1. QUESTION: Does the roof system need to meet Title. 24 requirements?
RESPONSE: Specification Section 07210, 2.01, B no. 2 states "Batt Insulation of R3O at ceiling lines."
This indicates roof Batt Insulation is to comply with Title 24. Only "conditioned" spaces require this
Insulation. Spaces such as the Apparatus room, main Electric room and exterior covered areas that
are not conditioned DO NOT require this insulation. See wall Section nos: A8.1O thru A8.3O Mechanical
Floor plans for further clarification.

ALTERNATES
PART 1 -GENERAL
1.01 DESCRIPTION
A. Work Included: Administrative and procedural requirements for Alternates.
1. Refer to Drawings and Technical Specifications sections for technical aftemate requirements.
1.02 ALTERNATES
A. Definition: An Alternate is an amount stated on the Bid Form for certain construction activities defined in the
Bidding Requirements that may be added to or deducted from Base Bid amount if the City decides to accept a
corresponding change in either the amount of construction to be completed, or in the products, materials,
equipment, systems or installation methods described in Contract Documents.
1. Alternates shall Include all supporting elements required, so thatthe combination of any alternate or aftemates
with the Base bid shall be complete. Include as part of each Alternate, miscellaneous devices, accessory
objects and similar items incidental to or required for a complete installation whether or not mentioned as part
of the Alternate.
B. Coordination: Coordinate related Work and modify or adjust adjacent Work as necessary to ensure that Work
affected by each accepted Alternate is complete and fully integrated into the project
C. Notificatlon: Immediately following the award of the Contract, prepare and distribute to each party involved,
notification of the status of each Altemate. Indicate whether Alternates have been accepted, rejected or deferred for
consideration at a later date.
D. List A `List of Alternates" is included at the end of this Section. Specification Sections referenced in the Schedule
contain requirements for materials and methods necessary to achieve the Work described under each Alternate.
E. Contract Time: Except as otherwise specifically provided by the City, complete accepted alternate work within the
time stipulated for the Work in the Agreement.
F. The Contractor shall hold the price on these Alternates for 90 calendar days beyond the date of the Bid Opening,
unless otherwise specified.

1. Fire tests:
a. Coatings and facings (each tested separately):
1. Flame spread Index (ASTM E 84): 25, maximum.
2. Smoke developed index (ASTM E 84): 450, maximum.
b. Specifically approved for use by the authorities having jurisdiction
under paragraph 2602A of the California Building Code.
C. For those portions of the system applied to walls having a fire -
resistive rating, system shall have been tested and shall have met
the conditions of acceptance of Uniform Building Code Standard
No. 7 -1.
d. Potential heat of building materials (Uniform Building Code
Standard No. 26 -1): 6000 Btu per square foot, maximum.
e. Uniform Building Code Standard No. 26 -4: Wall system shall meet
acceptance criteria.
f. Systems not complying with one or more of the above
requirements shall have been specifically approved for use by the
authorities having jurisdiction under paragraph 1713(f) of the
Uniform Building Code.
2. Wind resistance (ASTM E 330): Withstand force of 20 psf acting outwards.

2. Firm regularly engaged in manufacturing a line of repair and maintenance
products suitable for future use with system Indicated.
3. At least 5 years' successful experience in applications similar to those
required for the project.
B. Manufacturer's representative shall visit the site near the beginning of system
installation to verify suitability of substrate preparation and to verify acceptability of
system Installation methods and workmanship.

C. Installer's Qualifications:
1. Approved by system manufacturer.
2. Installers shall have at least 5 years' successful experience in applications
similar to those required for the project.
D. Manufacturer's Requirements:
1. System manufacturer shall certify that the system is suitable for use with
substrates indicated herein and on the drawings.
2. System manufacturer shall review and certify that this specification and the
details shown on the drawings conform to the manufacturer's
recommendations.
E. Regulatory Requirements:
1. Provide a system that conforms to the fire and code requirements
enumerated under the paragraph titled "System Description" and the
labeling requirements enumerated under the paragraph titled "Delivery,
Storage, and Handling."
F. Mock -ups:
1. Construct mock -up of each system configuration and texture. Include
typical edge, joint, sealant, and openings conditions.
2. Notify the architect before constructing mock -ups.
3. Do not install system on project without the architect's approval of mock-
up.
4. Remove and dispose of mock -ups with the consent -;of the architect only
after substantial completion of work of this section is achieved.
A. At Contractor's option, mock -up may be incorporated as a part of
the work.
G. Preinstallation Conference:
1 Conduct conference at project site for purposes of a final review of the
contract documents, manufacturer's instructions, and materials to be used.
2. The contractor, the Installer, the system manufacturer's representative,
other trades as deemed appropriate by the contractor, and the architect
shall be present.
3. Examine actual conditions of substrates to determine whether they are
satisfactory for installation of system.
4. Examine the contract documents relating to system and compare with
system manufacturer's current printed recommendations.
1.06 DELIVERY, STORAGE, AND HANDLING
A. Deliver materials to project site in manufacturer's original packaging.
1. Materials shall bear manufacturer's name, brand name, description of
contents, and identifying markings in the form required by this
specification. Materials not so labeled will be rejected and shall be
Immediately removed from the site.

1.07 ENVIRONMENTAL CONDITIONS
A. Minimum Temperature of Ambient Air and Substrates: 40 degrees F or above and
steady or rising at time of installation and curing of coating materials and for at
least 24 hours thereafter.
B. Hot - Weather Limits: As recommended by system manufacturer and depending
upon air temperature, relative humidity, wind speed, and exposure to sun.
C. Do not install coatings when conditions are outside of specified limits.
D. Partially completed work or work not fully cured that is exposed to the elements in
excess of manufacturer's recommendations may be rejected.
1.08 WARRANTY
A. System manufacturer's standard labor and material warranty.
B. This warranty shall be in addition to, and not a limitation of, other rights the City of
Arcadia may have against the contractor under the contract documents.
C. Warranty Period: 10 years from the date of substantial completion.
1.09 MAINTENANCE MATERIALS
A. Prior to substantial completion, deliver the following materials to the location
designated by the architect:
1. 25 anchors of each type used.
2. One unopened pail of each system coating component used on the project.
1.10 SUBMITTALS

2.03 MIXING
Mix materials in accordance with manufacturer's instructions, using only
manufacturer - approved materials in the instructed quantities. Use only freshly
mixed materials. Apply materials within the time prescribed by the manufacturer
and without retempering, unless specifically approved.

PART 3 -EXECUTION
3.01 EXAMINATION
A. Examine substrates with installer and manufacturer's representative present.
B. Determine whether or not substrate conditions are acceptable.
1. All substrates: Conform to required dimensional tolerances.
2. Verify that moisture barriers are in place and properly shiplapped.
C, Obtain approval of substrates by manufacturer's representative.
D. Correct unsatisfactory conditions before proceeding with installation of system.
3.02 PREPARATION
A. General:
1. Protect adjacent surfaces from contamination during application of
coatings.
2. Schedule flashing and system installation as necessary to produce an
integrated, water -tight envelope.
3. Substrates shall be free of water, moisture, and frost.
3.03 GYP SHEATHING / PLYWOOD SHEATHING SUBSTRATES
A. Mechanical Attachment:
1. Shim where necessary due to unevenness of substrate to achieve a level,
plumb, planar, finished surfacer
2. Do not over -drive fasteners.
3. Sheathing substrates:
a. Drive fasteners squarely into framing members, achieving required
embedment.
b. Fasteners driven into sheathing only will not be accepted and shall
be removed.
4. Form tightly butted, flush surfaced joints between adjacent boards and
adjacent courses. Fill` any gaps. Do not use adhesive to secure filler
pieces,
5. Precisely fit at openings and edges. Ensure that edge of sheathing
conforms to required edge details.
3.04 EXPANDED METAL LATH
A. Install in accordance with system manufacturer's instructions using approved
fasteners and fastener spacings.
1. Metal lath to be discontinuous at control joints.
B. Work materials keeping a wet edge.
C. Complete each application before previous coat cures and is inspected.

3.05 COATINGS - GENERAL
A. Complete each coating in sections by working from joint to joint, from edge to
edge, from corner to corner, or according to other such divisions in the surface.
B. Work materials keeping a wet edge.
C. Complete each application before initial set occurs.
D. Allow each coating to cure before proceeding with subsequent operations.
E. Remove excess coatings from joint trim while still wet.
F. Protect each coating from damage and excessive heat, cold, water, and moisture
while curing.
3.06 JOINTS
A Control Joints
1. Extend control joints full width or height of surfaces.
2. Where vertical and horizontal control joints intersect, interrupt horizontal
control joint to allow continuous vertical joint.
3. Where control joint sections form butt joints or intersections, install trim in
beads of bedding sealant.
B. Install miscellaneous profiles where shown on drawings and where recommended
by system manufacturer.
3.07 BASE COAT
A. Apply a uniform thickness of base coat to insulation.
1. Thickness within system manufacturer's recommended minimum and
maximum.
B. Reinforcing Lath:
1. Install reinforcing Lath at corners of openings.
C. Install corner reinforcement at all outside corners unless otherwise shown.
3.08 FINISH COAT
A. Apply finish coat; thickness within manufacturer's recommended minimum and
maximum.
B. Color and texture shall match approved mock -up.

3.10 TOLERANCES
A. Substrate - maximum variation from plane:
1. 1/4 inch in 4 feet.
B. Major vertical and horizontal lines (external corners, control or expansion joints,
freestanding elements, other conspicuous lines) - maximum variation from plumb:
1. 1/4 inch in 20 feet.
2. 114 inch in any story.
C. Minor vertical and horizontal lines (arises and other inconspicuous lines) -
maximum variation from plumb:
1. 1/4 inch in B feet.
2. 3/8 Inch in 20 feet.
3. 3/8 inch in any story.
0. Finished surfaces - maximum variation from plane (exclusive of specified texture):
1. 1/8 inch in 10 feet.
Coating material minimum and maximum thickness (exclusive of specified texture):
1. As recommended by system manufacturer.
2. If a range or tolerance is not specified by system manufacturer, minimum
thickness at any point shall be as recommended by system manufacturer,
and maximum thickness at any point shall be 150 percent of the
recommended minimum thickness; average thickness overall shaU-fall
within the middle one -third of the minimum -to- maximum range.
3.11 CLEANING
A. Clean finished surfaces in a timely manner if required in order to prevent permanent
discoloration.
B. Remove accumulated dirt from finished surfaces prior to substantial completion but
after completion of adjacent abutting horizontal surface construction (such as
pavements) and after establishment of adjacent turf (if any).
If discoloration or contamination occurs and cannot be removed, or if system
suffers damage prior to substantial completion, then restore, or remove and
replace, affected portions (reworking entire planar surfaces as necessary to conceal
reworked area), using manufacturer's recommended restoration coatings or new
materials meeting the requirements of this specification, as acceptable to the
architect.
3.12 PROTECTION
A. Protection of Work in Progress:
1. Provide temporary covering and other protection as necessary to prevent
spattering of materials on other work.
2. Provide temporary protection for tops of walls and other exposed locations
until permanent construction is Installed.

PART 1- GENERAL
1.1 DESCRIPTION
Vendor directly to provide and install the vehicle exhaust system. The Contractor shall coordinate
their operations with the Contractor -hired vendor to provide infrastructure necessary for a
complete system.

The other Contract Documents complement the requirements of this Section and
apply to this Section.
Division 1 - General Requirements and Section 15100 apply to the Work of this
Section.
3. Where requirements of the Section exceed those in other Contract Documents,
Contractor shall comply with the requirements of this Section.
B. Codes and Regulations:
In addition to complying with the specified requirements, comply with pertinent
regulations of governmental agencies having jurisdiction.
In the event of conflict between or among specified requirements and pertinent
regulations, the more stringent requirements will govern when so directed by the
Engineer.
C. City -hired vendor work included: Work includes, but is not necessarily limited to, the
following.
1. Furnish -8 complete Emergency Vehicle Auto - Disconnect Exhaust Systems of
the Sliding Balancer track type with Pneumatic Grabber Nozzle, as provided by
Plymovent Corporation, 375 Raritan Center Parkway, Edison, NJ 08837, (908)
417 -0808. The Arcadia Fire Department has standardized on this manufacture
and system therefore no substitutions will be accepted.
2. A system of controls shall be furnished and installed complete as hereinafter
described. All wiring, and electrical cable, complete with all electrical accessories
and materials as required for the installation of the control system shall be
furnished and installed under Section of the Contract, but shall conform to the
Specification requirements as set forth under Division 16.

All blocking, framing and wood supports required for the purpose of
accommodating the Mechanical System unless specifically called for under this
Division. The contractor is responsible for the correct location of all such items
and shall bear the expenses covering their omission or improper location.
2. Electrical connections to all motors, electric starters, disconnect and over - current
protective devices, unless specifically called for by this Section, or unless the
equipment is furnished as an integral part of the Mechanical System Equipment,
as hereinafter specified or noted on the Drawings.
3. Line voltage electrical wiring and conduit, except where specifically called for on
the Drawings or hereinafter in this Section.
4. Painting, except when supplied as factory finish, or specifically called for in this
Section or on Drawings.
1.2 QUALITY ASSURANCE
A. Contractor must supply names, addresses and phone numbers of three (3) active and
completed projects within the State of similar or equal scope as outlines within this
specification.
B. Use adequate numbers of skilled workers who are thoroughly trained and experienced in
the necessary crafts and who are completely familiar with the specified requirements and
the methods needed for proper performance of the Work of this Section.
C. Without additional cost to the Owner, provide such other labor and materials as are
required to complete the Work of this Section in accordance with the requirements of
governmental agencies having jurisdiction, regardless of whether such materials and
associated labor are called for elsewhere in these Contract Documents.

1.3 SUBMITTALS
A. Comply with pertinent provisions of Architectural Section.
B. Product data: Within 35 calendar days after the Contractor has received the Owner's
Notice to Proceed, submit 6 copies of the following to the Engineer for approval prior to
acquisition:
1. Materials list of all items proposed to be provided under this Section including, but
not limited to all equipment and mountings, flexible noses and accessories, duct
specialties, flexible connections, controls, piping and accessories.
2. Manufacturer's specifications, catalog cuts, and other data needed to prove
compliance with the specified requirements. All pieces of equipment shall be
clearly identified on corresponding manufacturer's literature being submitted.
3. Shop drawings for the Engineer and Commissioning Authority's review must be
accompanied with a basic representative drawing showing, in plan view, the
overall system layout.
4. All submittals for entire Project shall be submitted at the same time or all may be
rejected until all are included in one submittal package.
5. Owners Manual.
6. Warranties and Guarantees.
7. All submittals shall be bound together in a three hole folder or a three ring binder.
1.4 DESIGN CHANGES CAUSED BY PRODUCT SUBSTITUTIONS
A. Contractor shall pay costs of design and installation for changes resulting from substitution
of alternate products.
B. Acceptance of alternate products by Engineer does not change this requirement.

PART2- PRODUCTS
2.1 STRAIGHT RAIL TRACK
A. Scope of System Operation: The vehicle exhaust removal system shall capture 100 % of
the exhaust emissions directly at the tailpipe of the vehicle and exhaust those emissions to
a specified area safely outside the building. The operating controller shall be designed to
complete this cycle. A pneumatically operated collection nozzle shall be connected to the
motor vehicle's exhaust tailpipe. When the driver starts the vehicle, the exhaust fan will
automatically energize and vent the toxic gases directly to the outside of the building. This
automatic feature shall be achieved by means of a pressure sensor located inside the
exhaust ducting; this pressure sensor shall sense the engines output pressure upon the

first stroke of the engine piston and energize the fan starter. The automatic controller
shall use an adjustable timer to keep the contactors energized for a designated period of
time. Should the operating vehicle not exit the station within the designated preset time
period, a temperature override switch shall be incorporated to override the timer relay.
This override shall be achieved by means of an adjustable temperature sensor located
inside the exhaust ductwork. The adjustable temperature (heat) sensor shall have a
range of 90 -130 degrees. If the vehicle is still running inside the station longer than
anticipated, the heat sensor will override the timer relay. The pneumatic connection
device shall stay connected to the vehicle tailpipe as it travels to the exit door by means of
a pre- engineered Aluminum Rail and Trolley System. The suction trolley is designed to
part rubber sealing lips with minimal friction and allow suction only at the point where the
trolley is positioned. The vacuum pressure created by the fan (negative pressure) seals
the rubber lips. The rail shall be securely attached to the building structure and supports a
flexible hose assembly that moves with vehicle inside the station. As the vehicle nears
the exit door, the pneumatic nozzle connection located at the tailpipe shall release its air
pressure automatically therefore releasing the nozzle from the tailpipe. This shall be
accomplished by means of an uncoupling plate strategically located on the suction rail.
After the system releases from the vehicle tailpipe at the door, it shall retract passively and
remain near the door in a convenient storage position for ease of attachment when
returning to the station. When the vehicle returns to the station, a system operator
manually pulls the flexible hose assembly to the threshold of the entrance door. The
system operator holds the pneumatic connection device approximately 18" from the floor
and at the door threshold. Without bending over, the system operator, in order to avoid
facial exposure to the exhaust gas stream, attaches the pneumatic connection device to
the tailpipe at the door threshold. As the vehicle approaches the station, the driver
momentarily stops. The exhaust fan motor energizes at the same time the connection is
made. Standing straight up with the pneumatic fill valve in his left hand the system
operator shall slide the connection device up against a flanged adapter attached to the
vehicle tailpipe; the operator shall then inflate the pneumatic nozzle around tailpipe. The
cycle is completed as the exhaust fan starts and vents the toxic gases with the pneumatic
connection nozzle firmly attached to the vehicle exhaust pipe. The vehicle then proceeds
to its designated resting position. System must be applicable to be upgraded to a motor
drive return at a future date with no replacement of equipment. Contractor shall provide a
release from the vehicle tall pipe. No exceptions.
B. Rail Material: The rail shall be a one -piece continuous extruded aluminum rail in a
minimum length of 19 feet in an effort to reduce the points of leakage due to seams of
connections. The construction profile shall be of a round profile type, which shall adhere
to the following dimensions. Rail diameter of 6.5" with a rail thickness of 0.175. The
bottom portion of the rail shall have a continuous slot to accept a rubber seal. The rail
material shall be aircraft aluminum alloy type AA -6063. The aluminum track shall be
extruded as a one piece design unit to maximize the structural integrity of the rail and to
minimize joints which may add to possible leakage of dangerous exhaust gases. Extruded
into the rail profile shall be all necessary mounting guides, which will allow for support of
the rail mounting hardware and airline support cable. Mounting channels shall be
provided continuously along both sides of the rail extrusion in order the proper positioning
of all required mounting supports in accordance with codes. The rail shall allow the trolley
/ hose assembly to glide to the door threshold in a safe and effective manner. The
extruded rail channel shall allow the whole rail to remain rigid and shall provide an area to
attach bolts for splicing additional rails together for systems over 19 feet long. The overall
extruded rail lengths shall be 19 foot standard. The rail system shall be equipped with a

hydraulic braking system that limits travel of flex hose as the vehicle exits the building.
The hydraulic brake shall be incorporated into the end cap of the suction rail.
C. Top Mounting Suspension: The top mounting suspension shall be specifically designed to
attach with 2 mounting cleats to the mounting slots that were extruded into the rail profile.
The top suspension mount support shall be zinc plated bright finish and provided with 2
.mounting cleats with (4)- 5116" X %" hex head bolts to attach the mounting support to the
rail.
D. Support Legs: Support leg and mounting feet shall be manufactured and provided by the
supplier of primary exhaust removal system (Equipment Manufacturer). This is to ensure
that the unit is installed as a complete system including the mounting hardware. The
support leg material shall be aircraft aluminum alloy type AA -6063. Supports shall be
standard in 19 feet lengths. A minimum of one support with appropriate bracing shall be
provided for every 10 linear feet of rail profile. The support legs shall consist of a square
outer profile with dimensions no less than 2" OD X 0.1" with 10mm fastening hardware
provided. The vertical adjustable mounting foot shall be capable of attaching the leg
assembly to a ceiling with a 30 degree pitch, complete with 318" hardware necessary for
mounting the leg assembly to the top suspension mount. The horizontal adjustable
mounting foot shall be capable of attaching the leg assembly to the wall, complete with
hardware necessary for mounting the horizontal track to the mounting channel system.
The support leg shall be equipped with round tubular zinc - plated steel knee brace with
pressed ends in standard lengths of 20 ", 30" and 72" inches. The angle shall be
completely adjustable to the leg support and mounted perpendicular and parallel to
direction of the rail. The typical support angle shall be 45 degrees from the centerline of
the factory provided support leg. The standard leg shall be capable of meeting a Seismic
4 requirement.
Vertical support and bracing shall be provided to safely secure the rail profile in
accordance with building code and seismic standards which may apply. A minimum of one
support with appropriate bracing shall be provided for every ten linear feet of rail profile.
E. Hydraulic Brake System: The brake shall be incorporated into the end cap of the suction
rail profile, The hydraulic brake system must incorporate a hydraulic shock capable of
reducing the forward impact of 1 to 4 suction trolleys which may be installed now or in the
future to the exhaust rail system. This hydraulic shock shall be secured to a steel end cap
fabricated of 6.25 diameter steel tubing with a wall thickness of 0.156" welded to a 0.156"
steel plate with formed 90 degree side rails for rigidity. The end cap shall have a
removable circular end plate to facilitate an end feed duct connection and shall be a black
powder coated finish. The hydraulic shock shall be capable of reducing to a full stop the
trolleys in less than 4 ", without physical damage to either the rail profile or trolley that it is
stopping.
Rail Splicing Joint: The splice joint shall be formed aluminum extrusion equal to the
internal diameter of the suction rail profile. The splice shall have a wall thickness of no
less than .190" in thickness and a length of no less than 8" from end to end. The rail
splicing shall be safely secured by no less than 16- 3/8" x 1 '/;' bolts, nuts and lock
washers. Each bolt shall pass through the exterior of the rail profile and splicing joint and
be secured on the inside by a lock washer and nut. Self tapping bolts or screws are not
acceptable.
G. Middle Rail Duct Connection: The rail duct connection shall be rectangular to an 8"
diameter round transition fitting fabricated from 20 gauge galvanized steel with a double

rubber U style lip seal. The rectangular slot shall be 19" long by 1 W high with a 3/8"
external flange to slide into the rail profile.
Trolley Assembly: Trolley Assembly shall be a gantry type trolley with sealed bearing
loaded wheels designed to roll inside the internal rail profile flange. The trolley chassis
shall be galvanized steel epoxy coated with a black finish. The chassis shall be fitted with
a tapered cone. The rubber sealing lips shall have a vulcanized Teflon strip covering 1 '/3"
of the bottom edge of the sealing lip which shall minimize resistance between the cone
and the rubber sealing lips. The exhaust cone transition shall be a tapered slot design
which shall fit inside the suction rail profile. The tapered slot shall be equal or exceed in
area the diameter of exhaust ventilation hose to which it is attached. The trolley assembly
shall be equipped with rubber impact bumpers at both the front and rear of the trolley
chassis to eliminate metal to metal contact which could damage the trolley assembly.
There shall be a system balancer assembly provided to aid in the delivery of the hose to
the exit door. The balancer assembly shall be a self adjusting weight spring tension
balancer with a lifting capacity of no less than 31 lbs. The balancer shall have a minimum
diameter steel cable of .080 and have a safety link connection. The system supplier shall
manufacture both the balancer and the trolley assemblies for the purpose of conveying
the flexible hose to the door exit for automatic release of the pneumatic collection nozzle.
Only a stainless, steel balancer cable will be accepted. No exceptions.
Regulator Assembly: The regulator assembly shall be constructed of cast aluminum. The
regulator shall safely operate with an input pressure of 0 - 200 psi; the output pressure
shall be set at 12 psi. The regulator shall be attached to each trolley chassis to allow for
independent adjustment of each pneumatic collection nozzle. The regulator shall be
provided with needle type adjustment gauge that is clearly marked with the proper
operating range of system.
J. Uncoupling Valve Assembly: Shall be provided to activate the release of the pneumatic
collection nozzle located on vehicle's exhaust pipe. It shall be a whisker type valve that
shall provide a single direction action and affixed to amounting bracket directly onto the
trolley chassis. The valve shall be activated when the whisker switch comes in contact
with a disconnect plate located on the side of the rail profile. The disconnect plate shall
provide activation of the uncoupling valve switch mounted on the suction trolley chassis.
The disconnect plate shall be capable of being mounted anywhere along the outside of
the rail in a manner that allows for easy adjustment. No holes shall be drilled into the rail
for the mounting of the disconnect plate. One disconnect plate shall be provided for each
trolley that is provided to allow for independent adjustment of exit speeds.
K. Upper Flexible Hose: Hose shall be flexible exhaust hose manufactured for the sole
purpose of venting high temperature exhaust gases which are produced by internal
combustion engines. The flexible hose shall be designed strictly for the harsh
environment of rapid response and auto - release of a vehicle exhaust tailpipe. Hose shall
range from 3" — 5" diameters with varying lengths depending on the system length
required ranging from 20 - 43 feet without joining or splicing connections. Hose material
shall be high temperature synthetic rubber impregnated into a high temperature laminated
fabric with a minimum overlapping thickness of 2 7116 ". This construction of hose must be
capable of operating at continuous temperatures of 400 degrees F and intermittent
temperatures of 500 degrees F such as are experienced when pump checks are
performed inside the station. Independent testing by a recognized UL laboratory must
accompany the bid document as proof of performance claim. The wire helix shall be
bound and protected in laminations of hose winding. This shall be accomplished in a
fashion which eliminates any possibility of personnel coming in contact with an exposed

hot metal helix. The hose shall further protect the internal wire helix from heat buildup and
in turn add increased visibility to personnel. Wear strip shall be 9/16" wide and shall be
provided as a safety yellow color. The bend radius of the high temperature hose shall be
no less than 1.5 times the diameter of hose to ensure that hot gases are not restricted as
they pass through the system.
L. Lower Hose Assembly: Shall be a rigid 3" -5" diameter by 2 foot long section of yellow and
black hose identical in appearance to the upper hose assembly. Lower hose shall support
the pneumatic connection nozzle and chrome reducing elbow in a rigid fashion to allow for
the operator to place hose collection nozzle onto the tailpipe without bending over. Lower
hose is the only section of hose which shall disconnect from the upper hose assembly and
shall act as a safety disconnect in the unlikely event the nozzle gets entangled.
M. Safety Disconnect Coupling: A (4) part segmented coupling with removable wear strips to
protect the vehicle and disconnect from wear. The coupling shall be incorporated in the
design of the system enabling the lower two foot hose assembly to physically separate
from the upper hose assembly thus reducing the possible chance of damage to system in
the unlikely event the exhaust connection nozzle assembly may become entangled in the
undercarriage of the vehicle. This device shall consist of two spun aluminum collars
connected by a reusable- segmented coupling band. The release tension of this device
shall be preset at 130 Lb. and adjustable from 20 Lb. to 206 Lb. of separating force to
accommodate varying exit speeds of vehicles. Shall be reusable. This is considered a
safety requirement and any system bid must incorporate a safety disconnect. No
Exceptions.
N. Collection Nozzle Assembly: The nozzle shall provide a substantially air tight seal around
exhaust tail pipe when connected thus allowing for 100% source capture. The seal shall
not allow for escape of life threatening exhaust gases, which may be present during the
following conditions:
In the event vehicle's engine is accelerated above normal idle resulting in an
exhaust velocity greater than 5000 feet per minute.
2. In the event that the output velocity or CFM of the exhaust exceeds the
manufacturers normal capture velocity or CFM of exhaust system.
The Nozzle shall automatically adjust its internal orifice to accept any tailpipe ranging from
one inch through six -inch diameter. If required the bidder of the nozzle shall offer both
maximum diameter nozzles ranging from 4.75" diameter to 8.25" diameter. The nozzle
pressure shall not exceed 15 psi. when connected to the vehicle's tailpipe. Nozzle
construction shall be high temperature synthetic rubber vulcanized to a high temperature
synthetic fabric. A NOMEX inner liner shall be provided for the primary temperature
source at the tailpipe to act as a friction barrier. The chrome - reducing elbow that
connects to the connection nozzle shall be fabricated using continuous welded
construction. This important feature eliminates the escape of any potentially lethal
exhaust gases and must provide for a smooth air flow transition from connection nozzle
into the high temperature flexible hose. The angle of transition shall be no less than or
greater than 67 degrees from the centerline of the reducer. The chrome - reducer shall
incorporate a primary expanded metal debris screen, which is permanently affixed by
welded seams to the inside opening of exhaust fitting. Since this item is a point of safety
for both personnel and the system itself, no exception will be allowed.

O. Manual Fill Valve: A manual connection fill valve shall be located 1 foot above safety
release coupling approximately 4 feet from floor and shall be of a sliding /push button type
for manual or automatic release. In its, design this valve shall incorporate in its design a
handle which the operator may easily operate in a standing position. The attachment of
the collection nozzle shall not position the operator's breathing zone closer than 36" from
the exhaust tailpipe. The automatic release of the connection valve shall be no greater
than 3 psi. shift pressure to activate the automatic nozzle deflation. The primary air supply
shall be accomplished by means of a compression type fitting. The regulated air supply
line to collection nozzle shall be designed to safely release from the upper hose at a
pressure no greater than 80 lbs. Since this is a safety item no exception will be allowed.
P. Compressed Air Features: Airlines shall be Y:' (6mm) OD tubing capable of exposure of
high temperature air stream inside the ventilation hose and duct. The airlines shall be fed
through the exterior of the hose through Teflon and brass grommets. The airlines shall be
fed through the exterior of the duct through high temperature rubber grommets to protect
against abrasion. Unless a fire station air compressor is to be utilized the bidder shall
provide a quiet operating compressor to be located proximate to the vehicle bays. It shall
also be located so that preventative maintenance can be performed quickly and
effectively. The operation of the compressor running inside station shall not generate
sound decibels in excess of 25 dB. The compressor shall be equipped with a filter /dryer
to ensure the conveyance of clean dry air to the pneumatic controls incorporated in the
auto - release ventilation system.
Q. Hose Saddle: A hose suspension saddle shall be fabricated of a rubber molded cushion
specifically manufactured for the sole purpose of suspending high temperature exhaust
ventilation hose in a rapid response and auto - release application. The design of the
saddle shall smoothly transition the direction of the hose during its travel along the track.
Securing clamps shall be provided including a link fastener, for the purpose of mounting it
to the balancer safety link.
R. Special Features: The system must be designed to expand for future apparatus to a
tandem vehicle arrangement (one vehicle behind the other) by adding to the proposed
system. Systems that require replacement of the existing system or major components to
meet a tandem vehicle arrangement shall not be accepted. A special emergency
disconnect feature shall be optional to enable the vehicle to back off the system through a
rear exit door. Unique occasions may require the emergency vehicle to depart from the
back door in a drive through station. Also a malfunction of the front over -head door may
force the vehicle to exit from the station outside the confines of normal operation. Overall
system design and performance shall be for both back in and drive - through configurations
when applicable. This feature assures door to door coverage and collection of dangerous
exhaust gases from the point of connection at the doorway.
S. Vehicle Tailpipe Modification: The bidder shall supply a drawing for the precise
modification procedure for the vehicles to attach to the exhaust removal system. The
modification shall vent the exhaust gases at a 90- degree angle on the passenger side of
the vehicle. Tailpipe modifications requiring a 45- degree angle of exhaust venting shall
not be acceptable, in order to prevent exhaust blowback into the station after the auto -
release system disengages from the tailpipe. A flange shall be provided and installed by
the bidder as a precisely located stopping point for the collection nozzle. The
manufacturer's supplied adapter shall securely attach to the vehicle tailpipe. The flange
shall be fabricated from 14 gauge- zinc - plated steel. The attachment to the tailpipe shall
be made by a U bolt for ease of adjustment.

2.2 SLIDING BALANCER TRACK
A. Track shall be one piece continuous extruded aircraft aluminum type AA -06063 in a
minimum length of 20 feet. Construction profile shall be a boxloc Type profile which
adheres to the following dimensional data. Track height TV% Track width 1 W, Track
Thickness 118 ".
B. Telescopic vertical support mounting legs to be adjustable form 4 ft. To 7.5 ft. In 1"
increments.
C. If telescopic vertical supports exceed 2% horizontal side bracing is necessary. Horizontal
side bracing to be 45 tubular steel, 2 ft. Long by 1" in diameter. Braces will be chrome -
plated finish.
D. Traveling trolley to be .25" electrogalvanized steel with four steel ball bearing rollers.
E. Trolley stops to be .25" electrogalvanized steel plate with adjustable threaded bolt. Trolley
stops to be provided for each end of horizontal track.
F. Flexible vehicle exhaust hose to be 4" diameter, consisting of 4 -ply black high temperature
composite impregnated fabric laminated over a spring wire helix bound with a protective
yellow wear strip to allow for high visibility of hanging hose by personnel. Flame retardant
to UL 94V.0.
G. Pneumatic low pressure air regulator to have easy to read pressure needle gauge and
adjustable regulating knob with locking set screw.
H. Manual inflation /deflation (MFD) valve to be push- button and provided with automatic
deflation switching and exhaust port for bleeding of pneumatic nozzle. Provided with this
valve shall be automatic safety break -away feature for pneumatic nozzle. Provided with
this valve shall be automatic safety break -away feature for pneumatic air line which
supplies pneumatic nozzle.
Uncoupling valve shall be mounted to an easily moveable adjustable mounting bracket to
accommodate the varying exit speed of the fire and will automatically activate the exhaust
port of the manual fill and deflation valve described in 1 -H.
High temperature supply and blow -down pneumatic lines must be installed within 4"
diameter exhaust hose, and fed through close tolerance eyelets at fill valve, to protect and
eliminate tangling or fouling of pneumatic lines on apparatus.
K. System must release both ways if bay is drive through.
2.3 ELECTRICAL CONTROLLERS (Minimum of 2 shall be furnished and installed)
A. Clean Filter Indicator Alarm: This standard feature shall be used in conjunction with the
Unifilter for filtering diesel exhaust particulate before release to the atmosphere. The
clean filter indicator shall monitor the pressure loss across the filter bank media. Once the
useful life of the filter has been depleted the pressure differential switch will signal a high -
pressure loss and flash the "Fan On" indicator while the exhaust blower is running.
B. Remote Alarm: Shall monitor the system and advise when a preset number of emergency
runs on the system have accrued.

C. No Airflow Alarm: Shall monitor the system and advise when the exhaust fan is not
functioning properly.
D. Carbon Monoxide Alarm: Shall monitor the carbon monoxide levels inside the apparatus
bay area.
2.4 PNEUMATIC GRABBER NOZZLE
A. To be made of molded high temperature polymer composite and constructed of a multi -
layer dual air bag lined and reinforced with kevlar synthetic cord. Nozzle to have four
panel inflation pattern capable of internally expanding to accommodate tail pipes from 1"
threw 6" in diameter. Nozzle and reducing elbow will not exceed 5 lbs. Nozzle's grabbing
strength to be 10 threw 15 psi under normal use and shall have a maximum bursting
pressure of 100 psi. Nozzle to have grabber lock seal connection between nozzle and 1
piece 45 degree reducing elbow. A total of 8 Grabber nozzles including hose shall be
provided.
2.5 SPRING COIL BALANCER
A. To be totally enclosed cast aluminum with adjustable weight and cable return control
feature. Balancer must have a lifting capacity of 31 lbs, and a cable length of 8 ft. and be
made of high grade stainless steel aircraft cable terminated with a stainless steel one way
safety link.
2.6 SUSPENSION HALTER (SADDLE)
A. To be made from a heavy duty molded rubber cushion that is attached to the hose by way
of a stainless steel hose clamp and D ring fastener.
2.7 SAFETY DISCONNECT COUPLING
A. To be made up of two spun aluminum collars. The two collars will be held together by a
reusable rubber mating band. The reusable breakaway mating band will have a maximum
release tension not to exceed 50 lbs. One collar must,have an expanded 'metal debris
screen to keep foreign material out of exhaust system and blower.
2.8 EXHAUST FANS
A. Fan housing shall be spark resistant aluminum cast construction and be manufactured as
a two -piece split housing with silicon seal for easy maintenance.
B. Fan impeller shall be radial blade type and be constructed of cast aluminum spark
resistant material. Fan wheels shall be both statistically and dynamically balanced.
C. Fan shall be high pressure blower and have a minimum CFM and static pressure gauge
capacity as following, to overcome standard duct losses.

D. Fan shall be direct drive motor mounted steel or aluminum mounting base.
Fan housing shall be provided with Teflon shaft seal to prevent motor shaft sparking,
interrupting turbulence and drying of motor bearings.
Fan shall be properly supported and structurally braced to prevent excess vibration and /or
movement and mounted on spring isolators.
G. Fan shall be provided with arrangement as shown and with discharge muffler.
All fans shall be tested in accordance with AMCA Standard #210 in an AMCA approved
test facility.
Fan shall be AMCA Type A construction.
J Two (2) 5 HP exhaust fans 00 2,000 cfm & 8 inch wq shall be furnished and installed.
2.9 MOTORS
A. All motors shall be supplies as Totally Enclosed Fan Cooled (TEFC).
B. Motor shall be three - phase.
C. Motor shall comply with UMC Chapter 1103 (A).
2.10 PRODUCT CONVEYING AIR DUCTS
A. Round duct to be galvanized steel spiral pipe and have positive airtight sales.
90 and 45 elbows shall be 1.5 diameter radius, one piece airtight welding, die stamped or
welded gore construction.
C. Tapers, laterals, and fittings to be airtight.
D. The following UMC Codes shall apply: Chapter 6 and Appendix A; 6 -1 and 6 -2.
E. Minimum Conveying Velocities shall be 3500 feet per minute.
F. FILTER SCRUBBER: Furnish & install two (2) filter scrubbers with 98% efficient main filter
& aluminum mesh pre - filter alarm which activates when filter requires changing.
2.11 FAN STARTER
A. Controller Logic: Shall be designed to sense the output pressure which is normally
generated by any internal combustion engine designed to propel any motor vehicle. The
operating logic shall be designed to complete this cycle, at any point in time, when a
collection device is connected to a motor vehicle's exhaust tail pipe and at which time the
vehicle is manually or automatically energized and at which time the vehicle is manually or
automatically energized by the operator. This controller shall in turn automatically sense

the engine's output pressure and in turn energize the electrical contractors which will
provide proper full load amperage to the exhaust system motor. The controller through
the use of a three minute fixed timer shall keep the contactors energized for the three
minute minimum fixed time. If the responding vehicle does not disconnect from the
exhaust ventilation system in less than the prescribed three minute setting, a temperature
override switch shall override the fixed timer delay relay to ensure continuous system
operation for as long as the exhaust gas temperature being transported through the duct
system is in the excess of 130 degrees Fahrenheit. At no time during this cycle shall the
controller allow the exhaust ventilation fan to short cycle by stopping and staring
anywhere during the period of time that the vehicle is connected to and operating on the
ventilation system.
B. _ Certification /Approvals- electrical controller offered to the department shall be approved by
Underwriters Laboratories (UL) as a complete electrical system for enclosed industrial
control panels.
C. UL Rating - Electrical controller shall be UL listed /approved and manufactured in
accordance with Underwriter Laboratories standard UL -508 enclosed industrial control
panels. The electrical trolley shall include a limited energy control circuit.
D. Electrical Enclosure: Shall be NEMA 12 rated and UL listed as Type 12.
E. Enclosure Keylock: Shall be provided and mounted in electrical enclosure to restrict
access to internal components of controller by only authorized entry.
F. Control Transformer: To be UL listed industrial control circuit transformer with primary and
secondary fuse blocks. Transformer shall be provided with multitap primary 208V through
480V, AC, and 24V through 120V secondary.
G. Electrical Timer: Shall be solid state, 3 minute fixed timer. Operating logic shall complete
this cycle. Input voltage is applies to the timer at all times. Upon closure of a normally
open isolated start switch, the load energizes and remains energized as long as the
switch is closed. When the start switch opens, the load de- energizes and the timer is
ready for a new timing cycle. Timer shall be UL Recognized component under file number
E65038.
H. Engine Start Switch: Shall be engine pressure type capable of recognizing the output
pressure of any type of motor vehicle. Electrical contact shall be dry type or not exceed
24V.
I. Temperature Override Switch: to be closed on rise type to enable continuous system
operation after the fix time delay relay has completed it's timing cycle.
J. Push To Stop Button: Shall be Allan Bradley illuminated amber contact push button. This
device shall meet UL Type 4X rating. Indicator Iightfstart button shall be mounted on the
enclosure cover and be identified by engraved ledger plate.
K. Wiring: Shall be run in wire channel to allow for easier identification of wiring circuit and
appearance. All wiring circuitry shall meet UL listed for proper bending radiuses and
terminations.
L. Terminal Block: Shall be 600V, UL•rated, recognized and shall provide individual
connection points for remote controls, power and motor connections.

M. Wiring Identification: Shall be computer generated and identity all terminals, fuses,
contactors, and both supply and termination points.
2.12 SUPPORTS
A. All Supports shall comply with UMC Chapter 6 and Appendix 6 -1 and 6 -3.
Structural design shall conform to AISC.
2.13 COMPRESSOR
A. Compressor for air supply to pneumatic grabber nozzles to be a #4B227, 20 gal tank,
115/208/230 volt, single phase, 15 amps. @ 125 psi maximum working pressure.
B. At the discharge side of the compressor, Contractor will install a "T" fitting with plug.
Location of "T" fitting will be in compliance with Owner's direction.
2.14 COMPRESSED AIR PIPING
A. Provide all compressed air piping from compressor location or compressed air piping in
building to all vehicle exhaust pickup points.
Piping shall comply with compressed air piping section specification Section 15400.
PART 3 - EXECUTION
3.1 CONTRACTOR TRAINING
A. Contractor /installer(s) must complete manufacturer's training course and must obtain
certificate of completion from manufacturer prior to start of installation.
3.2 SURFACE CONDITIONS
A. Examine the areas on conditions under which Work of this Section will be performed
Correct conditions detrimental to timely and proper completion of the Work. Do not
proceed until unsatisfactory conditions are corrects.
3.3 COORDINATION
A. Coordinate as required with other trades to assure proper and adequate provision in the
Work of those trades for interface with the Work of this Section.
3.4 PREPARATION
A. Holes in concrete:
Provide sleeves, accurately dimensioned and shaped to permit passage of items
of this Section.
B. Flashing:
Where items of this Section penetrate the roof, outer walls, or waterproofing of

any kind, provide under this Section all base flashing and counter flashing
required at such penetration.
3.05 GENERAL INSTALLATION REQUIREMENTS
A. Mount piping, ductwork, and equipment in spaces provided unless specifically shown
otherwise. If spaces are inadequate, notify Engineer in time to avoid unnecessary Work.
Do not cut or notch structural members without specific approval of the Engineer.
B. Follow manufacturer's instructions on items not specifically covered in drawings and
specifications. Report discrepancies to Engineer for clarification before starting Work.
$.06 EQUIPMENT INTERFACE
A. For electrically operated equipment, verify the electrical characteristics actually available
for the Work of this Section and provide equipment meeting those characteristics.
3.07 PAINTING
A. For roof - mounted equipment, provide factory prefinish on all exposed surfaces.
1. Touch -up scratches and abrasions to be invisible to the unaided eye from a
distance of 5 feet.
3.08 INSTALLATION OF EQUIPMENT
A. All equipment shall be delivered to the Project site with all surfaces clean and free of loose
dirt and rust. Special care shall be exercised by the Contractor to store the equipment in
a clean area to prevent the accumulation of dirt prior to installation. If possible, the
Contractor should arrange to deliver equipment to the project site and store on the floor of
the area in which it is to be installed.
B. Before installation of all equipment, the Contractor shall inspect each piece and wipe all
internal and external surfaces clean. At the end of each Work period, or when ends of
hoses are left open, the open ends shall be tightly closed off with a plastic sheet and
taped securely to the open end of the hose.
3.09 CONTROL INSTALLATION
A. Install wiring and tubing parallel to walls and floors and securely clipped to structure or
mechanical system components. Group parallel runs for neat appearance.
B. Upon completion of the installation calibrate all equipment and adjust controls for proper
operation.
3.10 WARRANTY AND SERVICE
A. Contractor must warrant system, which includes all equipment, electrical, ductwork, and
labor for a period of two years from date of certification of start up. Warranty will not
include misuse and /or abuse of system.
B. Contractor must show standing inventory of spare parts located within the State of
California and allow on -site inspection of parts so needed.

C. Contractor must have on -staff duly certified personnel who have completed
manufacturer's training for service.
D. The fire station will be provided with a Firefighter's training video outlining normal use and
operation of the system.
3.11 MECHANICAL SYSTEM START -UP RESPONSIBILITY
A. Start up all Mechanical Systems, and perform any such Work as may be required to
adjust the systems to meet the requirements of the Contract Documents.
3.12 OPERATION OF SYSTEM
A. Upon the vehicle's return to the apparatus room of the firehouse, a four inch flexible hose
equipped with Pneumatic Grabber Nozzle is attached to the tailpipe of the vehicle, and is
inflated by a manual fill valve located on the flex hose. The vehicle can then be moved
into the firehouse and parked in its designated position.
B. As the vehicle leaves the apparatus room, the flexible hose with the grabber nozzle
travels along the Sliding Balancer Track configured with a spring coil balancer. The
balancer is used to keep excess hose slack from the floor and away from the apparatus.
At the end of the travel of the Sliding Balancer rail, the uncoupling valve releases the
compressed air from the grabber nozzle, allowing for smooth uncoupling of the exhaust
system.
C. Exhaust nozzles must be Pneumatic Grabber Type with a positive seal connection to the
vehicle tailpipe.
D. The system must allow for drive through -type apparatus room bays.
E. Contractor must provide apparatus exhaust modification estimates, if required for system
functionality.
3.13 COMMISSIONING
A. A Commissioning Authority, whose services will be provided by the City, will direct and
coordinate the commissioning process and approve commissioning work. The
Commissioning Authority will work with the Contractor according to protocols established
in the Commissioning Plan.
3.14 FIELD TRAINING
A. The Contractor shall conduct a training course for operating and maintenance personnel
as designated by the City Engineer. Training shall be provided for a period of 8 hours of
normal working time and shall start after the system is functionally complete but prior to
the performance tests. The field instruction shall cover all of the items contained in the
approved Operating and Maintenance Instructions.

This Contract is made and entered into this %11f " day of JUA -Z-0 - 2006, by and
between the CITY OF ARCADIA (hereinafter called the "Owner") and G -2000 CONSTRUCTION,
INC. (hereinafter called the "Contractor").
2. RECITALS.
2.1 The Owner is a charter City organized under the laws of the State of California, with
power to contract for services necessary to achieve its purpose;
2.2 Contractor, in response to a Notice Inviting Bids issued by Owner on May 2, 2006,
has submitted a bid proposal for Fire Station 105 described in the Contract.
2.3 Owner has duly opened and considered the Contractor's bid proposal, and duly
awarded the bid to Contractor in accordance with the Notice Inviting Bids and the other Bid
Documents, and has given written notice to Contractor on June 7, 2006.
2.4 Contractor has obtained, and delivers concurrently herewith, Performance and
Payment Bonds and evidences of insurance coverage as required by the Contract.

The above documents, including the General Conditions, are an integral part of the Contract
Documents. In addition to signing this Contract, Contractor shall initial this paragraph immediately
below acknowledging that he or she has read, understood and agrees with all of the terms of the
Contract Documents, including, but not limited to, provisions of the General Conditions relating to
indemnification, insurance, standards of performance, termination, compensation and time of the
essence performance. Contractor shall not disclaim knowledge of the meaning and effect of any
term or provision of the Contract Documents, and agrees to strictly abide by their meaning and
intent. In the event that Contractor fails to initial below, the Owner shall have the right to
declare the Contract unexecuted and to award the Contract to another contractor in
accordance with state law.

3.2 Contractor's Basic Obligation.
Contractor promises and agrees, at its own cost and expense, to furnish to the Owner all
labor, materials, tools, equipment, services, and incidental and customary work for the construction
of Bid Category number(s) necessary to fully and adequately complete Fire Station 105, including
any alternates selected by the Owner, and all structures and facilities described in the Contract
(hereinafter the "Work "), for a total of SEVEN MILLION ONE HUNDRED SIXTEEN THOUSAND
DOLLARS AND NO CENTS ($7,116,000.00), as specified in the Contract Bid Forms submitted by
the Contractor in response to the above referenced Notice Inviting Bids. Such amount shall be
subject to adjustment in accordance with the applicable terms of this Contract. All Work shall be
subject to, and performed in accordance with the above referenced documents.
3.3 Standard of Performance.
Contractor shall perform all Work under this Contract in a skillful and workmanlike manner,
and consistent with the standards generally recognized as being employed by professionals in the
same discipline in the State of California. Contractor represents and maintains that it is skilled in the
professional calling necessary to perform the Work. Contractor warrants that all employees and
subcontractors shall have sufficient skill and experience to perform the Work assigned to them.
Finally, Contractor further represents that it, its employees and subcontractors have all licenses,
permits, qualifications and approvals of whatever nature that are legally required to perform the
Work, and that such licenses and approvals shall be maintained throughout the term of this
Contract.

3.4 Period of Performance.
Contractor shall perform and complete all Work under this Contract within 450 Calendar
Days, beginning ten (10) Calendar Days afterthe date on which the Letterto Proceed is sent bythe
Owner to the Contractor. The work shall commence approximately 30 days from the date of the
notice of award letter. Moreover, Contractor shall perform its Work in strict accordance with any
completion schedule, construction schedule or project milestones developed pursuantto provisions
of the Contract, including but not limited the Project Schedule located in the Specifications.
Contractor agrees that if such Work is not completed within the aforementioned period
and /or pursuant to any such completion schedule, construction schedule or project milestones
developed pursuant to provisions of the Contract, including but not limited to the Project Schedule
located in the Specifications, it is understood, acknowledged and agreed that the Owner will suffer
damage. Pursuant to Government Code Section 53069.85, Contractor shall pay to the Owner as
fixed and liquidated damages the sum of one thousand dollars ($1,000.00) PER DAY as provided
by the applicable provisions of the General Conditions, found in Part "B" of the Contract Appendix.
3.5 Owner's Basic Obligation.
Owner agrees to engage and does hereby engage Contractor as an independent contractor
to furnish all materials and to perform all Work according to the terms and conditions herein
contained for the sum set forth above. Except as otherwise provided in the Contract, the Owner
shall pay to Contractor, as full consideration for the satisfactory performance by the Contractor of the
services and obligations required by this Contract, the above referenced compensation in
accordance with compensation provisions set forth in the Contract.
3.6 Contractor's Labor Certification.
Contractor maintains that he is aware of the provisions of Section 3700 of the California
Labor Code which require every employer to be insured against liability for Worker's Compensation
or to undertake self- insurance in accordance with the provisions of that Code, and agrees to comply
with such provisions before commencing the performance of the Work. A certification form for this
purpose is attached hereto as Exhibit "A" and incorporated herein by reference, and shall be
executed simultaneously with this Contract.
3.7 Attomeys' Fees.
If either party commences an action against the other party, either legal, administrative or
otherwise, arising out of or in connection with this Contract, the prevailing party in such action shall
be entitled to have and recover from the losing party reasonable attorneys' fees and all other costs
of such action.
3.8 Successors.
The parties do for themselves, their heirs, executors, administrators, successors, and
assigns agree to the full performance of all of the provisions contained in this Contract. Contractor
may not either voluntarily or by action of law, assign any obligation assumed by Contractor
hereunder without the prior written consent of the Owner.
