Rev. A. Karl Myers, Village Presbyterian Church Mayor Don W. Hage PRESENT: ABSENT: Councilmen Arth, Butterworth, Considine, Helms, Hage None The Minutes of the Regular Meetings of January 7 and 21, 1969, were APPROVED on MOTION by Councilman Considine, seconded by Councilman Arth and carried unanimously. Application of the Union Oil Company for a permit to allow its representatives to contact property owners in connection with acquisition of subsurface oil and gas leases. It was noted in a letter from said company that the program consists of a direct mail contact, including a letter of explanation and instructions for executing the lease which is enclosed; that a property owner may return the executed lease by mail. That the subject application is necessary in order to contact individuals who do not answer by mail and to further explain the nature of the lease, as well as to deliver consideration checks to those property owners who have answered by mail. He noted that the representatives are bonded and screened by the company and carry identification. The City Manager explained that the request is similar to that of the Standard Oil Company which was approved approximately one year ago; that it does not apply to any drilling and that the provisions of the Solicitation Ordinance would be enforced. Mayor Hage declared the hearing open. No one desiring to speak to the matter the hearing was CLOSED on MOTION by Councilman Considine, seconded by Councilman Helms and carried unanimously. Councilman Butterworth stated in part that it should be emphasized that the approval of this application would not imply any permission to drill. Whereupon it was MOVED by Councilman Considine, seconded by Councilman Helms and carried on roll call vote as follows, that consistent with permission granted' Standard Oil Company the City Council hereby grants the same permission to the Union Oil Company to contact property owners in the manner described and that the provisions of the Municipal Code as it pertains to door to door solicitation be complied with. A complete study will be made of local revenue sources available to cities, the county, school districts as well as the types of services these units of government are providing for the citizenry. It was felt that this is a step in the right direction, that the city would benefit, whereupon it was MOVED by Coun~ilman Butter- worth, seconded by Councilman Arth and carried unanimously that such a study be made by the Los Angeles County Division of the League of California Cities with county participation. The City Attorney had prepared a proposed contract to be entered into with the Simon Eisner & Associates and it was MOVED by Councilman Helms, seconded by Councilman Arth and carried on roll call vote as follows, that the contract be executed with said company for the creation of a general plan for the city. 1 AYES: NOES: ABSTAIN: Councilmen Arth, Butterworth, Helms, Hage None Councilman Considine, as he did not receive the proposed contract in sufficient time to study the contents None ABSENT: In order to proceed with the implementation of the General Plan Study it was MOVED by Councilman Arth, seconded by Councilman Butterworth and carried on roll call vote as follows, that an appropriation of $28,775 be made from Capital Projects Account and that staff be directed to forward the appropriate application for reimbursement by the State for two-thirds of the total cost of the development of a General Plan, but that during the interim the City proceed as promptly as possible to start the work on the Plan. AYES: NOES: ABSENT: Councilmen Arth, Butterworth, Considine, Helms, Rage None None The request of the Ray Geophysical Division, Mandrell Industries, Inc., for permission to conduct a survey along Santa Anita Avenue from the south city limits to the north city limits was DENIED on MOTION by Councilman Considine, seconded by Councilman Helms and carried unanimously. It was the consensus of the Council that the streets have previously been surveyed by other companies and, based on the complaints received, its motion was made consistent with past policy. Upon recommendation of the City Manager and the Purchasing Officer, it was MOVED by Councilman Considine, seconded by Councilman Helms and carried on roll call vote as follows, that the City continue its participation in the cooperative gasoline purchasing program for the fiscal year 1969-70 as coordinated by the Los Angeles County Purchasing Agent and that said Agent be so notified. I AYES: NOES: ABSENT: Councilmen Arth, Butterworth, Considine, Helms, Rage None None The City Manager advised that a reViSion of the sales agreement between the Pacific Southwestern Properties and the City for city owned land at the southeast corner of Naomi and Baldwin Avenues would be necessary due to the fact that the proposed type of eating establishment was no longer available, however, one small photograph 2-4-69 - 2 - J I of I 1 NEIGHBORHOOD PARK (Baldwin Stocker) ;;? Iii 3 tl COUNCIL POLICY (Recognition for Service) CARNIVAL (Parking Lot) continued 18: 7413 of the new building had been briefly reviewed by Council. It was noted that the developer will be required to apply to the Planning Commission for a conditional use permit. However, the matter will be held over until the next regular meeting to afford an opportunity for Council to teview a more comprehensive rendering or plot plan. the City Manager advised that the School Board has endorsed the proposed plans for the development of property at the Baldwin Stocker School. However, they have added the same stipulation as the City Council - that no construction be authorized until it has reviewed a report concerning future school needs and will inform the City at such time as it can be said that the school would have no further use of the property. There- fore, the City Manager will be informed by the School Superintendent ~hen the report is received and when the School Board takes such action. the City Manager paraphrased his report dated January 30, 1969, concerning certain standards for recognizing individuals who have served the city in various ways. According to said report the recognition would be in the form of Keys to the City, Plaques with Gavels, Ceramic Plaques, Resolutions, Certificates and Proclamations. It was MOVED by Councilman Arth, seconded by Councilman Helms and carried unanimously that the guidelines as set forth by the City Manager in his report dated January 30, 1969 be ACCEPTED as the general award policy for the City Council. It was then MOVED by Councilman Helms, seconded by Councilman Considine !p~~E~rried unanimously that the motion be amended to include "Council ~diiW~ on Proclamations and the like. II The request of the Arcadia Jaycees for permission to conduct a carnival on property north of the City Hall surrounding the parking lot and heliport from April 9 to 13 was held over until staff ascertains the position of the Turf Club inasmuch as the area in question is on lease to them, also the possible damage to the paving which is only about 1" to 2" thick and arrangements are made for appropriate bonding to provide for the payment of any damage by the Carnival Company. AUDIENCE PARTICIPATION CLAIM (Fox) (SIGNS) 1 4 Calvin Fox, owner of the Phillips 66 Station at 5 W. Huntington Drive, inquired as to the disposition of a claim filed for $6000 damage to his business from August 6, 1968 through November 25, 1968. Mr. Fox stated in part that the claim is a result of .loss of sales due to the requirement by the City to remove miscellaneous signs on the business premises. He said he had received an acknowledg,ment of the claim from the City Controller on November 26, 1968. The City Attorney ~ill investigate the matter. Mayor Hage advised Mr. Fox that the sign ordinance will be studied by Council on Sunday February 9 at 7 P.M. All interested persons are invited to attend. Steve Frohling, manager of MacDonald's Hamburger stand on Foothill Boulevard, expressed concern with the possibility of losing its $8000 sign at the expiration of the proposed abatement period under the new sign regulations. The sign was installed in 1965. He stated in part that the requirement would work a hardship on those already in business. Lawrence White, manager of MacDonald's in 1966 spoke briefly on the matter. In answer to questions he stated that at the time of the sign installation it was considered to be an architectural feature. 2-4-69 - 3 - '\ MUNICIPAL DATA SYSTEM (Arth~ DRAINAGE PROBLEM (Arcadia Avenue) ~r) TRAFFIC ~~;O PROCEDURAL ORDINANCE WAIVED ':)3~1 AUDIT ;; 1967 -68 OPTION TO PURCHASE City own~d Land 3' 10 3 ,~ ADJOURNMENT 9:20 P.M, 18:7414 Robert O'Hagan, manager of the Arcadia May Company, referred to a -communication from Don Ehr, assistant manager of Hinshaws, in which it was suggested that a review of the program include a representative of the entire business community and perhaps some representation from the Sign Association. Mr. O'Hagan agreed therewith, with the thought that he did not believe the total business community was represented on the committee which studied the matter. In conclusion he suggested additioral time for businessmen to conduct an intensified review. Cllas .Harding, 431 E. Las Flores Avenue, exp lored the format ion of the ad hoc committee which has met for over a year; the press coverage; public meeting at which all businessmen in Arcadia were invited, and read the names of the persons serving on that committee. 1 Councilman Considine stated for the record that he appreciated Mr. Harding's clarification because he felt the committee had worked long and diligently, as did the Planning Commission and that if any new evidence is presented the ad hoc committee and the commission should hc~.v~ i.e-n".9PP9ftunity to rev~e~ l~t. . Councilman Arth reported that a meeting was held on January '27 at which'bids were reviewed and that RCA with its Spectra 45 was awarded the contract based on its low bid. .. . ,.;,,' I' l ~ .', Councilman Considine advised that he had received a report on the drainage 'problem at the rear of a medical building (Arcadia Avenue) facing Duarte Road. Discussion ensued with the Director of Public Works recommending the construction of a half street in lieu of a drain type facility. It was the consensus of the City Council that it is incumbent upon that body to improve the situation and it was MOVED by Councilman Considine, seconded by Councilman Helms and carried..on roll call vote as follows, that staff complete the engi~eering' 'for the improvement of the half street and eventually go to bid.. AYES': NOES: ABSENT: 'Councilmen Arth, Butterworth, Considine, Helms, Hage None NO,ne ': In answer to concern expressed by'Councilman Helms it was noted that lane markers for Baldwin Avenue immediately north of the median strip (lane change indication) were on order and will be installed on the sub~ect location and another on Santa Anita Avenue south of Santa Cla~a. On MOTION by Councilman Butterworth, seconded by Councilman Helms and carried unanimously the provisions of the procedural ordinance were wa{veq in order to consider the following items. 1 " " The.'City Manager distributed copies of the independent audit for 1967-68 as .~i~pared. and submitted by Louis P. Black. \. .'- The City Manager reported that the option will soon expire on the sale of city owned property at 506 S. Santa Anita Avenue; that it appears sub- stantial progress is being made; that the purchaser is requesting a 90 day extension at the existing option fee of $975 per month. As a repre- sentative of the Land Committee, Councilman Helms MOVED that the extension be granted. Motion seconded by Councilman Butterworth and carried unanimously.
