REGULAR MEETING
FEBRUARY 18,1969
The City Council of the City of Arcadia, California, met in regular
session in the Council Chamber of the Arcadia City Hall on February
18, 1969, at 8:00 P.M.

The Minutes of the Regular Meeting of February 4, 1969, were APPROVED
on MOTION by Councilman Helms, seconded by Councilman Butterworth and
carried unanimously.
Extensive discussion was held on the proposed new sign ordinance,
which would amend, repeal and add to certain regulations relating
to signs. The twelve page document was perused page by page and each
individual councilman indicated areas with which he differed.
With reference to signs to be prohibited, page three, Councilman
Butterworth stated in part that he favored a provision in the
ordinance which would regulate but not prohibit moving or rotating
signs; that if moving signs are prohibited and the Van de Kamp
sign is not included the law would not be uniform and the City
Manager would be placed in an untenable position inasmuch as he
is charged with enforcing the law. He felt the Council should
take a moderate position by opposing moving signs and that under
a proper showing they could be permitted.
In referring to the action of the Council at the time the Van de
Kamp sign was permitted, Mayor Hage stated in part that it was
considered part of the architecture and not a sign per se; that
he could not in all fairness insist on the abatement of that
particular moving sign under the conditions. Whereupon he MOVED
to allow moving signs currently in operation and to disallow all
future requests for moving signs. (MOTION DIED FOR LACK OF A
SECOND) .
Following further discussion Councilman Considine MOVED to accept
the definitions and prohibitions concerning movable signs, on
page three, Motion seconded by Councilman Arth and carried on roll
call vote as follows:

In connection with his motion Councilman Considine observed that
Council is attempting to draw up what it considers to be the best
and most appropriate sign ordinance; that at the time Van de Kamp's
windmill was permitted a statement was made by the Council at that
time that the windmill would not be considered a sign; right or
wrong, the statement is a matter of record. He felt that motion is
not necessary for identification which is the prime purpose of a
sign.
Definitive language for clarification purposes was explored and
will be incorporated in the ordinance by interlineation (See page4 & 5).
The date for the eventual removal of nonconforming signs will be
Apri 1 5, 1975, instead of 1974, as previous ly indicated.

Following completion of the review of the proposed new ordinance
and in answer to query by Councilman Butterworth, the Planning
Director stated in part that in his opinion the document is
workable, that hardships are not indicated and that there has
been no misjudgment,on the part of the council.
The new sign ordinance was introduced later in this meeting.

No action was taken on Planning Commission Res. Nos. 668 and
669-A & B granting conditional use permits for a) restaurant at
815 S. Baldwin Avenue and b) restaurants at 305 and 309 E.
Foothill Boulevard. It was noted that February 22 will be the
expiration time of the ten day appeal period.
March 4, 1969, was scheduled as the date of a hearing on the
recommendation of the Planning Commission concerning amending
the Municipal Code as it relates to the Modification Committee.
This meeting will be adjourned to a time certain in order to
review the capital project program as submitted by the City Manager.
Councilman Helms requested reports from the City Engineer, the Fire
and Police Chiefs concerning median strips.
At the last Council meeting a request was made for more comprehensive
renderings of the proposed restaurant for the southeast corner of
Baldwin and Naomi Avenues. Representatives of the International
Industries (potential buyers of the property) were present at the
pre agenda meeting and displayed plans for a seventy seat restaurant
and parking area. It was MOVED by Councilman Arth, seconded by
Councilman Helms and carried on roll call vote as follows, that
previous authorization for sale of the subject property is hereby
amended to permit the construction of a restaurant building in
accordance with plans submitted by International Industries.

The City Manager advised that the dates of the carnival which the
Arcadia Jaycees desire to hold on the parking area leased to the
Turf Club north of City Hall have been changed from April 9-13 to May
1-4; that a reply is awaited from the carnival operator as to a
sufficient bond to protect the City, the Turf Club and the Jaycees.
It is necessary to ascertain the acceptability of the surety bond to
be posted by the operator to guarantee complete repair of any damage
to the area in question.

It was noted that applications for 1969 business permit renewals have
been received from the Arcadia Sports Center, dba Arcadia Bowl, 21
Morlan Place, Vista Management Company, dba Bowling Square, 1020 S.
Baldwin Avenue, and Late Corporation and Mango Corporation, dba Santa
Anita Lanes, 188 W. Las Tunas Avenue. The recommendation for approval
of the license officer and the City Manager was accepted on MOTION by
Councilman Considine, seconded by Councilman Butterworth and carried
unanimously.' In order to emphasize continuance of the conditions
governing alcoholic beverages the City Clerk will' remind each permittee
by letter of the special permit condition under which the permit was
originally issued and that the condition remains in effect. Acknow-
ledgment will be requested.
When the City Council granted a business permit (April 16,1968) to
Donald E. Seversike to operate the Cinemaland Theatre, renewal of
the permit was to be reviewed by Council. It was noted by the
License Officer and the City Manager that the applicant has maintained
a policy of showing regular, first grade movies during the past ten
months and the Police Department reports there have been no problems
connected with the operation of the theatre. Whereupon it was MOVED
by Councilman Butterworth, seconded by Councilman Considine and
carried unanimously that the subject business permit be renewed for
1969; that the matter be brought back to Council only if complaints
are received.
The request of the West Arcadia Business & Professional Association ",;
for permission to hold a clothesline art show on March 8 on both
sides of Baldwin Avenue between Duarte Road and Naomi Avenue and
in the Golden West Village area was APPROVED on MOTION by Councilman
Helms, seconded by Councilman Butterworth and carried unanimously,
subject to the approval of the Public Works Department. Insurance
protecting the City is still in full force and effect.
The request of the Boys' Christian League for permission ,to airdrop
leaflets publicizing its activities was DENIED on MOTION by Council-
man Considine, seconded by Councilman Arth and carried unanimously.
The Municipal Code restricts the distribution of advertising matter,
and the prohibition against littering would be a negative factor also.
The Council is in complete sympathy with the programs of the League,
but feels that other avenues of advertising should be encouraged.
It was MOVED by Councilman Helms, seconded by Councilman Butterworth
and carried on roll call vote as follows, that 24 mastarm-mounted
street name signs be purchased for six locations as indicated on a
map attached to the report of the Director of Public Works dated
February 14, 1969.. It was noted that the expenditure will approximate
$1800, funds within the current Public Works budget. An endeavor will
be made in future years to finance same out of Gas Tax funds.

In order to consider the following item, the prov,s,ons of the Procedural
Ordinance were waived on MOTION by Councilman Butterworth, seconded by
Councilman Considine and carried unanimously.
The City Manager advised that the County Flood Control District has
asked permission to haul debris from the Sierra Madre Dam and the
Carter Debris Basin to the Flood Control Channel. Hauling would be
routed in Arcadia from Grandview Avenue to Santa Anita Avenue to
Elkins Drive to the Wash. On the basis of this hauling route being
used and the District assuming the obligation of repairing damage which

may result from the hauling operations, the fee as required by City
Ordinance No. 1377 was waived. This is an emergency measure inasmuch
as the basins are full and must be emptied. Work proposed to start
March 5 and run for approximately 180 days. Councilman Considine was
greatly concerned about the speed limitation of the trucks, control
of dust and maintaining clean streets during the operation and recalled
similar experiences during the freeway construction. Staff will work
with the District toward this end.
Walter Gockley, Chairman of the Ad Hoc Committee on Signs, expressed
appreciation for the way the Council, Planning Commission, staff and
all others had resolved the problems connected with the preparation of
a new sign ordinance with which the businessmen could live~

Louis Baldwin, 1116 Highland Oaks Drive, asked for assistance in
eliminating the glare from the McDonald signs at the hamburger stand
on Foothill Boulevard; that it ,is a nuisance especially during the
times his patio is in use. The City Manager referred to a section
in the proposed new sign ordinance prohibiting glare. The Building
Department will investigate and report back.
Calvin Fox, owner and operator of the Phillips 66 gas station at the
northwest corner of Santa Anita and Huntington Drive, stated in part
that in his opinion the proposed ordinance will be a violation of
the constitutional rights of individuals; that a man has every right
to pursue his business without restraint.
Homer Shirley, owner of the Superior Concrete Block Company, 10836
E. Live Oak Avenue, asked if the new Capital Project Program provided
for the construction of a new fire station in his area. The City
Manager advised that it is not anticipated during the next five year
program and noted the existence of two fire stations (County) located
fairly close to his business.
The City Attorney presented, explained the content and read the title
of Resolution No. 4053 entitled: "A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA AUTHORIZING THE DESTRUCTION OF CERTAIN FIRE
DEPARTMENI RECORDS."
It was MOVED by Councilman Considine, seconded by Councilman Arth
and carried on roll call vote as follows, that the reading of the
full body of, Resolution No. 4053 be WAIVED.

ENDORSING VIGOROUS ENFORCEMENT OF REGULATIONS FOR CONTROL OF WATER
POLLUTION ANDlRGING THAT REGULATIONS BE STRENGTHENED WHERE NECESSARY."
It was MOVED by Councilman Arth, seconded by Councilman Considine and
carried on roll call vote as follows, that the reading of the full body
of Resolution No. 4054 be WAIVED.

The City Manager noted the new brochure advertising the attributes of
the city's industrial and commercial areas.
Expressions of appreciation were made to all persons involved in bringing
the sign ordinance to its conclusion.
At 10:00 P.M. the meeting was ADJOURNED until TUESDAY, FEBRUARY 25, 1969,
at 7:30 P.M. in the Council Chamber. There being a scheduled Planning
Commission meeting at 8 PM in the Chamber, the Council will continue its
deliberations in the Conference Room at~.
