REGULAR MEETING
FEBRUARY 20, 1968
The City Council of the City of Arcadia, California met in regular
session in the Council Chamber of the Arcadia City Hall on February
20, 1968 at 8 p.m.

Complying with the request of the City Council the City Manager
prepared in report form his recommendation concerning the number of
commercial and industrial refuse permits to be issued. He para-
phrased same, to wit: that staff has requested all applicants to
complete forms which would indicate ability and willingness to meet
standards outlined in the ordinance recently adopted setting forth
regulations; that to date four applicants have responded satisfactorily;
that it appears at this time that' the number of permits desirable
would not exceed six; that should it become apparent from developments
that this number be increased it could be done at such time. It was
noted that all permit holders would compete freely throughout the city
and would be available at the maximum rates to be listed as part and
parcel of their applications.
Councilman Butterworth stated in part that he could not accept the
concept of a quasi-monopoly which would be the case if the present
limit,of five wele continued; that there is no substitution for
competition other than competition itself; that when limited to six
it would make it easier for collusive price control, which was hard
to detect; that companies which are not qualified could not come in
under the strict standards recently adopted. He concluded in part by
suggesting permitting a limit of eight licensees, which would be another
step toward free enterprise, although he favored opening the commercial
and industrial refuse pickup to qualified companies.
Councilman Hage agreed with Councilman Butterworth on the need for
competition, but felt that the actual number of permittees should be
left open for the time being and await developments.
Councilman Arth agreed in part with Counctlman Hage that some type of
limitation must be imposed; that he would be amenable to placing the
number at eight.
Councilman Forman MOVED that the number of business licenses for
commercial and industrial rubbish pickup be limited to six. Mayor
Considine seconded the motion and commented that by limiting the
number to six the Council could suspend the license of any collector
who is not operating in compliance with the standards; that it will
insure good service at a fair price and then referred to the estimated
number of accounts within the city to be served by the proposed six
collectors.

Manager advised that he had received the requested information
the requirements from:

McCormac Rubbish Company (application on file for some time)
Community Disposal Company
Moon Rubbish Company
Best Disposal Company
It was reco~ended that these five be approved, whereupon it was
MOVED by Councilman Arth, seconded by Councilman Hage and carried
unanimously that the said five rubbish pickup companies be issued
council permits at this time.

The, City Manager advised that the above three companies have not
responded to the request for pertinent data to the extent that a
recommendation could be made at this time.
Mayor Considine declared the hearing open and Paul Mnoian, dba
Nu-Way Rubbish Company, briefly explored his background and
experience and referred to the growth of the city through the
free enterprise system. In response to a query he stated in part
that he had submitted the questionnaire as required by the office of
the City Manager, but felt that certain phases of it were unfair.
It was suggested that he confer with the City Manager to ascertain
its degree of completion. It was noted by Councilman Butterworth
that the questionnaire was prepared under the direction of the City
Council and it has the support of the legislative body; that five
applicants have satisfactorily completed the form and they have been
accepted for permits; that there are now three more open, including
that of Mr. Mnoian.
In order to provide an opportunity for applicants to complete the I
questionnaire for the remaining openings, it was MOVED by Councilman
Forman, seconded by Councilman Butterworth and carried unanimously
that the hearings on the applications (listed above) be continued
until the nextOregular council meeting (March 5, 1968). HEARINGS
REMAIN OPEN.

The City Manager referred to information from Kenneth C. Norman
that he plans to purchase the garbage and collection business from
Paul Thorsen, dba City Refuse Service Company. It was noted that an
application has been filed with the City Clerk; that it will be pro-
cessed in compliance with the municipal code which requires a
public hearing by and before the City Council.
Paul Thorsen introduced Mr. Norman, local resident and the afore-
mentioned prospective buyer. Mr. Thorsen also expressed appreciation

for being permitted to serve the city during the past twenty five
years.
L. B. Reynolds, 212 Bonita Avenue, owner of apartments at said
address, asked Council to consider including multiple dwellings
in the commercial category for pickup; that he was not satisfied
with services or charges from the present collector. He made an
oral presentation of charges and made comparison thereof.
Mayor Considine advised that the matter of residential pickup was
not before the Council at this time, however, the matter was referred
to staff.
The City Council acknowledged receipt of a proposal from Louis P.
Black, auditor who had been retained by the City to examine the
city books for the last three fiscal years. Discussion ensued on
the precedent set by this and former councils in making a change
within periods of time for the purpose of securing new approaches
and/or procedures. It was MOVED by Councilman Forman, seconded
by Councilman Hage and carried unanimously that staff investigate
further into the matter in terms of a change of auditor and submit
report.
On MOTION by Councilman Hage, seconded by Councilman Forman and
carried unanimously it was agreed that the City Council respond
favorably to the City Council of the City of Los Angeles in inviting
amateur athletes of the world to hold the 1976 XXI Olympiad in
Los Angeles.
Whereupon the City Attorney presented, explained the content and
read the title of Resolution No. 3989, entitled: "A RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, JOINING THE
CITY AND COUNTY OF LOS ANGELES IN THEIR INVITATION TO UNITED STATES
OLYMPIC COMMITTEE TO SELECT LOS ANGELES AS THE SITE OF THE 1976
SUMMER OLYMPICS."

In connection with the request of the Union Oil Company Mr. F. J.
Kearns addressed Council stating in part that his company was
desirous of conducting a vibroseis geophysical survey on certain
streets within the city; that they would like to start within the
next couple of weeks. He explained the operation which could be
accomplished in six days and would not inconvenience the residents;
that the trucks traversing the streets would be the only noticable
noise which would be kept at a minimum. He noted also that it may
be they will want to test other routes which are not designated in
the communication dated February 9, 1968, in which case they will
return to Council for permission.

John Clark, in charge of operations for the oil company,
explained the progression of the trucks and stated in part
that t~e residential areas could be tested during the day and
commercial and industrial sectionsbe tested at night. He agreed
to the condition that 'all equipment would be kept off thoroughfares
during peak traffic periods.
The conditions recommended by the Director of Public Works and the
City Manager Were explored in detail and it was the consensus that
they be accepted including an inspection charge. Hence, it was
MOVED by Councilman Butterworth, seconded by Councilman Hage and
carried on roll call vote that permission be granted subject to the
following conditions:

1. Furnish evidence of public liability and property damage insurance
in an amount satisfactory to the City Attorney.
2. Work shall be limited between the hours of 9 A.M. and 4 P.M. in the
residential areas with no work on Saturdays, Sundays or Holidays.
That work in the commercial and industrial areas to be at the
discretion of the oil company with the understanding that during
peak traffic hours the equipment shall be off the streets.
3. Inform the residents at least 24 hours in advance and advise them
of the nature of the test and what to expect.
4. All damage to street facilities resulting from the operations shall
be repaired by the company to the satisfaction of the Director of
Public Works.
5. Pay all inspection charges.
6. Keep the City Engineer's office advised of schedule and progress.

discussion was only to present information he might have

The City Council acknowledged the three proposals of Hugh E. Buck
concerning the painting of house numbers on curbs throughout the
City. (Letter dated February 12, 1968~) It was the consensus of
City Council that this project become a 1968-69 budgetary item.

It was noted that the request of the owners and operators of the
nursery school and day camp at 716 West Huntington Drive, Emilie
and Luben Balabanoff's request for an extension of their zone
variance should be referred to the Planning Commission. Whereupon
it was MOVED by Councilman Hage, seconded by Councilman Forman and'
carried unanimously that the owners be advised of said procedure.

The report of the License Officer revealed that adjustment of the
license fees for bulk vending machines clustered into one stand
as' a unit would not change the basic fee schedule but would modify
application of the schedule. An amendment to the Arcadia Municipal
Coae Section 6220.57 would provide for a new Section 6220.57.1
(see report dated February 14, 1968 setting forth terminology
therefor). It was noted that the recommended fees would be
substantial reductions from the fees in existence prior to the
recent revisions of b~siness license fees and would be only category
of business operations in which reduced fees have been recommended.
Effective date of the revised fee was also explored. It was further
noted that it is not legally possible to waive the requirements of a
penalty fee due to delinquent payment.
It was MOVED by Councilman Forman, seconded by Councilman Arth and
carried on roll call vote as follows that the City Council approve
the terminology recommended by the Business License Officer and the
City Manager.

It was further MOVED by Councilman Forman, seconded by Councilman
Arth and carried unanimously that th~ effective date for the revised
fee be January 1, 1969.
The City Manager advised that the Director of Public Works has reviewed
the plans and specifications for installation of storm drains on the
streets indicated on a projection reflecting extensions and priority'
drains in connection with this project, and recommends the approval
thereof. He continued that the work is scheduled to begin shortly
after the close of the racing season and should be completed within
180 days thereafte!_ .
Mayor Considine noted for the record that the staff make every effort
to keep open the access to all business establishments during the
period of. construction; that they do suffer hardships when they are
obstructed for periods of several days and the like.
It was then MOVED by Councilman Arth, seconded by Councilman Forman
and carried unanimously that the plans and specifications be approved
by resolution and that authorization be and it is hereby granted the
County Flood Control District permission to occupy and use the public
streets to construct', operate and maintain said installations.
The City Attorney then presented, explained the content and read the
title of Resolution No. 3987, entitled: "A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, APPROVING PLANS AND
SPECIFICATIONS AND AUTHORIZING THE LOS ANGELES COUNTY FLOOD CONTROL
DISTRICT TO PROCEED WITH CONSTRUCTION FOR 1964 STORM DRAIN BOND ISSUE
PROJECT NO. 1402."

carried on roll call vote as follows the recommendation of the
Director of Public Works and City Manager was APPROVED for salary
adjustments of 1) Edward Bozek to be increased to $1,090 per month
which would conform to Step D of salary schedule No. 452, and
2) Charles Cantrill to be increased to $989 per month which would
conform to Step D in salary schedule No. 448. This would divide the
responsibilities of the now vacant Assistant City Engineer's position.
Said adjustment to be effective February 26, 1968. Authorization was
also given for the hiring of an additional Assistant Civil Engineer at
the salary schedule Step A currently in effect for said position.

Mr. James Harvey, retiring President of the local Chamber of Commerce,
expressed appreciation to the City Council and the City staff during
his tenure as president of said organization.
The City Attorney explained that a deed granting an easement for road
purposes of a parcel of real property was accepted by the City in
conjuction with a lot split; that the deed set forth the legal
description of the entire parcel rather than the small portion thereof
which was required. He recommended the reconveyance of that portion
of property not needed for the easement. Whereupon it was MOVED by
Councilman Hage, seconded by Councilman Forman and carried on roll
call vote as follows that the City Attorney prepare a deed for such
purpose; that the Mayor and City Clerk be authorized to execute same
on behalf of the City.

The City Attorney presented, explained the content and read the title
of Resolution No. 3986, entitled: "A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF ARCADIA, CALIFORNIA, ORDERING AND CALLING FOR A GENERAL
MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON THE 9th DAY OF APRIL,
1968 DESIGNATING THE OFFICES TO BE FILLED AT SAID ELECTION: PROVIDING
FOR THE POLLING PLACES FOR SAID ELECTION: AND APPOINTING THE ELECTION
OFFICERS FOR SUCH ELECTION AND FIXING THEIR COMPENSATION."

The City Attorney presented for the first time, explained the content
and read the title of Ordinance No. 1375, entitled: "AN'ORDINANCE OF
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING CHAPTER 8
OF ARTICLE VIII OF THE ARCADIA MUNICIPAL CODE BY ADDING THERETO A NEW
PART 3 ENTITLED "UNDERGROUND UTILITY DISTRICTS".

On MOTION by Councilman Butterworth, seconded by Councilman Arth and
carried unanimously the request of the West Arcadia Business and
Professional Association to hold its Jr. Achievement Trade Show on
March 30, 1968 between 10 A.M. and 5 P.M. was APPROVED, subject to the
City being named an additional insured under the Association's
liability insurance program.

The City Attorney will prepare a report for Council consideration
concerning an inspection fee to be charged when an oil company makes
a geophysical survey.
'In response to an inquiry by Councilman Butterworth, the City
Manager advised that meetings are being arranged to present factual
data' concerning the city to the residents of the territory proposed
to be annexed. Every effort is to be made in this regard.
Mayor Considine read into the record the communication from the
Methodist Hospital of Southern California located in the city,
wherein a check for $79 was submitted which will pay the lease
($1.00 per year) for the entire period of 99 years, 20 years having
been previously paid.

At 10:18 P.M., the City Council recessed to enter an executive
session to consider retention of special counsel for eminent
domain proceedings on Baldwin Avenue, and to discuss the employment
of a new City Attorney.
At 11:05 P.M., the City Council reconvened and adjourned immediately
thereafter.
