The Rev. John Toews, Arcadia Christian Church Mayor Robert J. Considine PRESENT: ABSENT: Councilmen Arth, Butterworth, Forman, Rage, Considine None The minutes of the regular meeting of January 2, 1968 were APPROVED on MOTION by Councilman Forman, seconded by Councilman Arth and carried unanimously. Upon request of the applicant and with the consent of the members of the City Council, Mayor Considine took out of agenda sequence the application of William Cook, dba Michaels of Arcadia, for a business permit to conduct a private social club at 101 South First Avenue. Following instructions of the City Council the City Manager presented a report on standards should the Council decide in favor of the social club. In reference thereto Wayne Butterfield, attorney for the applicant, addressed the City Council stating in part that the applicant would comply with all the regulations; that the available parking space would be utilized as well as off street parking, He referred to a proposed membership fee and advised that it is planned to have nightly dancing and entertainment three or four times weekly, In answer to an inquiry he stated that the applicant does not operate another social club at this time, The Planning Director explained the requirements on parking which were a matter of concern to the City Council. No one else desiring to be heard, the hearing was CLOSED on MOTION by Councilman Forman, seconded by Councilman Hage and carried unani- mously, Discussion ensued and it was the consensus of the City Council that the subject area is indeed in need of business stimulation, but the public dancing possibility posed a matter of concern as well as the inadequate parking facilities; it was thereupon MOVED by Councilman Forman that the application be DENIED (based primarily on the possibility of a precedent which might be set by permitting dancing and the lack of the required parking spaces), seconded by Councilman Arth who stated for the record that he would be willing to take a second look at the application if it were re-filed as a private social club without dancing, The motion therefore is: To deny ;"_,, without prejudice to the applicant re-filing an application for a 1. 1-16-68 18:7164 business permit to operate a private social club without dancing. AYES: NOES: Councilmen Councilmen Arth, Forman, Hage Considine (who observed that in his op~n~on it could be a reasonable business) Butterworth ABSTAIN: Councilman ABSENT: None RUBBISH COLLECTION J ') t; I ' CONTINUED --- The City Manager explored in detail his progress report of commercial refuse permit applications (dated January 16, 1968). The City Attorney had prepared a proposed ordinance pursuant to instructions and extensive discussion ensued thereon. In particular the sections providing for an audit by the City of the books of a permittee,the proposed limitation of a vehicle over five years old and the area or areas which an applicant proposes to serve and statements of maximum charges. 1 During the proceedings Paul Mnoian, dba as Nu-Way Rubbish Company, applicant for a commercial rubbish pickup license, stated in part that he would have no objection to having his books audited by the city if he were granted a business license and recommended opening up the field to more than the existing number of permits, Paul Thorsen, dba City Refuse Company, addressed Council stating in part that the city does not have the right to ask an audit unless it would be willing to guarantee him a profit; that his prices are the same as the average in the San Gabriel Valley communities and that in his opinion it would be impossible for Arcadia to receive reliable service if all companies were allowed to solicit in the City, He continued in part that he would be willing to meet with the City Council to discuss his operations, Mr, Thorsen's attorney also suggested that his client could file a data sheet similar to ones filed by utility companies. It was noted that Mr. Thorsen's residential contract or the operation thereof was not an issue at this time except where the provisions of the proposed new ordinance would apply; that the matter before Council is primarily whether or not to open up the field to more than the existing permitted number of business licenses for commercial rubbish pickup. Duke Dana, 2614 Louise Avenue, was advised to take up his complaint concerning rates with the City Manager. Mr, Dana stated in part that he was paying a double fee, The City Council then considered each section of the proposed ordinance and the following action was taken on specific portions thereof. 1 MOTION by Councilman Forman, seconded by Councilman Hage and carried on roll call vote as follows that Section 6434,9 be MODIFIED to provide for production by the applicant of customer lists, rates and ownership statement certified as true and correct under penalty of perjury by permittee, deleting the requirement for an audit of the permittee's books and records. AYES: NOES: Councilmen Arth, Forman, Hage, Considine Councilman Butterworth, who felt that the City should have the right to audit the books of any firm given an exclusive franchise by the City; that it is the City's obligation to protect the residents by insuring fair rates; that he could not see anything wrong with requiring such an audit. None ABSENT: ' 2. 1-16- 68 18:7165 1 Concerning Section 6434.4(e) it was Mayor Considine's oplnlon that if a person is going to have a permit to do business in the city, he should have a permit to do busi ness in the total city, but should have the privilege of posting his rates on an area basis; then he has the right to serve the areas at those rates if he chooses, any or all of it. Councilman Arth concurred in this observation, It was then MOVED by Mayor Considine that'the applicant be required to post rates by area after which he would be granted a permit to do business in the city, Motion seconded by Councilman Butterworth, The motion did not carryon the following roll call vote: AYES: NOES: ABSENT: Councilmen Arth, Considine Councilmen Butterworth, Forman, Rage None Said Section 6434.4(e) remains intact. Section 6434,6,5 providing that no person holding a permit shall operate a vehicle or truck which has been used for five years or more was DELETED on MOTION by Councilman Considine, seconded by Councilman Arth and carried on roll call vote as follows: AYES: NOES: Councilmen Arth, Hage, Considine Councilmen Butterworth, Forman ORDINANCE NO. 1371 Introduced Other than minor text changes the proposed ordinance was acceptable to the City Council to the extent recorded herein, Whereupon the City Attorney presented for the first time, and read the title of Ordinance No, 1371 entit led: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING THE ARCADIA MUNICIPAL CODE BY REPEALING SECTION 5120,1.3 THEREOF, BY AMENDING SECTIONS 5120.7 AND 5120,8,1 THEREOF AND BY ADDING THERETO NEW SECTIONS 3213,5, 5110,5, 5120.9, 5120.10, 6434.3, 6434.4, 6434,5, 6434,6, 6434,6.1, 6434.6,2, 6434.6.3, 6434,6.4, 6434.6,5, 6434,7, 6434,8, 6434,9' AND 6434,lO CONCERNING THE REGULATION OF GARBAGE AND RUBBISH COLLECTION, HAULING OR DISPOSAL. Jenkins, for a business permit to allow two public auctions of antique furniture, bric-a"brac, and the like, on February 24 and 25, 1968, Mayor Considine declared the hearing open and no one desiring to be heard on the matter the hearing was CLOSED on MOTION by Councilman Arth, seconded by Councilman Butterworth and carried unanimously. On MOTION by Councilman Butterworth, seconded by Councilman Hage and carried unanimously the application for a business permit as indicated was APPROVED subject to Mr. Jenkins obtaining a temporary sales tax permit for Arcadia to cover the auctions. 1 Proposed amendment of the Arcadia Municipal Code (Section 9275,4,8) concerning service stations as recommended by the Planning Commission in its Resolution No. 625. The Planning Director explained that the recommended freestanding sign, permanently mounted in a location shown on a plot plan for the express purpose of advertising the price of gasoline, will not exceed a nominal size of 3' x 51 nor more than 8' in height, would solve the problems of the operators and still assure an aesthetic appearance. He explained that it is also recommended that regulations be changed to permit auxiliary signs (advertising trading stamps, credit cards and telephone service), Mayor Considine declared the hearing open and no one desiring to be heard the hearing was CLOSED on MOTION by Councilman Forman, seconded by Councilman Butterworth and carried unanimously. It was MOVED by Councilman Forman, seconded by Councilman Butterworth and carried on roll call vote as follows that the recommendation of the Planning Commission as contained in its Resolution No, 625 be sustained. AYES: Councilmen Butterworth, Forman, Hage, Considine NOES: ,None ABSTAIN: Councilman Arth (due to his professional affiliation,) Planning Commission recommendation for the approval of the final map 'of Tract No. 22330 (Camino Real, Norman, Holly, El Monte Avenues) be approved subject to the Commission's report dated January 9, 1968 and in addition thereto that trust amounts be established on each of two properties as follows: 429 W. AYES: NOES: ABSENT: Councilmen Arth, Butterworth, Forman, Rage, Considine None None The Planning Director explained that the Planning Commission has granted a conditional use permit to allow the development of a shopping center at the northwest corner of Live Oak and Santa Anita (Arcadia Shopping Center); 'that one of the conditions of approval required the developers to submit the final working drawings to the commission for approval; that this was fulfilled at the last commission meeting and that the commission was requested to permit r: / / I / A the light standards in the parking area to be 20' high instead of 10' as' specified in the Arcadia Municipal Code; that the Commission recommended the waiving of Section 9263.6,l thereby permitting the proposed light standards to be 20' instead of 10' in height, That the request was a matter of concern and was subsequently referred to the Technical Study Committee and a study is underway by said committee. However, it was noted that time is of the essence to the developers of the subject property and during the discussion it was the consensus of the City Council that 15' would be preferable; that an emergency ordinance could be adopted once the Commission made its recom- mendation baded on the study of the Technical Study, Hence, the matter referred back to the Commission, LIGHT STANDARDS HEIGHT 1 RAPID TRANSIT REPORT (;, II'; SMOG 1 The report of the Mayors' meeting on Rapid Transit for San Gabriel and Pomona Valley held on December 14, 1967 was submitted and acted upon as follows: MOTION by Councilman Hage, seconded by Councilman Butterworth and carried ,unanimously that the following minute resolution be adopted: BE IT RESOLVED that the City Council of the City of Arcadia, California, support Application (No, 49751) filed by the Rapid Transit District with the' Public Utilities Commission seeking the approval of the Commission to use the Baldwin Park line of the Southern Pacific Company for the San Gabriel Valley Corridor Rapid Transit line as proposed in the RTD preliminary report, and oppose Application (No. 49251) filed by the Southern Pacific Company in connection therewith. It being the consensus of the City Council that it support the endeavor of the City of Temple City on urging the State Legislature to take appropriate action to establish stringent standards controlling the manufacture of gasoline and petroleum products for the purpose of reducing sulphur content therein, it was MOVED by Councilman Butterworth, seconded by Councilman Arth and carried unanimously that the Mayor communicate said support. TEMPORARY The City Clerk was advised by the Phillips Petroleum Company concerning its CESSATION service station at 5 W, Live Oak Avenue; that a declaration has been filed (non- pursuant to the Arcadia Municipal Code Section 9248 and 9248,1 which sets conforming forth that inactive participation in a non-conforming use for a period in use) excess of 90 days constitutes abandonment of such use unless within that ~,I 1period a declaration is filed. It was noted that a new dealer applicant ;-"f~Ol-is being sought, It was MOVED by Councilman Hage, seconded by Councilman Forman and carried unanimously that said grace period be extended to June 30, 1968, OPrION EXTENDED (BBC) (60 days) MOTION by Councilman Forman, seconded by Councilman Butterworth and carried on roll call vote as follows that the request of the BBC Development Corporation, optionee for the purchase of city owned 5, 1-16-68 PROPOSED ANNEXATION (boundaries) , , , ./ ,/ , CIGARETTE TAX DISTRIBUTION SUPPORTED \ l ~ ",' CONTRACT AWARD (ground maintenance) ': (\ 6' " " 18: 7168 property at Wheeler, Santa Clara and Santa Anita Avenues, for an extension of sixty (60) days in order to complete its plans and financing arrangements, be APPROVED. It was noted that in consideration for said extension the Corporation agrees to pay the additional sum of $7,942.00 and it is mutually agreed that said sum will apply to the total purchase price, AYES: NOES: ABSENT: Councilmen Arth, Butterworth, Forman, Rage, Considine None None Mayo Considine advised that on January 10, 1968 the Local Agency 1 Formation Commission considered the request of the City to divide proposed Annexation No, 40 into two portions, one northerly and one southerly of Oakdale Drive on Rosemead Boulevard; that opposition was presented by the Michillinda Park Association, It was noted that the LAFCO hearing was continued until January 24, 1968 at 9 a,m. in order for the city officials to decide on a course of action. Mayor Considine felt that the City Council should agree to the annexation from Huntington Drive south because the people in that area had worked so diligently in getting petitions signed, and to release the area north therefrom; that to do otherwise would be a breach of faith, Councilmen Butterworth and Hage felt that the city should adhere to its original plan which had been carefully worked out and favored holding to the original boundary. Councilman Forman stated in part that he would with reluctance release the area north of Huntington Drive but that he ffid not given up hope, Councilman Arth referred to the capital costs of improvements and expressed a desire for a detailed stu~y. Ray Stuehrmann, 9077 Southview Road, San Gabriel, addressed the City Council stating in part that it was the feeling of residents in the proposed annexation area south of Huntington Drive that the recom- mendation of LAFCO should be taken and not run the risk of losing the entire annexation by including the northern area in an election; that they do not want to be annexed to Temple City which endeavor has been defeated three times in the hopes of coming into Arcadia, In answer to questions the City Manager said that projections hastily worked out showed that the area to the south of Huntington Drive would produce $154,000 a year in revenue and require about $107,000 in added expense; capital outlays would require about $528,000 (mostly for streets, curbs and lighting) and that the area would not be a burden if the outlays were budgeted over a long enough period of time. All Councilmen were in accord that its first obligation is to the residents of Arcadia and it was agreed that a time certain be scheduled for the purpose of deciding on a course of action, i.e., whether to press for an Oakdale Avenue dividing line in its application to LAFCO or to agree to the Huntington Drive boundary as recommended by the commission (JANUARY 23, 1968 at 8 p.m.). 1 MOTION by Councilman Forman, seconded by Councilman Arth and carried unanimously that the League of California Cities Revenue and Taxation Committee be supported in its proposed formula concerning distribution of cigarette taxes to cities (report dated December 29, 1967), It was noted by the City Manager (report dated January 16, 1968) that a savings of approximately $8000 the first year and $5000 the second year could be realized by switching from maintenance of the large planted areas by city forces to contracting, He explored the three bids 6, 1-16- 68 I J r j J ~ PROGRESS REPORT (Storm drain bond issue- Project 1402) STOP SIGN INSTALLATION 5 ~~,;\::l\ ROOFING (CITY HALL) c r:- /1 () n I'CHANGE OF CARNIVAL DATE , ' 18:7169 received and recommended an award therefor. It was MOVED by Councilman Forman, seconded by Councilman Hage and carried on roll call vote as follows that the City Council award the contract for maintenance of the beautified areas to Duke's Landscape Service, that all other bids be rejected; that all bid deposits be returned; that any irregularities or informalities in the bids or bidding process be waived and that the Mayor and City Clerk be and they are hereby authorized to execute a contract in form approved by the City Attorney. AYES: NOES: ABSENT: Councilmen Arth, Butterworth, Forman, Hage, Considine None None The City Council was informed that the County Flood Control District proposes to advertise for bids January 23, 1968 and has scheduled the bid opening for February 23, 1968; that it is intended to award contract at the March 5, 1968 meeting of the Board of Supervisors and that it appears evident that the actual construction work will be underway in April of 1968 (at the close of the racing season). A report incorpo- rating this information dated January 11, 1968 is on file in the office of the City Clerk. /(- On recommendation of the Director of Public Works and the City Manager an existing yield sign was authorized for removal and the installation of stop signs for east and west bound traffic on Hacienda Drive at Rancho Road was authorized on MOTION by Councilman Hage, seconded by Councilman Forman and carried on roll call vote as follows: AYES: NOES: ABSENT: Councilmen Arth, Butterworth, Forman, Hage, Considine None None On recommendation of the City Manager it was MOVED by Councilman Arth, seconded by Councilman Butterworth and carried on roll call vote as follows that a contract for the re-roofing of the older building at City Hall be awarded to the low bidder, Stone Roofing Company, Inc., in the amount of $3,222.00; that all other bids be rejected; that any informalities or irregularities be waived in the bids or bidding process; that the Mayor and City Clerk be and they are hereby author- ized to execute a contract in form approved by the City Attorney. AUDIENCE PARTICIPATION Montessori School hearing scheduled ",.;1 Van Harris, 1412 S. Santa Anita Avenue, addressed the City Council concerning property at 1406 S. Santa Anita Avenue, the location of the Montessori School. He stated in part that the original conditions had not been complied with and protested the use in an R-l zone. Following an explanation by the Planning Director that the Planning Commission had considered the request of the new owner and operator, and had approved an extension of one year on its conditional use permit with an increase in the maximum enrollment from 20 to 28 (see Resolution No. 626) it was MOVED by Councilman Arth, seconded by Councilman Hage and carried unanimously that the City Council institute proceedings on its own initiative as provided in the Arcadia Municipal Code Section 9275.2.9 for a public hearing to be held on February 6, 1968. All persons, interested and,-the public generally to be so notified by the City Clerk. I In order to take action on this request the provisions of the procedural ordinance were waived on MOTION by Councilman Forman, seconded by Councilman Butterworth and carried unanimously. Lube N. Balabanoff, 1625 S. Second, spoke to the proposed annexation and urged Council to retain its original intention to annex the whole area. In answer to an inquiry by Mrs. Attrill, 1816 S. Baldwin Avenue; the City Council acknowledged receipt of a letter from Mable Taylor, 1821 Baldwin Avenue concerning the proposed widening of Baldwin Avenue and protesting the median strip and the continued cost of maintenance thereof. The City Attorney presented for the second time, explained the content and read the title of Ordinance No. 1372, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING THE ARCADIA MUNICIPAL CODE BY REPEALING SECTIONS 9262.1.31, 9263.1.32 AND 9266.1.5 THEREOF, BY ADDING THERETO NEW SECTIONS 9220.23.1, 9220.51.1, 9275.1.45.1 AND 9275.1.53.4 AND BY AMENDING SECTION 9275.1.45 THEREOF."
