Dear Mr. Miller:
This Letter of Agreement ( "Agreement ") shall be our agreement regarding the "My
Favorite Book" Photo Project at the Arcadia Public Library ( "Library") described below
( "Project "), to be provided by Terry Alan Miller— Photography ( "Consultant ") as an
independent contractor to the City of Arcadia ( "City ").
The scope of services ( "Services ") to be provided by Consultant are more particularly
described in the proposal submitted to City by Consultant, dated August 24, 2007, attached
hereto as Exhibit "A" and incorporated herein by reference.
Consultant shall perform all Services under this Agreement in a skillful and competent
manner, consistent with the standards generally recognized as being employed by
professionals in the same discipline in the State of California, and consistent with all
applicable laws. Consultant represents that it and its employees have all licenses, permits,
qualifications and approvals of whatever nature that are legally required to perform the
Services, including a City Business License, and that such licenses and approvals shall be
maintained throughout the term of this Agreement. There will be no compensation for the
above Services.
Services on the Project shall be provided effective immediately, and, unless terminated
earlier as provided herein, shall cease on G— 15 -08. City may terminate this
Agreement at any time with or without cause. Consultant may terminate this Agreement
for cause only.
Consultant shall defend, indemnify and hold City, its officials, officers, employees, agents
and volunteers free and harmless from any and all claims, demands, causes of action,
expenses, liabilities, losses, damages and injuries to property or persons, including
wrongful death, in any manner arising out of or incident to any alleged negligent acts,
omissions or willful misconduct of Consultant, its officials, officers, employees, agents,
arising out of or in connection with the performance of the Services or this Agreement,
including, without limitation, the payment of all consequential damages, attorneys' fees
and other related costs and expenses.

City hereby designates the Director of Library & Museum Services ( "City's
Representative!'), or his or her designee, to act as its representative for the performance of
this Agreement. City's Representative shall have the power to act on behalf of City for all
purposes under this Agreement. Consultant shall not accept direction or orders from any
person other than City's Representative or his or her designee.
Consultant shall not enter into any subcontract for performance of any of the Services
contemplated under this Agreement, nor assign this Agreement, without the prior written
approval of City, and subject to such conditions and provisions as City may deem
necessary. This Agreement may only be amended by a written document signed by both
parties.

My Favorite Book
Photo Project Proposal for Arcadia Library and The City of Arcadia
Dear Janet and Carolyn:
A fellow photojournalist in Moline, Illinois recently came up with a terrific idea that I
thought could be.a wonderful promotion for Arcadia Public Library.
I would like to propose that I borrow this idea and create something very. similar for
Arcadia Public Library.
This could be a direct follow up to the successful READ poster program.
The idea is really quite simple:
To take portraits of Arcadia library patrons with their favorite book.
The city / myself would not charge any patron for the sitting...
And the original 8 x 10 prints could be printed at a discounted rate for display in the
library.
Offer discounted 8 z 10 prints for $25 each or.I 1 x 14 Prints to Patrons for $35.00....
a portion of which would to be donated to the library.
The concept could involve several hours on a given day. I would set up a small studio.
backdrop with lights so each image would have the same background. Inviting anyone in
Arcadia, including local dignitaries, who cares to participate to come to the library with a
copy of their favorite book and have their portrait taken.
We would run stories in the Arcadia Weekly about said project and announce a date

Depending on the number of people who show up, we could make a wall size poster of
small versions of the portraits as well as'ioffer an online gallery from which people could
view /order prints.
The library /City web site could have a direct link to this online gallery.
I would welcome the opportunity to discuss this proposal further with you at your

images he shot that day down to 156 portraits, and from
that group he picked his 30 top photographs. `For the
show at the library we printed the 30 images as 11" x 14"
prints, titled with the person's name and the title of their
favorite book. Then I built two 2' x 3' composites featuring
the remaining 126 images. Everyone who had their picture
taken is on the wall. An online presentation of the `My
Favorite Book' project was built using the application
Simpleviewer."
Mizener, who is the director of photography for both
papers, said feedback from the community continues to be
very positive. "The project was displayed in the center of
the library, and I can't believe how great it looked, The
library staff says the project really resonated with the pub-
lic." He says there was a clamor for reprints. `It pushed us
to'offei 1 C' x 14" reprints, customized with the subject's
name, for $25 each, and a portion of the money will be
donated to the library."
The librarian plans to keep the project and hang it again
every five or 10 years. She told the newspaper that she
thinks it will be fun for people, especially the children, to
come back and find themselves on the wall again in 10
Yen's with their favorite book.
