Ted Cummins, Arcadia Friends Church. Mayor Robert J. Considine Present: Absent: Councilmen Arth, Forman, Rage, Considine Councilman Butterworth. The Minutes of the regular meeting of March 19, 1968, were APPROVED on MOTION by Councilman Arth, seconded by Councilman Rage and carried unanimously. The Minutes of the adjourned regular meetings of March 22 and 27, 1968, were APPROVED on MOTION by Councilman Arth, seconded by Councilman Rage and carried unanimously. Councilman Forman abstained from voting due to his absence from said two meetings. HEARING (Light standard height) p; Planning Commission Resolution No. 629 recommending the amendment of the Arcadia Municipal Code by amending sections pertaining to landscaping requirements for residential areas; that landscaping should be required in prescribed yard areas and to limit by fifty percent the paving of front yards with driveways and accessways , II in all of Arcadia's residential districts. COMMUNICATION (Novak) \ '\" 'v" ,:: I I COMMUNICAT1ON (CATV protest) L.\A \ ~d 18: 7224 Planning Commission Resolution No. 632 recommending an amendment to the Arcadia Municipal Code by adding thereto a new section which would permit property which could become non-conforming due to street widening programs initiated by the City to maintain its previous legal status. , Mayor Considine declared the hearing open, and no one desiring to be heard, the hearing was CLOSED on MOTION by Councilman Hage, seconded by Councilman Forman and carried unanimously. It was further MOVED by Councilman Hage, seconded by Councilman Forman and carried unanimously that the recommendation of the Commission be SUSTAINED and that the City Attorney prepare the ,appropriate ordinance to effect said amendment. Planning Commission' Resolution No. 638 recommending an amendment to the Arcadia Municipal Code by adding, amending and repealing ,'certain sections thereof relating to real-estate-for-sale i~ signs was scheduled for PUBLIC HEARING on April 16, 1968. \ (a) The Planning Director explained the recommendation of the Committee concerning approved safety grab bars to be required in tubs and showers; the location and design of the grab-bar to be determined by the building superintendent at the time the plans are checked. It was MOVED by Councilman Forman, seconded by Councilman Arth and carried unanimously that the City Attorney prepare the appropriate ordinance to effect said amendment to the Arcadia Municipal Code, Section 1312.3. (b) The Planning Director explained the recommendation of the Committee concerning vacant, obsolete, hazardous, non-conforming buildings; that the files indicate that the property owners have not voluntarily made attempts to repair, improve, rehabilitate, relocate, demolish or change the condition of the structures they own after receiving proper notice from the Building and Safety Division. The Building Superintendent circulated pertinent material and cited one property actually beyond repair. Some discussion held on cost of demolition or a manner in which to cause the owner to bring a building up to code. The Building Superintendent asked for the benefit and protection of public hearings by and before the City Council. Whereupon it was MOVED by Councilman Forman, seconded by Councilman Hage and carried unanimously that the Building Superintendent pursue steps to apprise the owners of the obvious hazards in an effort to persuade them to correct same; that if this approach is not productive, the matters may then be presented to City Council to use its legal resources therefor. The letter from Louis A. Novak, M. D., concerning Annexation No. 40 West Arcadia Inhabited was received and ordered FILED. I The City Clerk read into the record the contents of a petition signed by 25 residents protesting the awarding of a franchise to the Foothill Cable TV Company because its proposed rates are higher than those proposed by International Cable Television Corporation. Attached thereto was a rate schedule. Mayor ConSidine noted that the City Council has held public hearings, has made a thorough search of all of the companies involved and the officials of the companies as to integrity 4-2-68 ~ 2 - JOINT The City Manager explained that officials of various cities have POWERS been, developing the Joint Powers Agreement for some time; that AGREEMENT ~eight of the nine cities now making up the San Gabriel Valley C/ /..5'~J Municipal Data System have signed said agreement; that although '--, the City has been permitted a member on the Board of Directors, it has not officially approved the agreement. Re recommended the approval thereof and if experience or study indicates the need for amendments to the agreement they could be sponsored by the city as a full fledged member. Whereupon it was MOVED by Councilman Forman, seconded by Councilman Arth and carried unanimously that the Joint Powers Agreement authorizing the Municipal Data System be APPROVED in concept; that the City Attorney prepare same for acceptance by the Council at its next regular meeting. (April 16, 1968). 'I APPROVED COMPUTER SERVICES ADVERTISE FOR BIDS (street improvement) Fi001ft 18: 7225 and capability along with general application. ,It was the con- Sensus of the City Council that it would offer little justification to reopen the matter at this P9int especially at a time when an effort is being made to complete a program to supply the residents good television reception at the earliest possible date. Councilman Arth observed, that although he had favored International due to its slightly lower rate he ,could see no reason to reopen the matter after Council had made its determination following public hearings and first and second readings of the ordinance awarding the franchise. Whereupon the petition was ordered, FILED. It was MOVED by Councilman Hage, seconded by Councilman Arth and carried unanimously that the plans and specifications for the improvement of Baldwin Avenue from Camino Real to Live Oak Avenue be APPROVED and that the City Clerk be and she is hereby AUTHORIZED to advertise for bids to be returned,May 2, 1968. The project will be financed with State Gas Tax Funds approved in the current budget. The City Manager explained the request of the Planning Depart- ment for a new automobile to replace a 1961 vehicle which is in the service department a great deal of the time and is in a condition where it should be replaced; that funds are in the Department's budget. He suggested a station wagon to accommodate the needs of the department. 1<: I 'I ., ~ \...; ", Whereupon it was MOVED ,by Councilma'n' Forman, seconded by Councilman Hage and carried on roll call vote as follows; that the City Manager be authorized to solicit informal bids for the procurement of a new vehicle not to exceed the sum of $3000. Corrigan, representing the Tom Hess Hauling Company, addressed Council stating in part that he had submitted a request to the City Manager for permission to complete a haul down Highland Oaks Avenue to Foothill Boulevard at the freeway site for a period of six working days. He explained th~t a total of 30,000 tons of material had to be hauled at 5000 tons per day for six days only, and, explored his working schedule. The route preferred by the Chief of Police was outlined. The City Council expressed concern for the residents who would be affected and a desire that they (the residents) be notified in advance and given the benefit of the schedule so they would know it would be completed with this last haul. Council indicated a willingness to negotiate, on the basis of reasonable restrictions to protect the residents. Whereupon, it was MOVED by Councilman Forman, seconded by Councilman Hage and carried on roll call vote as follows, that permission be granted not to exceed a total period of 8 days, which would include the six working days, for the operation to be completed. The City Manager and staff to negotiate on the basis of advance notifi- cation to residents and reasonable restrictions for the protection of their property. I The City Attorney presented for the second time, explained the content and read the title of Ordinance No. 1380, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING A COMMUNITY ANTENNA TELEVISION FRANCHISE." MOTION by Councilman Forman, seconded by Councilman Hage and carried on roll call vote as follows, that the reading of the full body of Ordinance No. 1380 be WAIVED. Upon recommendation of Councilman Forman, the City Attorney presented, explained the content and read the title of Resolution No. 3995, entitled, "A RESOLUT1ON OF THE CITY COUNCIL OF THE CITY OF ARCADIA, RELATING TO OPPOSITION TO THE PROPOSED CONSOLIDATION OF THE MUNICIPAL AND JUSTICE COURTS IN LOS ANGELES COUNTY." It was MOVED by Councilman Forman, seconded by, Councilman Hage and carried on roll call vote as follows, that the reading of the full body of Resolution No. 3995 be WAIVED.
