HomeMy WebLinkAboutAUGUST 5,1968 I~U~U y \)1'-) 1 18:7313 MINUTES CITY COUNCIL OF THE CITY OF ARCADIA ADJOURNED REGULAR MEETING August 5, 1968 The City Council of the City of Arcadia, California, met in adjourned regular session at 7:45 P.M. in the Conference Room of the City Hall. PRESENT: ABSENT : Councilmen Arth, Butterworth, Considine, Helms, Hage None Continued discussion on revised city charter. The forthcoming table of contents for the new charter was noted. SECTION 401 - ELIGIBILITY. Fifth line to read "a Councilman who. has been elected for '2 consecutive 4 year. '" SECTION 403 - VACANCIES. FORFEITURE OF OFFICE. FILLING OF VACANCIES. City Attorney to provide for continuation of councilmanic authority should all five members of council be involve9 in fatal disaster. SECTION 403(C) The words "and so forth" to be omitted in fifth line. SECTION 406 - PROHIBITIONS. (a) HOLDING OTHER OFFICES. City Attorney to recheck. May become part of Section 400. SECTION 411 - OPEN MEETINGS. RALPH M. BROWN ACT. To reflect the provisions of the Ralph M. Brown act, as exists or as amended. SECTION 500 - CITY MANAGER. Provisions discussed at length, primarily on the amount of time for removal notice to the City Manager following a municipal election. Councilmen Arth, Considine and Hage felt that 135 days would be appropriate. Councilmen Butterworth and Helms were not in agreement. Councilman Helms felt that 90 days as reflected in the proposed document would be adequate. SECTION 505 (B). The last clause from the semi colon to read, "and all of said books shall be properly indexed and open to public inspection when not in actual use. SECTION 602. DIRECTOR OF FINANCE (d) The words "in accordance with audit procedures provided for in this charter" to be deleted. TREASURER. to follow the last word in this paragraph, the words Ilor resolution.'1 SECTION 604. Change the words "Department Heads" to "Appointive Administrative Officers." SECTION 605. PERSONAL FINANCIAL INTEREST. In the third line the word "substantial" to be deleted. The City Attorney to provide for defini- tive government code section where reference to state law is made. SECTION 607. ACCEPTANCE OF OTHER OFFICE. City Attorney to review the words "employee" and "officer". SECTION 7 0 2. APPO INTMENTS. TERMS. read "after the expiration" of the Second paragraph. The last line to second consecutive term. SECTION 704 - MEETINGS. CHAIRMEN. The word "serve" to be deleted in line four and the words lito serve" inserted after "tempore", line five. 8-5-68 - 1 - 18:7314 First paragraph, last sentence, to read "the provisions of Section 411 of this Charter (the Ralph M. Brown Act) shall apply to all meetings of boards and commissions." Third paragraph, fourth line to read "Commission may prescribe its own procedures and rules of operation" which shall...City Attorney to check out. City Attorney to check omission concerning penalty to be invoked for failure to testify...power to compe1...and so forth. SECTION 705. COMPENSATION. VACANCIES. Third paragraph. End of fifth line, the words "or takes any legally necessary step" to be stricken. Sixth line to read "or files nomination papers to run for elective city office, which office shalL.." 1 SECTION 706 - PLANNING COMMISSION. The City Attorney will provide for Section 706.1 for a General Plan. SECTION 708. LIBRARY BOARD OF TRUSTEES. POWERS AND DUTIES. (b) Change the word "make" to "establish". Change the words "rules and regulations" to "procedures and rules of operation." Last line of this paragraph, change the word "may" to "it shall." (c) Change the words "department heads" to "appointive administrative officers." SECTION 801 (c) City Attorney to explore alternate for the word "official" as used and designated with Personnel. Last line under (c) the words "officer or" to be deleted. SECTION 804. SUSPENSION. DEMOTION AND DISMISSAL. Fourth paragraph. Some question as to the inclusion of rules of evidence made in applying to informal hearing. Fifth paragraph, sixth line, the word "officer" to be changed to City Manager. SECTION 806. PROHIBITIONS. GENERAL. (a) Second line to read "in any way be favored or be discriminated against with respect..." (c) The -;nd of line three to inc lude the words "or offer to pay" after the word "pay". (d) Include the last sentence in the present Charter, Section 806. SECTION 900. STATE SYSTEM. City Attorney to check out for the legal reference to the Employees' Retirement Act. SECTION 1102. DEFINITIONS. (j) Will be checked and altered by City Attorney. Emphasis was placed on the urgency of disseminating the contents and effects of the proposed charter to the e1ectarate within the remaining months prior to election day (November 5). I Mayor Hage referred to Watson Property Tax Initiative and advised Council that there will be a meeting on the subject in the Rodger Young Auditorium, Friday, August 23, at 10:00 A. M. City Manager was authorized to attend a labor relations seminar in San Franci~co. Funds from manager's budget. At 10:10 P.M. Councilman Helms moved to adjourn the meeting sine die.
