JUNE 25, 1969
lhe City Ceuncil of the City of Arcadia, California, met in adjeurned
session en June 25,1969, at 7:30 P.M. in the Council Chambers of the
Arcadia City Hall.

lime and place scheduled for the public hearing en the proposed budget
for 1969-70. The proposed budget was filed in the effice of the City
Clerk on June 13, 1969, and has been available fer inspectien by the
public. An Affidavit of publicatien is on file in said office.
~ayer Arth declared the hearing open and follewing is a summary of the
preceedings, (Full transcriptien on file in the office ef the City
Clerk). No ene desired to speak to. any of the non-personnel items.
An extensive presentatien was made by Sam Hunegs en behalf ef the
~mployees who are members of the American Federation of State, County
and Municipal employees. He read some amendments to Chapter 10 of
the Gevernment Code effective as of January 1, 1969, relating to
,"The City through its representatives shall meet and cenfer in good
faith with representatives of formally recognized employee organizations
with majority representatien rights regarding matters within the scope
of representation including wages, hours and other terms and conditions
of empleyment within the appropriate unit." He read obligations imposed
thereby, including the prevision to furnish to the other party upon '
request nen-confidential data normally maintained during the regular
~ourse of business; to jointly prepare a non binding written memorandum
of understanding setting forth all agreed upon matters for submissien to
the City Council. He commented further en the mailing of the agenda
providing it is sufficiently descriptive and far enough in advance to
permit time for proper consideration.
He continued in part with an explanatien of the meetings he had with
the City Manager and the new Personnel Director; that all the prepesals
the Union had made cencerning fringe benefits for its members had been
rejected by the Director who also stated he was net prepared to discuss
salaries; that a study by staff was presented to the Union, which Mr,
Hunegs feund to be inadequate and incomplete. Reference was made to
the centents ef a study which had been submitted to. council by Mr.
Hunegs at the start of this meeting, This study set forth cest of living,
classification and fringe benefits and comparison ef salary with those
of specific cities. He commented that Arcadia, after the new salaries
Were adopted by the other cities, would still be third, fourth or half
way from the top, He paraphrased a telephone conversatien with the
Persennel Directer during which he stressed the need for an epportunity
to discuss the study prepared by city staff. That such a meeting had
not been held. He centinued in part that he later was infermed by the
hirecter that the recommendations of the City Manager and staff were
to be submitted to. the City Ceuncil and that there would not be a further
meeting. In answer to questiens of the Council, Mr. Hunegs related in

chrenological order the dates of his meetings with management which
he stated in part he thought lasted abeut 35 minutes in tote. He
concluded by asking Council to instruct the City Manager to meet
with his organization, attempt to achieve an agreement and return
to Council. That any such agreement be retroactive to July 1.
The President ef the Employee's Association, Mrs. Wilma Johnson,
addressed Council and read a communication which had been presented
to Council at the start ef this meeting, (Made part ef the record).
It was requested therein that the adoptien of the budget be delayed
until such time as a fair and legitimate study could be made and 1
negotiated upen; that the association have access to the percentile
ratings and salary figures used in cemparing city pesitiens with the
16 cities selected by management and that it receive all agreements
in writing prior to adoption. It was noted therein that a memorandum
to indicate management's good faith in its dealings with employees had
not been ~eceived although it had been advised the memorandum enly
needed th~ Manager's signature and would then be distributed.
The Chairman of the Police Relief Association, Thomas Bednark, referred
to a communication and proposal which had been submitted to Council on
June 24. Said documents were made part of the efficial recerd. Included
therein w~re recommendations on salaries and additional benefits which
had been based on increased cost of living and retention of trained
personnel, An across the board increase ef 12.5% for all swern members
of the department was requested. Also. hazard pay ef motor officers,
adjustments in sick leave. He explained meetings with the City Manager
and Personnel Director and asked fer a final meeting with the City
Council. He also requested that the budget adoption be deferred with
any agreements retroactive to July 1.
The City Manager then summarized his meetings with each ef the organi-
zations and stated in part that recommendations on salaries were put
into writing so there would be no doubt what was to be presented to.
Ceuncil; that he had used information supplied by the erganizatiens
and surveys compiled by management; that he had indicated to the
organizatiens that he would meet with them as eften as they desired.
He continued that adjustments were made after meetings were held and
that the question of meeting and conferring in good faith has to be
separated from the question of agreeing to the requests; that he did
not agree with any organization to approve all of its requests, nor
would it be proper for him to agree to something he theught was not
based on sound facts and policy just to get an agreement; that if
an agreement is not reached management and organizations make separate
reports for submission to. Council which is being done at this meeting.
He further stated that if he failed to see that the Empleyee's Associa-
tion received the referred to memorandum as to Council's action on formal
recognition of the association, he would assume that responsibility and
would plead guilty. He also commented that as yet he had not seen the 1
material submitted by the Union at this meeting and could not speak to it. ,
The Union representative stated in part that he had not seen any of the
changes referred to. by the City Manager and asked once again that action
on the budget adoption be deferred. The City Manager commented in part
there was nothing to impart to the Union as no changes were made in that
area; that the associations which secured changes in salary recommendations
were notified.
Ceuncilman Butterworth stated in part that nothing is lest b)' talking
things OVer, but he felt that the statement that the City Manager had
not met in good faith had net been supported; that written documents

were exchanged which to him seem to be more an evidence of good faith
than prolonged cenversations where there is no record; that the City
Manager had given in on a number of instances and in his opinion was
proper; that the Manager has stated he should have signed a memorandum
for distribution to the employee's association and in view of the position
taken by the City Manager he found it difficult to. see how it can be
argued that management has not negetiated in goed faith unless the
organizations take the position that he did not give in on everything,

Mayer Arth noted that all employees are aware that over a period of
at least ten years, the hearing date on the budget has been published
and held in order for it to be adopted by July 1.
The President of the Employee's Association asked to. have the record
show that the association did not receive written notice of any changes;
she then explored comparison of salaries in the 16 cities and stated
in part that enly 4 out of those 16 require the same high skills that
Arcadia dees for similar positions. She then asked to. receive in
writing salaries of all employees and explanations therefor, and
cemmented in part that to be even average the increase would have to
be 6,9% - using the cities recommended by the City Manager but not
censidering the higher requirement in skills.
Councilman Butterworth observed in part that if the associations feel
they have not had ample opportunity to express themselves and if there
is a pessibility of reaching an understanding if there were some delay,
he weuld be willing to defer action if it would net present a legal
preblem, The City Atterney advised ef the City Charter requirement
that the budget be adepted by July 1. Councilman Hage agreed to granting
a little extra time if it weuld help,
Councilman Helms queried whether anything concrete ceuld be accomplished
in the few remaining days; that he certainly felt there should be full
discussions between management and representatives of the organizations,
but from documentation presented he did not see any great disparity that
could net be worked out in the months ahead; that he did net think the
City Manager was firm in all position classifications and salaries and
that he henestly did net feel additional time would accomplish anything.
In referring to the Manager's information that the overall increase fer
salaries is 7.2% Mayer Arth commented in part that in his opinion manage-
ment has recognized that the City is below the median in seme instances
and that this is evidence of bargaining in good faith and questiened the
value of additional meetings.

The Chairman ef the Pelice Relief Asseciation stated in part that the
time element entered the picture in order fer the asseciation to negetiate
because it did not receive notice until May 20 that the association would
have to represent the police; that theretofore there was a standing
arrangement that the Chief of Police ceuld represent the association.
Once again he asked for a delay in budget adeptien and for additional time
to meet and confer.
It was then MOVED by Ceuncilman Hage, seconded by Councilman Butterworth
and carried en roll call vote as follows, that the public hearing be
centinued until 7:30 P.M. June 30, and that the City Manager be autherized
to meet and confer with the organizations under conditions he deems proper
and in full confermity with the law,

At the request of Council, Rebert Powell, member of the Municipal
Consulting Department of Stone and Youngberg, investment banking
firm, speke at length cencerning the procedure involved in bond
financing fer major prejects. The City Council had evinced interest
in this method primarily for the constructien of the St. Joseph
Reserveir but including other improvements. (Informatien only).
It being the censensus ef the City Council that the City participate
in the San Gabriel Valley Municipal Data System fer an additional
year, 'eperating under the Joint Pewers Agreement, it was MOVED by
Councilman Butterworth, seconded by Councilman Hage and carried en
rell call vete as follows, that an expenditure ef $12,303 be
autherized from Acceunt 409-48 reflected in the Budget for 1969-70.

The City Attorney explained that he ever10eked the deletion of ene
werd 'Dire~tor' in Sectien 4511 of Ordinance No.. 1400 at the time
the document was first intreduced and amended (on June 17) and
proceeded to read the title ef a new Ordinance No. 1400 entitled:
"AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA AMENDING
ARTICLE IV, CHAPIER 5 OF THE ARCADIA MUNICIPAL CODE RELATING TO
REGULATIONS FOR THE USE OF THE COUNTY PARK AND ARBORETUM."
It was then MOVED by Ceuncilman Hage, secended by Councilman
Butterwerth and carried en rell call vote as follews, ,that the
reading of the full bedy of Ordinance No.. 1400 be WAIVED.

The City Attorney presented for the second time, explained the
content and read the title of Ordinance No, 1399, entitled: "AN
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA AMENDING SECTION
8230.5 OF THE ARCADIA MUNICIPAL CODE RELATING TO THE UNIFORM PLUMBING
CODE."
It was MOVED by Councilman Butterworth, seconded by Ceuncilman Helms
and carried on roll call vote as fellows, that the reading of the full
body ef Ordinance No. 1399 be WAIVED.

10:45 P.M. at which time it was MOVED by Councilman Helms, secended
by Councilman Butterwerth and carried unanimeusly, that the following re-

At 10:50 P.M., the meeting adjeurned to. MONDAY, JUNE 30, 1969, at
