The City Council of the City of Arcadia, California, met in regular
session in the Council Chamber of the Arcadia City Hall on March 4,
1969, at 8:00 P.M.

The Minutes of the Regular Meeting of February 18, 1969, and the
Adjourned Regular Meeting of February 25, 1969, were APPROVED on
MOTION by Councilman Helms, seconded by Councilman Butterworth and
carried unanimously. Councilman Considine abstained from voting
on the February 25, 1969, minutes due to his absence therefrom,
HEARING Planning Commission recommendation (Resolution No, 670) concerning
altering the membership of the Modification Committee, This would
, .~' entail an amendment to the Municipal Code Section'9292,l, The
f.)? ~;0~ , C~mmission finds that said committee will function more efficiently
q ',_!.j) by substituting the Planning Director foc the Building Official as
))~. one of the members of the committee, The Committee would then be

Mayor Hage declared the hearing open, No one desiring to be heard on
the matter, the hearing was CLOSED on MOTION by Councilman Considine,
seconded by Councilman Arth and carried unanimously,
Whereupon it was MOVED by Councilman Considine, seconded by Councilman
Arth and carried unanimously that said recommendation be APPROVED and
that the City Attorney prepare the appropriate ordinance to change
Section 9292,1 of the Arcadia Municipal Code,
a, Planning Commission (Resolution No, 668) granting a conditional
use permit for a restaurant at 815 S, Baldwin Avenue was RATIFIED,
subject to conditions, on MOTION by Councilman Considine, seconded
by Councilman Butterworth and carried unanimously,
b, Planning Commission Resolution Nos. 669-A and 669-B granting
conditional use permits for restaurants at 305 and 309 E, Foothill
Boulevard were RATIFIED,subject to conditions, on MOTION by Councilman
Considine, seconded by Councilman Arth and carried unanimously,
c. Planning Commission (Resolution No. 671) granting a conditional
use permit for a restaurant at 101 South First Avenue was carried
over until the regular meeting of March 18, which will be the
expiration date for the filing of an appeal,
The City Council acknowledged the commendation from the Methodist
Hospital for the efficiency of the City Fire and Police Departments
during its recent fire problem; that the Hospital Officials are
convinced that the expeditious handling of the fire by the departments
was the primary reason no lives were lost nor serious injuries sustained~

Request for consideration and support of the Los Angeles County District
Attorney's legislative proposals dated February 1, 1969, The remedies
included therein are to provide citizens of the County with the type of
law enforcement and criminal justice to which they are entitled. It
was the consensus of the City Council that many of the proposals are
beyond the responsibility and jurisdiction of the Council and that it
would rather not be placed on record. Mayor Hage will direct a
communication to the District Attorney setting forth the thinking of the
Council,
The communication concerning tax inequities from the City of Beverly
Hills was received. Reference was made therein to the committee 1
appointed by the Los Angeles County Division of the League of California
Cities to study the present County Services Area Law with a view to
possible action'thereunder to adjust what it is believed by incorporated
cities are inequities in the distribution of costs for county services
rendered to the unincorporated areas, for which incorporated cities are
supplying on their own, This includes both contract and independent
cities, Attached to the letter was a copy of an article from the Los
Angeles Times of February^9', Study is under way,
The letter expressing appreciation for the installation of a Shuffleboard
in the Assistance League Clubhouse, 100 S. Santa Anita Avenue, was
received and ordered FILED,
The letter from Arthur D. Gutenberg commending the Fire Department for
its assistance during the recent rains was received and ordered FILED.
Pressure buildup from impounded water was eliminated ~t his residence.
The City Manager advised that the Fire Department handled many such
instances.
The letter expressing appreciation for the assistance rendered Peace
Corps Trainees in the Municipal Management II Program for Venezuela
was received and ordered FILED.
In considering the request of Path, Inc., for the inclusion of a
community center concept in the Five Year Capital Program, it was
the consensus of the City Council that the request is properly one
which the City Recreation Commission should study and make recommendation.
Mayor Hage will direct a communication to the organization that the
request will be submitted to said Commission and that Council is open
minded on all recommendations from citizens on Capital Projects,
In exploring the report on the employment of an economic consulting
firm for assistance to the Planning Consultant in the development
of recommendations as part of the General Plan Study, one of the firms
recommended was eliminated based on experience of one of the Councilmen.

On November 5, 1968, Council approved Second Avenue widening and realign- 1
ment and authorized acquisition of appraisal of property formerly occupied
by the Hammond Lumber Company as well as Bonita Park property needed for
the realignment of Second Avenue at Huntington Drive intersection, The
City Manager Pro Tempore and Director of Public Works advised (report
dated February 28) that subsequent study of the realignment has disclosed
the inadvisability of improving Second Avenue north of Huntington Drive
terminating at or southerly of Santa Clara Street since the balance of
the pavement northerly of this location to Colorado Boulevard is inadequate
in width and in extremely poor condition, It was recommended that the
'improvement project limits be established at Bonita Avenue on the south
and Colorado Boulevard on the north which would require the appraisal
of eight properties and recommendation as to value concerning surplus

property created by virtue of the realignment, The proposal from
Howard S. Martin and Associates to make the needed appraisals for
$3,000 was accepted on MOTION by Councilman Arth, seconded by
Cou~cilman Considine and carried on roll call vote as follows:

Communication from the Methodist Hospital with further reference to
its previous request for permission to rotate the golden cross located
on the top of the elevator penthouse, It was noted therein that the
cross not only has been an identification feature but,. also serves as
a landmark for the civic center; that it is a symbol and would be
rotated exceedingly slow at the rate of four revolutions per minute, It
was pointed out that the hospital is located on property which is
classified as being unzoned and technically does not fall within the
scope,of commercial regulations.
In comparing the cross with th'e"Van de Kamp rotating windmill as part
of the structure, Councilman Butterworth stated in part that he would
be hard pressed to deny the request and MOVED that the request be
granted. Councilman Considine seconded the motion which was unanimously
carried. It was specifically pointed out in the granting of this
requ,est the cross is not considered tohbilft,commercial sign; but an
architectural feature of a'non-profit/f~c111ty and as such is not

considered to be controlled by the sign ordinance; that the property is
not under commercial zoning.
The request of the West Arcadia Business and Professional Association
for permission to hold its annual Junior Achievement Trade Fair on
March 22 or 29, 1969, on both sides of Baldwin Avenue between Naomi
Avenue and Duarte Road and also in the Golden West Village,area wa~
APPROVED on MOTION by Councilman Helms, seconded by Councilman
Considine, and carried unanimously. Any construction on city right-
of-way must meet the requirements of the Public Works Department,
The City is currently covered by the Association's insurance pOlicy.
It was noted in a report dated February 28 that the City Council on
October 3, 1967, adopted Resolution No, 3962 approving an Agreement
between the State Department of Beaches and Parks, the Los Angeles
County and State Arboretum and the City, whereby the City would
construct a roadway within the Arboretum in lieu of payment for right-
of-way required for the Baldwin Avenue extension. The Arboretu~, staff
concluded that sufficient benefit would not be derived from the' 'roadway
construction to justify this project as called for by the existing
Agreement, '
A revised agreement called for certain landscape work not to exceed
the amount contained in a cost estimate, The right-of-way acquired
by the City was appraised at $34,500 and the Director of the Arboretum
has guaranteed by letter that certain costs will be held within acceptable
limits in order that the total cost to the City will not exceed the
original $34,500, The work is to be funded from presently allocated
State Gas Tax Funds and must not exceed the amount of the original
appraisal without supplemental funds derived from a source other than
gas tax,
It was MOVED by Councilman Considine, seconded by Councilman Arth and
carried on roll call vote as follows, that the Revised Agreement be
and it is hereby APPROVED and that the Mayor be AUTHORIZED to execute
same subject to approval by the City Attorney,

A letter will go forward to the Director of the Arboretum to the effect
that the City Council agrees to the revised contract with the condition
that the total cost ~ill not exceed $34,500,
On recommendation of the City Manager and the Water Manager it was MOVED
by Councilman Arth, seconded by Councilman Considine and carried
unanimously that the two bids received for modification of water distri-
bution lines Phase 2 required for Foothill Freeway construction be
rejected and that the City Clerk be and she is hereby authorized to
readvertise for bids to be received March 24, 1969, at 11 A, M. It
was noted that the two bids were well above the engineer's estimate
and due to restrictions imposed by the State Highway the design must
be revised.

Council received a report from the Director of Public Works and Building
Official on the request of Louis Baldwin, Jr" 1116 Highland Oaks Drive,
for assistance in eliminating the glare from signs located on McDonald's
drive in at 143 E, Foothill Boulevard, The report contained methods for
obtaining lower level of light. Council felt the report was complete
and that Mr, Baldwin should receive a copy thereof.,

William G, Smith, 1283 Oakglen Avenue, addressed Council at length
v01c1ng strong opposition to the plans of the County Flood Control
District to empty debris from ~he Sierra Madre Dam, Carter Basin
and Santa Anita Basin into the Santa Anita Deuris Disposal site.
It would raise the level of the fill site to that of his property,
He presented a detailed proposal which would provide vertical separation
of five, six or seven feet from the property, Mr, Smith referred to
the meeting with County Supervisor Bonelli, at which Mayor Hage and
the Director of Public Works were present; that he felt the Supervisor
was sensitive to the cost but insensitive to the residents; that in
h is opinion it was inverse condemnation of property. Landscaping to
be requested in an effort to separate homes from the fill,
The City Council assured Mr, Smith it would continue to urge the
Flood Control District to reconsider its present plan; that a
communication would be directed to Supervisor Bonelli supporting
Mr, Smith's proposal and asked all interested residents to submit
letters also, Staff will check the history of the fill site to
determine if some documentary evidence could be found to strengthen
the City's position, The site is owned by the District,
Russell E, Scharman, 928 W, Huntington Drive, stated in part that
he was moving to the area in question and commended Mr. Smith in
his efforts and the plan as presented at this meeting,
Mayor Hage complimented the group spearheaded by Mr, Smith and stated 1
in part that if there is a compromise on the part of the Flood Control
District it will be mainly due to Mr, Smith's efforts; that the City
has done everything possible to effect an'alternate plan; that
Supervisor Bonelli may heed the citizens more than the legislative body,
And once again suggested that citizens submit letters to Mr, Bonelli,
Homer Shirley, representing the South Arcadia Businessmen, read a
communication relative to capital needs in that area. Lighting,
tree planting, fire station and the median strip.
The City Manager reported that double mastarm lighting will be
installed in the center median which will go from Santa Anita east
to Third Avenue (eventually to city limits); that trees may be
installed at any time a property owner indicates willingness to pay
for the tree as the city cuts the concrete and plants the tree; that

a fire facility is not included in the capital project program for the
next five years (a study to be made On the possibility of cooperative
programs for stations located less than one mile from city limits); and
that the median strip is budgeted and plans are nearing completion
therefor.
Jerry Jackson, 310 N, Normandie, Los Angeles, representing the California
Sign Users' Council, expressed appreciation for the action of the City
Council in approving the rotation of the cross atop the Methodist Hospital.
He referred to the new sign ordinance before the legislative body at this
meeting and asked for further consideration on roof and rotating signs.
Charles Harding, 43L E, Las Flores Avenue, referred to the letter from
the South Arcadia Businessmen and explored the improvements which have
been made in that area including the addition of businesses and
residences; that it should be realized that there is going to be need
for more fire protection there and asked that further discussion be
, held on a fire station. Mayor Hage asked the City Manager to prepare a
report on the matter prior to the public hearing on capital projects,
(scheduled for March 18),
Bill Young, Bekins Moving and Storage Company, 35 W, Huntington Drive,
agreed with the statement made by Mr. Jackson concerning signs and
read a letter from Harold Sexsmith, District Manager of his company,
in which it was stated in part that signs are needed for business
identification and asked Council for reconsideration of the proposed
sign ordinance.
Louis Baldwin, 1116 Highland Oaks Avenue, thanked the Council for its
prompt action in response to his complaint about the glare emanating
from McDonalds Drive-In lighting arrangement. A copy of the staff
report will be submitted to Mr, Baldwin,
The City Attorney presented for the second time, explained the content
and read the title of Ordinance No, 1397, entitled: "AN ORDINANCE OF
THE CITY COUNCIL OF THE CITY OF ARCADIA AMENDING, REPEALING AND ADDING
TO CERTAIN REGULATIONS RELATING TO SIGNS."
It was MOVED by Councilman Helms, seconded by Councilman Butterworth
and carried on roll call vote as follows, that the reading of the
full body of Ordinance No, 1397 be WAIVED.

In answer to an inquiry by Councilman Considine the City Manager wiLL
prepare a report on the traffic pattern at Second Avenue and Colorado
Street, Mr, Considine cited instances of hazard at that location
In order to continue the practice of accurate and complete recording
of CounciL meetings (for permanent record) the City Clerk had to
purchase new improved equipment for which she will endeavor to pay
out of her current budget. Council indicated its willingness to
assist in the payment thereof if funds in said budget become depleted,

The City Attorney read in full Resolution No, 4056, entitled: "A RESOLUTION

The City Manager adv~sed of the receipt of a request from property owners
on a certain portion of Foothill Boulevard for a study of zoning in
their area. That same will be referred to Simon Eisner and Associates.

The City Manager outlined plans for the forthcoming Board and Commission
dinner (March 6), Cost of same to come from Council Contingency Fund,
At 9:45 P,M'l Council and the City Manager entered an executive session
in the Conference Room.
At 10:15 P,M., Council reconvened in the Council Chamber and adjourned
sine die immediately thereafter.
