DECLARATION OF COVENANT RE OFF-STREET PARKING

THIS DECLARATION OF COVENANT, made and executed this

7th day of September, 1956, by MERRELL G. PRATT and ~ JEAN PRATT,
husband and wife, of the County of Los Angeles, State of California,
hereinafter referred to as Declarants,
WIT N E SSE T H:
WHEREAS, Declarants are the owners of the Westerly 2j feet
of Lot 6, and all of Lot 30, Block 74, Arcadia Santa Anita Tract,
per map recorded in Book 15, page 89, Map Records in the office of
the County Recorder of Los Angeles Countyj and,
WHEREAS, Declarants propose to construct additional build-
in8S on aforesaid Westerly 25 feet of Lot 6, Block (4, Arcadia Santa
Anita Tract, for commercial purposes; and
WHEREAS, Ordinance No. 760 of the City of Arcadia requires
in part that one parking space of at least 250 square feet shall be
provided for each 500 square feet of floor space for all commercial
buildingsj further, that when the required off-street parking space
is provided on a separate lot from the main building, there si1all
be recorded in the office of the County Recorder of Los Angeles
County, California, a covenant by the owner or owners of said lot
for the benefit of the City of Arcadia to the effect that such owner
or owners will continue to maintain such parking space so long as
said building is maintainedj and,
\iHEREAS, Declarants propose to maintain upon said Lot 30,
Block 74, Arcadia Santa Anita Tract, parking spaces as required by
said Ordinance No. 760 for the commercial building on aforesaid
\'lesterly 25 feet of Lot 6, Block '(4, Arcadia Santa Anita Tractj
NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS, that
Declarants hereby certify, declare, covenant and agree that they
will continue to maintain upon the aforesaid Lot 30, Block 74,

Arcadia Santa Anita Tract, the parking spaces required by Ordinance
No. 760 of the City of Arcadia for the commercial buildings located
or to be located upon said Westerly 25 feet of Lot 6, Block 74,
Arcadia Santa Anita Tract, pursuant to the requirements, regulations,
and ordinances of said City of Arcadia; provided, however, that
Declarants may have the use of said Lot 30, Block 74, Arcadia Sdnta
Anita Tract, for other lawful purposes other than parking spaces so
long as such other uses do not interfere with nor prevent the park-
ing spaces required by said Ordinance No. 760 of the City of Arcadia
and this declaration of covenant. This Covenant is expressly de-
clared to be for the benefit of the City of Arcadia, shall be en-
forcible solely by the City of Arcadia, and may be released only
by quitclaim deed by and from the City of Arcadia.
This Covenant is binding upon the heirs, executors and
assigns of the undersigned Declarants.
IN WITNESS WHEREOF, the Declarants have set their hands and
seal the day and year first hereinabove set forth.
