APRIL 16, 1968
The City Council of the City of Arcadia, California, met in regular
session on April 16, 1968, at 8 P.M. in the Council Chamber of the
Arcadia City RaIl.

The Minutes of the regular meeting of April 2, 1968, were APPROVED
on MOTION by Councilman Forman, seconded by Councilman Rage and
carried unanimously. Councilman Butterworth abstained from voting
as he was absent from said meeting. The Minutes of the adjourned
regular meetings of April 8 and 15, 1968, were APPROVED on MOTION
by Councilman Butterworth, seconded by Councilman Arth and carried
unanimously.
Mayor Considine stated for the record that he appreciated the
excellent cooperation he had received during his tenure as Mayor;
that in his opinion all of the city employees had put forth
tremendous effort during the year to improve the city and the
general climate of dealings with its citizens. Re complimented
retiring Councilman Forman for his contributions and efforts on
behalf of the city during the four years Mr. Forman has served
on the Council, and presented a plaque to him indicating the
years of service as Councilman and as Mayor during 1966-67.
Councilman Forman accepted with expressed appreciation to all
city staff members and employees and stated in part that he
leaves with some reluctance and observed that if he were 25 years
younger and had an opportunity to plan a course. of action for
his life he would have chosen a career of public service.
The City Clerk, having tabulated the semi-official returns of the
April 9, 1968 Municipal Election at which two Councilmen and a
City Clerk were elected, in accordance with Section 22932 of the
California Elections Code appointed the following as an Elections
Board to conduct the official canvass:

California, hereby certify and declare that the City Council of
the City of Arcadia, at a regular meeting held April 16, 1968,
has duly and regularly canvassed the returns of the General
Municipal Election held in the City of Arcadia on April 9,
1968, and has declared the results of said election."
Whereupon the City Attorney presented, explained the content
and read the title of Resolution No. 3996 entitled; "A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, STATING THE RESULTS OF THE ELECTION APRIL 9, 1968."

carried on roll call vote as follows, that the reading of

The City Attorney, as a Notary Public, administered the oath
of office to the 'City Clerk, .'Christine Van Maanen, and she
thereafter signed the required oath of office and upon receiving
a Certificate of Election in turn administered the Oath of
Office to Councilmen-elect Considine and Helms and presented
each with a Certificate of Election. ' I,

Councilman Considine stated that Section 404 of the City Charter
provides that after any election when a Councilman or Councilmen
are elected, the first order of business is for the City Council
to elect one of its members as presiding officer who shall have

the title of Mayor. He shall be the official head of the City
for all ceremonial purposes. He shall perform such other duties
consistent with his office and in accordance with such provision
and he asked for nominations for Mayor.
Councilman Butterworth: "I have the honor to place in nomination
for the Mayor of this community, a councilman who over the past
two years has dedicated service to this council and by his devoted
efforts on behalf of the community and its citizens has certainly
demonstrated his suitability and qualifications to act as Mayor,
and I now place in nomination for Mayor of Arcadia, Councilman
Don W. Hage. Councilman Helms seconded the motion which was
carried on roll call vote as follows:

The City Clerk thereupon ca~t a unanimous ballot for the sole
nominee, Councilman Don W. Rage. Mayor Hage then assumed his
seat as presiding officer and welcomed the newly organized
Council.
Councilman Butterworth: "I am equally privileged to place in
nomination for the office of Mayor Pro Tempore of this community;
a councilman who has distinguished himse1~ by the quality and
by the excellence of his work in the past two years and who, I
believe, has certainly demonstrated his capacity to serve as
Mayor Pro Tempore, and I now place in nomination, Councilman
C. Robert Arth." Councilman Helms seconded the motion which was
carried on roll call vote as follows:

The City Clerk thereupon cast a unanimous ballot for the sole
nominee, Councilman C. Robert Arth.
Mayor Hage... "It is an honor to have been chosen Mayor and I
will certainly try to carryon in the manner that Councilman
Considine has done...It is a tremendous experience and I hope
that Councilman Helms enjoys it as much as I have. I welcome
both Councilman Considine and Councilman Helms.~' He advised
that liaison appointments would soon be made.
Councilman Helms then stated:..."he would like to, thank first
of all his parents, Rev. and Mrs. James Helms of Huntington
Pa~k, who starte9 me out in life, my wife who sus~ained me
throughout the campaign, my campaign chairman, Dr. Koch, and
all of the citizens of Arcadia who gave me so much support;
that the feeling of frtendship throughout the city has been
overwhelming." He then thanked those who had faith and
confidence in him and pledged he would do his utmost to be
th~ir representation on Co~ncil.

Planning Commission Resolution No. 638 recommending the amendment of
the Arcadi~ Municipal Code by adding, amending and repealing of
certain sections thereof relating to real estate for sale signs. In
substance the. resolution recommends that regulations in Zones C-1,
C-2 and C-M limiti~g the size of. for sale, lease or rent signs to
four squar~ .f~et be repealed' and rep~a~ed .with' a 'new section which
would permit one sign not to exceed thirty-two square feet. The
present limitation of signs ad~ertising'property for sale, lease
or rent in the residentia~ areas is for one sign not to exceed
four square feet. The proposed amendments would permit the sign
to have'advertising copy on both sides; allowing two such signs
for corner properties; per~it~ o~e directional ,arrow; allowing
three smaller signs to be attached to the "fo'r sale" sign and in
the case of property on a dead end, cul-de-sac or 'temporarily
impassable streets, one directional arrow.may be placed at the
next through street intersection.
Mayor H~ge declared the hearing open and no one desiring to be
heard, ,the hearing was CLOSED on MOTION by Councilman Considine,

Following discussion and clarification of some of the points,
it was MOVED by Councilman Considine, seconded by Councilman

of the ?lanning Commission as set forth in its Resolution No.
638 be APPROVED.
Application of Donald Seversike for a business permit to operate
the theatre"and refreshment facilities at the Cinemaland Theatre,
135 Co1or~do ,piace. It was noted by the City Manager that"Council
would be considering the issuance of a permit for the balance of
the current calendar year..
Mayor Hage declared the hearing open and Mr. Seversike stated in
answer .to ,inquiries that..he intend~. to. continue. the same high
quality of family motion pictures as have been presented by the
Edwards Corporation. He explored his bookings. for the next few
weeks. Whereupon, it was MOVED by Councilman Considine, seconded
by Councilman Helms, and carr~ed.unanimous1y that the hearing be
CLOSED.

Proposed. abandonment and vacation. of all .or. any por,tion of alley
between Santa Anita. and First Avenues and between Santa Clara and
Wheeler Streets. The City Manager explained that the subject alley
is an east/west alley between Santa Clara and Wheeler Streets
running easterly from Santa' Anita Avenue for six lots which are
owned with one exception by the City, and are under option to
purchase by the BBC Development Corporation. Said corporation
.proposes .to construct an 8 story building thereon. Left unvacated
would be the stub alley extending westerly for cwo lots from the
north/south' alley in the middle of the block. It was noted that
the alley has been posted pursuant to Resolution No. 3988 and
.thus far,no ~bjections have been filed.

The City'Council received and accepted progress 'report in connection
with the Los Angeles 'County Flood Control 'District" Storm Drain
Project No. 1402. It explained that the contract had been awarded
tO'the low 'bidder, Vido Artukovich and'Son, Inc., in an approximate
figure of $491,000; that' th'e fun'ds budgete'd 'are' adequate for total
completion - construction to start this year on April 15 with an
anticipated date for completion in mid-September.

City Council accept the appraisal report for Phase III plus a
supplemental report to Phase III for property acquisition on

(in connection with the widening program;) that the sum of
$4,625 be,authorized for payment to the appraisers for said
work and that the City Manager be and he is hereby authorized
to expend appropriate gas tax funds for the acquisition of the

report as required by Section 2156 of the Streets and Highways
Code which contained the following: Progress made in improve-

The City Manager advised that the Division of Highways will advertise
for bids' for' the section of the freeway from Rosemead Boulevard to
Santa Anita Avenue in July; "that in connection therewith the City
will be required to install certain sewers which it will need later
and will be installed at this time. He explained that the City's
share" of the cost is $6,250 and noted that this sum will be
recovered by the City when the property which this sewer line will
serve becomes more fully developed and property owners pay their
proportionate share of the cost'for being permitted to connect
to the sewer.
Whereupon it was MOVED by Councilman Butterworth, seconded by

the City Council authorize the appropriation of $6,250 for said
purpose from Reserve for"Capita1 Improvement Projects Account

The City Manager advised of the results of the competitive
bidding for providing uniform rental service as set forth in
detail in a report dated April 11, 1968 (on file in the office
of the "City Clerk). He recommended the award of the contract
therefor which the City'Council accepted as follows:

and carried on roll call vote as follows, that the contract for
furnishing cotton" uniforms for the "period from May 1; 1968, to
April 30, 1969, be awarded to the low bidder, Red Star Industrial
Service, Kovakar Division, at the estimated cost of $4,640.50
for the 12 months period; that all other bids be rejected; that
any irregularities or informalities "in the bids "or" bidding process
be waived and that the Mayor and City Clerk be and they are hereby

The City Manager explored in detail a proposed employment agreement
for erigaging" the 'law "firm of Surr & Hellyer in the San Gabriel
Valley Adjudication suit, which agreement has been recommended for
'approva1 ,by thel city .representative on the .San Gabriel Valley Water
'Association, former City" Councilman Conrad .T.1 Reibold. The
extensive work done by the association in an effort to secure
friendly adjudication of the water basin was explained and it was
noted that progress appears to have been made in that eleven water
producers in the basin have .agreed "on 'said law firm as legal
counsel.
Discussion ensued on certain aspects of the subject agreement with
emphasis on reimbur.sement 'of ltravel 'expenses with Councilman Helms
observing in part that the provision therefor appears to be without
limitation or standards and suggested that perhaps in the future
some .thought' should be given to limiting "factors .in, an agreement;
and noted that there is no provision for an audit "if it should be
necessary.
The City Council members concurred that the law firm is very
competent and it was the consensus of the Council that Mr. Reibold
has done and will continue to do an excellent job in looking after

the interests of the city. A letter over the signature of the
Mayor will be sent to Mr. Reibo1d in appreciation of his efforts.

with the Californi'a' 'Highway Commission concerning financing
of proJect. No. 243 (extension,of the 605 Freeway from the
San 'Bernardino Freeway to the Foothill Freeway).
The City Manager advised of the receipt of a communication from
the' Public ,Uti1ities"Commission' 'in response to the request of
the City for an extension in the date for the demolition of the
railroad station; that the date has been extended from July 1
to August 1. Letter of appreciation to go forward to the
Comm~ssion and the information will be disseminated to various
fund raising committees.

The City Manager will endeavor to secure the approval of the County
. for the contractor who is installing storm drain project (No. 1402)
to use county property at Huntington Drive and Holly Avenue (just
above the rose garden) for stockpiling dirt during the excavation
period; that he would also offer the use of city property at the
west end of the city yard (Third Street) for the same purpose. This
proposal met with the approval of the City Council.
The City Council received notice that National Library Week starts
Sunday, April 21; that special awards will be made.
The City Council received information that the Vice President of
the Pinto-Pony-Colt League had expressed appreciation for the
improved facilities at Bonita Park. The General Maintenance
Superintendent was commended in this regard.
In order to consider the following item the provisions of the
Procedural Ordinance were WAIVED on MOTION by Councilman
Considine, seconded by Councilman Butterworth and carried
unanimously.
On MOTION by Councilman Arth, seconded by Councilman Considine
and carried on roll call vote as follows, the Mayor was authorized
to execute the Joint Powers Agreement for municipal data processing
system installation, subject to the approval of said agreement by
the City Manager and City Attorney.

On recommendation of Councilman Butterworth, a letter will be
directed to the City of Monrovia concerning its property on
Michil1inda Avenue and reaffirming the willingness of the City
of Arcadia to carry out its commitment therefor; that if
MOnrovia does not care to proceed, this city would have never-
theless fulfilled its commitment and there could be no further
argument. Said communication to have the signature of the Mayor.
Discussion held on the appointment of an independent auditor for
1967-68 and the matter will be an agenda item for the regular
meeting of May 7.
Louis Black, 1043 W. Huntington Drive, stated in part that he
has audited the books for the City during the past three years
and that the previous auditor had performed the work for seven
years. He asked to be considered for this year's examination
of the books.
At 10 P.M., Mayor Hage adjourned the meeting sine die.
