREEMENT,
THIS AGREEMENT, made and entered into es of this 1st day of Msrch, 1939, by and
between the subscribers hereto,
WITNESSETH: THAT, WHEREAS, the lands in the City of Arcadie," County bf Los Angeles,
State of California, which are now occupied are sb oc-eupied and owne~, with no known
exceptions, exclusively by persons of ,the White or Caucasian race; and
WHEREAS, it is the desire of the Parties hereto that lands withih the City of
Arcaqia continue_to be occupied and owned exclusively by persons of the Whtte or
Caucasian race; and
WHEREAS, each of the parties hereto is the owner of, or has an interest or'estate
in the real property in the City of Arcadia, County of Los Angeles, St~te or California,
designated and particularl~described opposite their respective signatures; and
WHEREAS, it is for the mutual benefit and advantage of each of the parties here-
to, and for the benefit, advantage alld protection of each and every parcel of land
within said City of Arcadia, owned by the respective parties hereto, whether the same
be now occupied or not, that each and every parcel of land within said City of Arcad1~,'
owned by the respective parties hereto, shall be limited and restricted to ownership
and occup~ncy by persons of the White or Caucasian race, and that the same shali be
owned and occupied exclusively by persons of the White or Caucasian race.
NOW, THEREFORE, in consideration of the premises, and in consideration of the
advantages to be derived by each of the parties hereto by the making of this Agree-
ment, and further, in consideration of the benefits which will accrue to the real
property of the undersigned, respectively, or in which they are respectively interested;
IT IS HEREBY MUTUALLY COVENANTED AND AGREED by and between the parties hereto that
each and every of the lots or parcels' of land desigr,ated and particul~ply described
opposite the respective signatures of the'parties hereto shall be forever subject to
the following restrictions and covenants, which shall apply to and be binding upon the
parties hereto, their and each of their heirs, devisees, executors; administrators,
successors and assigns namely:
That no portion or part of said lots or parcels of land ever shall be used or
occupied by, or rented to, or be permitted to be used or occupied by"or rented to any
person not of the White or Csucasian race, and that no person ever shall live upon
said property at any time whose, blood is not ,entirely that of the Caucasian race, but
if persons not of the Caucasian race are kept thereon by such Caucasian, occupant
strictly in the capa~ity'of servants or employees of such occupants, such circumstances
shall not constitute a violation of this covenant,
That no portion or part of said lots or parcels of land ever shall 'be sold to, or
conveyed to, or owned by any person not oT'the White or Caucasian race.
IT IS UNDERSTOOD AND,AOREED that said restrictions and covenants are made for the
benefit of each lot or parcel of land described after the respective signatures of the

parties hereto as against each and every other of said parcels or portions thereof,
and that said restrictions and covenants shall operate as covenants running with the
land, as to each lot or parcel of land so described, and that the same are created
as mutual, equitable servitudes, in favor of each of said lots or parcels as against
each and every other of said lots or parcels,
IT IS FURTHER UNDERSTOOD AND AGREED, and it is hereby expressly declared, that
the foregoing covenants shall inure to the benefit of and bind each and all of the
parties hereto; and that said covenants shall extend to and shall bind the heirs,
devisees, executors, administrators, successors and assigns of the parties hereto,
and of each of them, and that any breach of said covenants or agreements may be en-
JOined, abated or remedied by appropriate proceedings by the parties hereto, or by
any of them, their and each of their heirs, devisees, executors, administrators,
successors and assigns.
IT IS FtJR'~ COVENANTED AND AGllEED, that if any eection, part, clause or word
of this Agreement be declared by Judicial Decree of a court of compentent Jurisdiction
to be void, or should any section, part, clause or word of this Agreement be made
inoperative by any Legislative Enactment, auch Decree of Enactment shall not affect
the other sections, parts, clauses, or words contained herein, which shall continue
to blnd the parties hereto, or any of them, their and each of their heirs, devisees,
executors, administrators, successors and assigns., '
IT IS FURTHER COVENANTED AND AGREED that, in case -it shall be found covenient
or expedient to do so, the signature or signatures of' an)' part of parties may be
subscribed' upon separate instruments containing the same covenants and agreements as
herein contained, in lieu of having all of such signatures appended to one single
copy of the same, an~ that when thus executed all such iJ;lstruments and copies of the
same shall be read together and shall be deemed to be and the same shall constitute
one single instrument, and thet the covenants, and agreements shaU,be deemed to have
been made with and shall bind, ,and shall inure to the benef1 t of each and every other
person who shail' have signed this agreement or ~sePirate copies of ihe same, his and
each of their heirs, executors, administrators, successors and assigns and shall haVe
the same force and effect as thOugh the signatures of all parties had been fixed to a
single copy of this Agreement~' and LAND ESCROW AND SAFE DEPOSIT COMPANY is hereby
requested to cause to be'transcribed by the County Recorder of Los Angeles County,
only the first copy of any group or series of this Agreement cOJ;lsisting of two or
more copies thereof, which may be or are simultaneously filed for record as one
document and to cause to be set forth in the record immediately following the signa-
ture or signatures affixed to said first copy and the legal description of the
proper.ty, set forth therein only the respective signature or signatures, and the legal
description of the properties set forth opposite such'signature or signatures, vhich
are affixed to each of the other copies of this inst~nt, which are filed for record
with,~aid first copy, as one document, and in the order that said copies are arranged
in said document, it being the intent and purpose or each of the parties hereto that
~he record ahall show all executed copies of this Agreement to constitute one single
instrument, and to accomplish this purpose LAND ESCROW AND SAFE DEPOSIT COMPANY, is
hereby authorized and'instructed to delete"at its optiOn prior to the recordation
hereof, all repetition of printed matter contained in all subs~ue~t copies of this
Agreemtnt presented for recordation and it is agreed that such deletion for the
purpose of recordation shall in no vise impair the fOl'Ce and effect to this Agreement,
and the benefits to be derived hereUDder.
