CITY COUNCIL OF THE CITY OF ARCADIA
ADJOURNED REGULAR MEETING
AUGUST 11, 1968
The City Council of the City of Arcadia, California, met in adjourned
regular meeting on August 11, 1968, at 9:00 A. M. in the Conference
Room of the Arcadia City Hall.

Continuation of proposed new Charter deliberations.
ARTICLE I
Incorporation and Succession
SECTION l02. ORDINANCES, CODES AND OTHER REGULATIONS. Delete the
words "they shall have been duly", "changed" and "by proper authority."
SECTION 200. Next to the last sentence changed to read "The enumeration
in this Charter of any particular power, duty or procedure shall not be
held to be exclusive of, or any limitation or restriction upon, this
general grant of power."
SECTION 200. Last sentence changed to read "The City shall have the
power and may act pursuant to procedure established by ordinance or
any law of the State."
SECTION 201. INTERGOVERNMENTAL RELATIONS. The words "cities" and
"counties" to be included in this paragraph.
ARTICLE IV
THE CITY COUNCIL
SECTION 400. CITY COUNCIL. The August 9 draft as suggested by the
City Attorney was acceptable to Council, however, the word "organization"
in the seventh line was changed to "sequence of terms." Council preferred
the second paragraph of this section as outlined in draft dated August 2,
starting with "Each Councilman in office..."
SECTION 403 (a) VACANCIES, FORFEITURE OF OFFICE. FILLING OF VACANCIES.
To read "A vacancy shall exist ~ the Council,and shall be declared by
the Council, if a Councilman resigns, is legally removed other than by
recall, dies, or forfeits his office," in draft dated August 9.
SECTION 40l. ELIGIBILITY. Council determined to retain suggested
paragraph in draft dated August 5.
SECTION 402. COMPENSATION. To include the words "without further
council action", using the new paragraph in draft dated August 5.
SECTION 403 (c) Council determined to retain draft of August 2
changing the tenth line to read "qualifies, provided upon the occurrence
of a second vacancy, more than one year prior to the next general
municipal election". The word "any" in the fourteenth line same para-
graph to be changed to "the".
SECTION 406. PROHIBITIONS.

adoption, or at any later date specified therein, except the following..."

ARTICLE V
THE CITY CLERK
SECTION 501. CONTINUATION OF PRESENT CITY CLERK. Deleted the word
"appointed" in second line in draft dated August 2.
SECTION 503. VACANCIES. FORFEITURE OF OFFICE. FILLING OF VACANCIES.
Accepted draft dated August 5 except the word "any" in last line to be
changed to "such" and add after the last word "term" the words "or until
the next general municipal election whichever shall first occur." The
City Attorney to expand this paragraph to include a provision that the
newly elected clerk would serve for the remainder of the unexpired term.

THE CITY MANAGER
SECTION 600. CITY MANAGER. SELECTION AND QUALIFICATIONS. Accepted
draft dated August 2 with deletion of third paragraph thereon.
SECTION 60l. REMOVAL OF CITY MANAGER. Accepted draft dated August 5.
ARTICLE VI
OFFICERS AND EMPLOYEES
SECTION 602. DIRECTOR OF FINANCE. New (g) of August 2 will become
(0 in new draft to read "supervise the collection, receipt and the
deposit of all moneys payable to the city in a depository designated
by the councilor by the city manager, if the council has not acted
and in compliance with all applicable laws".
SECTION 602. TREASURER. The word "and" to be substituted for "or"
in last sentence. Draft dated August 5.
ARTICLE VII
BOARDS AND COMMISSIONS

Reference to DEPARTMENT HEADS or APPOINTED ADMINISTRATIVE OFFICERS
to be changed to DEPARTMENT ADMINISTRATOR in every instance. City
Attorney to define pursuant to Government Code of the State.
SECTION 704. MEETINGS. CHAIRMEN. Accepted new draft of August 5.
Last sentence in first paragraph to read "Provisions of section 411
hereof relating to the Ralph M. Brown Act, shall apply to all meetings
of boards and commissions, and, subject to the provisions of said act,
all meetings shall be ope~ to the public.

conduct shall be reported to the Mayor and procedures may be taken
pursuant to Section 413, hereof."

held on (b) in draft dated August 5 concerning purchases. Councilmen
Arthand Helms felt that the City Council should have more control on
library purchases. Ho~ever, the remaining councilmen preferred to leave
it as set forth in the draft of said date. '
ARTICLE VIII
CIVIL SERVICE

SECTION 804. SUSPENSION. DEM OTION AND DISMISSAL. Change the,word
"or" to "and" first word, second line. Fourth paragraph, fifth line,
insert after the word "regulations" "within thirty days from such
notification such answer..."
Fifth paragraph, accepted draft of August 5. Delete the word "to"
in the last sentence.
ARTICLE XI
FISCAL ADMINISTRATION
SECTION 1111. Second paragraph, third line, delete "lega lly registered"
and change the word "electors" to "voters" in fifth line.
City Attorney will check Section 1003 of the Model City Charter. He
observed that Section lOl of the proposed new charter includes this
provision.
Under Article XIV, MISCELLANEOUS, Section 1401 (j) shall include
"as shall be the singular and plural" (genders).

Index and table of contents to be prepared. Council to review proposed
charter with changes as soon as possible. Names of the charter committee
and the members of the city council to be incorporated in the material
for the public to review.
The City Attorney was highly commended on the oustanding work he has
performed in coordinating the determination of the council.
Adjournment at 1:35 p.m. Councilman Helms moved to adjourn the meeting
sine die. Motion seconded by Councilman Butterworth and carried
unanimously.
