Arcadia City Council Chambers The Planning Commission of the City of Arcadia met in regular session on Tuesday, June 26, 2012, at 7:00 p.m., in the Council Chambers of the City of Arcadia, at 240 W. Huntington Drive with Chairman Baerg presiding. PLEDGE OF ALLEGIANCE Chairman Baerg led the Pledge of Allegiance. ROLL CALL PRESENT: Commissioners Baderian, Beranek, Parrille and Baerg ABSENT: Commissioner Chiao MOTION It was moved by Commissioner Parrille, seconded by Commissioner Bderanek to excuse Commissioner Chiao from the meeting. Without objection the motion was approved. PUBLIC HEARINGS All interested persons are invited to appear at a Public Hearing and to provide evidence or testimony concerning any of the proposed items set forth below for consideration. You are hereby advised that should you desire to legally challenge any action taken by the Planning Commission with respect to the proposed item for consideration, you may be limited to raising only those issues and objections, which you or someone else raises at or prior to the time of the Public Hearing. 1. ZONE VARIANCE NO. ZV 12 -01 & SINGLE - FAMILY ARCHITECTURAL DESIGN REVIEW NO. SF ADR 12 -10 246 W. Wistaria Avenue Philip Chan -- - motorbikes, buses, motorhomes, trailers, boats and housecars. RECOMMENDATION: Recommend approval to City Council The applicant is requesting a Zone Variance to allow a three -car garage (24 linear feet of garage opening) to face the street on a 99.97 -foot wide lot in lieu of the minimum 100 -foot lot width required for a three -car garage to face the street. RECOMMENDATION: Approve Mr. Baldwin presented the staff report. Chairman Baerg asked if anyone would like to speak in favor of this project. Mr. Philip Chan, the project designer, represented the property owner. Mr. Chan pointed out that the lot width is only .03 feet short of the required 100 -foot lot width for a three -car garage facing the street. He explained that several options were considered but this one was the most practical and attractive and he asked the Commissioners for approval. Chairman Baerg asked if anyone would like to speak in opposition to this project. There were none. MOTION It was moved by Commissioner Baderian, seconded by Commissioner Parrille to close the Public Hearing. Without objection the motion was approved. MOTION It was moved by Commissioner Baderian, seconded by Commissioner Parrille to approve Zone Variance No. ZV 12 -01 and Single- Family Architectural Design Review No. SF ADR 12 -10 subject to conditions in staff report. ROLL CALL AYES: Commissioners Baderian, Beranek, Parrille and Baerg NOES: None ABSENT: Commissioner Chiao A Resolution reflecting the decision of the Planning Commission will be presented for adoption at the next Commission meeting. There will be a five working day appeal period after the adoption of the Resolution 2. TEXT AMENDMENT 12 -02 Citywide - Continued from May 22, 2012 The Development Services Department is initiating Text Amendments to the Single - Family Residential Zoning Regulations (Divisions 0, 1 and 2 of Part 5 of Chapter 2 of Article IX) of the Arcadia Municipal Code to amend the parking and storage regulations for motor vehicles, including recreational vehicles, trucks, commercial vehicles, motorcycles, motorbikes, buses, motorhomes, trailers, boats and housecars. RECOMMENDATION: Recommend approval to City Council Mr. Li presented the staff report. Chairman Baerg asked if anyone would like to speak in favor of this project. PC MINUTES 6 -26-12 Page 2 Ms. Mary Dougherty represented the Santa Anita Oaks Homeowners Association. She said that the HOA members are concerned about item 2B of the Text Amendment which allows an exception for parking or storage of a recreational vehicle in the front or street side yard without screening when there is no vehicular access to the side or rear yard areas. She said her group felt this exception should be eliminated. They are also in favor of allowing a 60 day grace period for enforcing this new regulation to allow residents time to make altemate arrangements. Ms. Dougherty said with these two changes, her organization would support this Text Amendment. Ms. Mary Lindgren said that she favors the Text Amendment except for the Exception in Item B2. She explained that for many years her neighbor has continuously stored a recreational vehicle in his driveway and the Exception would allow him to continue to do so since he has no vehicular access to the rear yard. Ms. Lindgren said that some of her neighbors have enlarged their driveways to allow RV parking along with several cars and she felt that Exception B2 would allow this to continue. Mr. John Murphy said that the current version of the Text Amendment is a huge improvement over the current Code except for the Exception in Item B2. He said that he believes this exception will negate the objective of the proposed regulation. Mr. Murphy pointed out that the objective is to remove recreational vehicles from being seen from the public right -of -way and that RV owners should use special facilities or commercial property designed for storage of large vehicles. He agreed that Exception B2 should be removed from the Text Amendment. Mr. Duane Lupton, said that parking trucks, large vehicles and RVs on the street devalues the property. He pointed out that these areas are neighborhoods of homes not parking lots and that anyone who can afford to buy these large vehicles and keep them supplied with gasoline can afford to rent storage space. Chairman Baerg asked if anyone would like to speak in opposition to this project. There were none. MOTION It was moved by Commissioner Baderian, seconded by Commissioner Parrille to close the Public Hearing. Without objection the motion was approved. Commissioner Baderian said that after a review of the staff report and the lengthy discussion at the last meeting, he agrees that Exception B2 would defeat the purpose of the proposed regulations. He recommended deleting the exception. Commissioner Baderian also recommended a grace period of 60 days to allow RV owners to make alternate arrangements for storage of their vehicles. Commissioner Beranek agreed that the exception should be removed and a phase in period of 60 days should be allowed. Commissioner Parrille also agreed and said that to be consistent, storage of RVs and other large vehicles should be in the rear or side only and screened from view, not in the front or in the driveway. Chairman Baerg noted that the consensus is that Exception B2 should be removed and a 60 -day grace period should be allowed. PC MINUTES 6 -26-12 Pane 3 MOTION It was moved by Commissioner Beranek, seconded by Commissioner Baderian to recommend approval of Text Amendment No. 12 -02 to the City Council with the elimination of the Exception in B2 and the addition of a 60 -day grace period. ROLL CALL AYES: Commissioners Baderian, Beranek, Parrille and Baerg NOES: None ABSENT: Commissioner Chiao The Planning Commission's recommendation and comments will be forwarded to the City Council. CONSENT ITEMS 3. RESOLUTION NO. 1857 A Resolution of the Planning Commission of the City of Arcadia, California, denying Conditional Use Permit No. CUP 12 -06 for a 580 square -foot tutoring center for children ages 14 -18 with a maximum attendance of 15 students at one time at 909 S. Santa Anita Avenue, Unit L. RECOMMENDATION: Adopt 4. RESOLUTION NO. 1858 A Resolution of the Planning Commission of the City of Arcadia, Califomia, approving Conditional Use Permit No. CUP 12 -09 to expand the existing bakery, Chiffon De Pastry Art, into an adjacent 1,200 square -foot vacant unit within an existing 6,900 square -foot commercial building at 1010 S. Baldwin Avenue. The expanded restaurant/bakery will be 2,300 square feet with a dining area for 12 patrons. RECOMMENDATION: Adopt 5. MINUTES OF JUNE 12, 2012 RECOMMENDATION: Approve MOTION It was moved by Commissioner Beranek, seconded by Commissioner Parrille, to adopt Resolutions No. 1857 and 1858 and to approve the minutes of June 12, 2012 as presented. ROLL CALL AYES: Commissioners Baderian, Beranek, Parrille and Baerg NOES: None ABSENT: Commissioner Chiao PC MINUTES 6 -26 -12 Pape 4 PC MINUTES MATTERS FROM CITY COUNCIL & PLANNING COMMISSION Councilman Wuo thanked Commissioner Baderian for his years of service with the Planning Commission and to the community. Chairman Baerg also thanked Commissioner Baderian for his 11 years of service and noted that Commissioner Baderian had served as a mentor for new Commissioners. He pointed out that Commissioner Baderian will be missed for his wisdom and his gracious demeanor toward all participants involved in the work of the Planning Commission. Commissioner Baderian said that it was a pleasure to work with an exceptional group of Commissioners and staff. MODIFICATION COMMITTEE AGENDA Chairman Baerg reported that the Modification Committee meeting was cancelled.
