Rev. Roger Sonnenberg, Our Savior Lutheran Church Councilman Jeffrey A. Dring PRESENT: ABSENT : Councilmen Dring, Gilb, Haltom, Saelid, Pellegrino None PRESENTATIONS It was MOVED by Councilman Gilb that the newly elected students be officially appointed to the Youth Commission for the period from June 1980 to June 1981. Motion seconded by Councilman Saelid and carried on the following roll call vote: AYES NOES ABSENT: Councilmen Dring, Gilb, Haltom, Saelid, Pellegrino None None Councilman Saelid, former Council liaison to the Youth Commission, pre- sented Certificates of Appreciation for their efforts and accomplishments to the following retiring Youth Commissioners: Diana Kaye, Richard Cheney, Sonny Yoon and Lynn Iler who could not be present Councilman Gilb, current Council liaison to the Youth Commission, then presented credentials to the following incoming commissioners: Arcadia High School Arcadia High School Maranatha High School Foothills Junior High School: Dana Junior High School: First Avenue Junior High School: Senior Class: Junior Class: Jeff Weiss, Jane Richter Alex Trigonis, Karen McKenzie Bill Aaron Kelly Mcquire Cindy Zol tan Tom McEntee During this presentation the Advisor to the Youth Commission, Marc Mueller, was introduced and joined the group for photographs. Grace Pelto, Chairman of the Arcadia Beautiful Commission, introduced the members of the Commission who were present - Helen Feichtmann, Margaret Gale, Helen Hauser, Claude Hoard, Eileen Hubbard, Patricia Inbody, Lois patnou, Kim Zecher, Catherine Mundy and Charles Batterson could not be present. Mrs. Pelto briefly outlined what the COmmission has accomplished thus far in improving the attractiveness of the City. The following awardees for this year were introduced and presented with Certificates. I CONTINUED - Request of the International Society of Krishna Consciousness for a Certificate of Registration for Religious Solicitation. At the last Council meeting the City Attorney had been directed to prepare a resolution instructing the City Manager not to issue the Certificate of Registration based on discrepancies, incompleteness and misrepresentations of the application. Tlie nearing remaining open Mayor Pellegrino asked for those in the audience who desired to be heard on the matter. No one desired to be heard and it was MOVED by Councilman Saelid, seconded by Councilman Gilb and carried unanimously that the hearing be CLOSED. As a matter of record it was noted that the organization had been notified of this hearing however no repre- sentative was present or responded. Reference was made to the applicant's request that action be taken as soon as possible. Whereupon the City Attorney presented, explained the content and read the title of Resolution No. 4907, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA MAKING FINDINGS OF FACT REGARDING THE APPLICATION OF THE INTERNATIONAL SOCIETY OF KRISHNA CONSCIOUSNESS, ALSO KNOWN AS HARE KRISHNA, FOR A CERTIFICATE OF REGISTRATION FOR RELIGIOUS SOLICITATION, AND DIRECTING THE CITY MANAGER NOT TO ISSUE SAID CERTIFICATE BASED ON THE DIS- CREPANCIES, INCOMPLETENESS, AND MISREPRESENTATIONS OF SAID APPLICATION AND ON SAID FINDINGS OF FACT." It was MOVED by Councilman Gilb, seconded by Councilman Dring and carried on roll call vote as follows that the further reading of the full text of the resolution be waived. Councilman Saelid and carried No. 4907 be and it is hereby I AYES NOES ABSTAIN: ABSENT : Councilmen Gilb, Saelid, Pellegrino None Councilmen Dring, Haltom None Request for a variance from the driveway ramp requirements for a proposed 6 unit condominium at 1107-1115 W. Duarte Road and 1149 Sunset Boulevard. The Public Works and Planning Departments have approved the request., It was noted that this is in compliance with the revised driveway ramp design criteria which has been approved by the City Council and which will be in- corporated into the Arcadia Municipal Code when the 1979 Building Codes are adopted. -2- 6-3-80 I HEARING TRACT NO. 40374 (Tenta tive Map APPROVED) HEARING BUDGET 1980-81 CONTINUED June 17 FIVE YEAR CAPITAL PROJECTS PROGRAM (June 17) I HEARING FEDERAL REVENUE SHARING FUNDS (JUNE 17) 25:0042 Mayor Pellegrino declared the hearing open and no one desiring to be heard the hearing was CLOSED on MOTION by Councilman Dring, seconded by Council- man Saelid and carried unanimously. It was then MOVED by Councilman Gilb, seconded by Councilman Saelid and carried On roll call vote as follows that the request be APPROVED. AYES NOES ABSENT: Councilmen Dring, Gilb, Haltom, Saelid, Pellegrino None None Planning Commission recommendation concerning the tentative map of Tract No. 40374 for an 18 unit commercial condominium at 40-44 West Live Oak Avenue. It was noted that this is a first development of a commercial condominium in the City. Mayor Pellegrino declared the hearing open and Jim Allison, Allison Con- struction Corporation, introduced himself. No one desiring to be heard the hearing was CLOSED on MOTION by Councilman Dring, seconded by Council- man Gilb and carried unanimously. It was then MOVED by Councilman Saelid, seconded by Councilman Dring and carried On roll call vote as follows that the Negative Declaration be approved and filed and find that the project will not have a significant effect on the environment; that the tract is consistent with the General Plan and that the waste discharge would not result in a violation of the existing requirements set forth in the Water Code; that the Director of Public Works be authorized to approve the subdivision agreement and that the tentative map of Tract No. 40374 be approved. AYES NOES ABSENT: Councilmen Dring, Gilb, Haltom, Saelid, Pellegrino None None The City Manager presented the preliminary budget for 1980-81 with a total budget request of $12,351,206. The City Council had reviewed the budget in several sessions and increases and decreases were enumerated by the City Manager. Increased levels of service in the Planning Depart- ment, Fire Department, Public Works Department and in the Library were recommended for approval. Salary recommendations for some 40 of the high- er salaried staff members has not been completed and a meeting was schedul- ed for June 24 at 7 p.m. CONTINUED - from the public hearing proceedings of March 18. The Finance Director responded to questions as to the possible effect of the Gann Initiative (Proposition 4) approved by the electorate last November and explained calculations based on the data available at this time. He con- tinued in part that the Initiative is ambiguous and is subject to legis- lative clarification. The Legislature is now considering Senate Bill 1352 but it probably will not be passed until late in June. Mayor Pellegrino declared the hearing open on the budgets and no one de- siring to be heard the hearings were CONTINUED to JUNE 17 on MOTION by Councilman Gilb, seconded by Councilman Dring and carried on roll call vote as fo llews : AYES NOES ABSENT: Councilmen Dring, Gilb, Haltom, Saelid, Pellegrino None None The City Manager explained that the administrative hearing on the Federal Revenue Sharing Program was held May 19 and that the general public hearing is scheduled at this time. The program before Council is for part of the July to September 1980 allocation. That as of now there is no assurance that the program will be continued ... it is assumed it will but no one knows in what form. Equipment proposed to be purchased was explored. It -3- 6-3-80 25:0043 was noted that the monies can be carried over ... the limitation is for two years. Staff will calculate the items carried over and/or antici- pated. Mayor Pellegrino declared the hearing open and no one desiring to speak to the matter at this time it was MOVED by Councilman Gilb, seconded by Councilman Dring and carried on roll call vote as follows that the public hearing be CONTINUED to JUNE 17. AYES NOES ABSENT: Councilmen Dring, Gilb, Haltom, Saelid, Pellegrino None None ARCADIA REDEVELOPMENT AGENCY I The City Council recessed in order to act as the ROLL CALL CONCEPT PLANS (Bowden) ADJOURNMENT PRESENT: ABSENT : Members Dring, Gilb, Haltom, None Saelid, Pellegrino Staff submitted the concept plans for the construction of a general office building at 610-618 N. Santa Anita Avenue by the Bowden Construction Com- pany. During this consideration Mr. Bowden responded to questions. Slides were shown of the proposed development which will be used for the general headquarters now located in Pasadena. Any equipment will be stored on Mr. Bowden's property on LaPorte which is within the redevelopment area. Pend- ing the review of the concept plans permanent drawings will be prepared and when these are approved they hope to start construction within six months. It was MOVED by Member Gilb, seconded by Member Saelid and carried on roll call vote as follows that the concept plans be approved. AYES NOES ABSENT: Members, Dring, Gilb, Haltom, Saelid, Pellegrino None None The meeting adjourned to June 17 at 7 p.m. COUNCIL RECONVENED AUDIENCE PARTICIPATION ZONE VARIANCE APPROVED 1224 S. Mayflower Herb Fletcher, 175 W. Lemon Avenue, asked the City Council to consider ad- vising the citizens through the local press as to what is transpiring, pri- marily referring to the proposed issuance of tax exempt bonds to finance facilities for the Methodist Hospital. In response to a question by Mayor Pellegrino as to whom Mr. Fletcher had in mind in a communication he wrote to the press, Mr. Fletcher said in part that he was answering a letter written by a resident in San Marino and was not referring to any member of the City Council; that he referred to the last two elections in Arcadia to bring out his point that people do not turn out to vote. I Planning Commission Res. No. 1141 granting a zone variance to permit an additional 128 sq. ft. of floor area to the main dwelling on a lot with three one-family dwellings at 1224 S. Mayflower Avenue. It was MOVED by Councilman Gilb, seconded by Councilman Saelid and carried on roll call vote as follows that the recommendation be APPROVED subject to conditions spelled out in said resolution. AYES NOES ABSENT: Councilmen Dring, Gilb, Haltom, Saelid, Pellegrino None None -4- 6-3-80 HOME OCCUPATION PERMIT FEE I RESOLUTION NO. 4906 ADOPTED MEDICAL PROGRAMS Self-funded APPROVED ILECTRlCAL ODE (1978) DITION HEARING July 15 ORDINANCE NO. 1707 INTRODUCED 25:0044 Staff advised that Ordinance No. 1701, establishing regulations for Home Occupation, was adopted on May 20, 1980 and will become effective June 20. Section 9285.9 of this ordinance requires that a fee shall be paid in an amount established by resolution of the Council. The Planning and Business License Departments recommend an annual permit fee of $25.00. Discussion ensued on the fair enforcement of this ordinance and whether or not the department could handle this with its current personnel. The Planning Di- rector said in part that the administration will basically be handled by the Planning and Business License Departments and he hopes additional per- sonnel will not be necessary - that it will be tough to start but should be simple on an annual basis. Councilman Haltom felt it would just be creating another bureaucracy.. and submitted in part that it appears to him that it would be unfair to those the City is able to capture because there will be those impossible to capture .. for instance those who work out of their homes - essentially working out of an office but supplements by working out of their homes ... The City Attorney presented, explained the content and read the title of Resolution No. 4906 entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA ESTABLISHING A FEE FOR THE HOME OCCUPATION PERMIT." It was then MOVED by Councilman Gilb, seconded by Councilman Saelid and carried on the following roll call vote that the reading of the full text of Resolution No. 4906 be waived: AYES NOES ABSENT: Councilmen Gilb, Haltom, Saelid, Pellegrino Councilman Dring None Councilman Gilb then read Resolution No. 4906 in full and MOVED for its adoption. Motion seconded by Councilman Saelid and carried on the following roll call vote: AYES NOES ABSENT: Councilmen Gilb, Saelid, Pellegrino Councilmen Dring, Haltom None Staff presented a proposal from Galbraith & Green,. Inc., to provide claims service for the City's self-funded employee medical, hospital and dental programs beginning July 1, 1980. The proposal had been presented to the City Employee Group Insurance Committee and it concurred with the recommendation that a change be made in the handling of employee claims. It was MOVED by Councilman Saelid, seconded by Councilman Gilb and carried on roll call vote as follows that the staff be authorized to contract with Galbraith & Green for administrative services as outlined in the proposal effective July 1, 1980. AYES NOES ABSENT: Councilmen Dring, Gilb, Haltom, Saelid, Pellegrino None None Staff advised that as of August 1979 the City has been subject to the en- forcement of the National Electrical Code 1978 Edition which was adopted by the State in August 1978. In order to clarify the fact that the City is enforcing the code and certain local amendments the City must formally adopt the code with the amendments. In order to proceed an ordinance must be in- troduced which will schedule a public hearing for July 15. During the con- sideration Councilman Haltom asked if those who will be affected will be notified of the code changes. The Planning Director said in part that every effort will be made to reach those persons and the license holders will definitely be notified. The Planning Director then presented, explained the content and read the title of Ordinance No. 1707, entitled: "AN ORDINANCE OF THE CITY OF AR- CADIA AMENDING CERTAIN BUILDING REGULATIONS SET FORTH IN ARTICLE VIII OF THE ARCADIA MUNICIPAL CODE, ADOPTING THE NATIONAL ELECTRICAL CODE 1978 EDITION, AND WITH CHANGES, ADDITIONS AND DELETIONS THERETO AND FINDINGS THEREFOR. " -5- 6-380 DATA PROCESSING AGREEMENT APPROVED ORDINAOCE NO. 1703 ADOPTED ORDINANCE NO. 1704 ADOPTED DRING HALTOM 25:0045 It was MOVED by Councilman Saelid, seconded by Councilman Gilb and carried on roll call vote as follows that the full reading of Ordinance No. 1707 be waived and INTRODUCED. AYES NOES ABSTAIN: ABSENT : Councilmen Dring, Gilb, Saelid, pellegrino None Councilman Haltom (he is an electrical contractor) None Staff submitted a proposed agreement between Municipal Data Systems and Science Dynamics Corporation for the City's data processing requirements. The Municipal Data Systems' Board of Qirectors approved the agreement at its last regular meeting. The primary features of the agreement were out- lined in the staff report dated May 29, 1980. It was noted that a steer- ing committee will handle the conversion from the City of Anaheim and each MDS city will be assessed $500 to establish a special fund for reimburse- ment purposes for actual time and costs incurred in the transition and redesign of the MDS programs. It was MOVED by Councilman Gilb, seconded by Councilman Saelid and carried on roll call vote that the proposed agree- ment be APPROVED effective July 1, 1980. I AYES NOES ABSENT: Councilmen Dring, Gilb, Haltom, Saelid, Pellegrino None None The City Attorney presented for the second time, explained the content and read the title of Ordinance No. 1703 entitled: "AN ORDINANCE OF THE CITY OF ARCADIA REPEALING PART 9.4 OF CHAPTER 6 OF ARTICLE II OF THE ARCADIA MUNICIPAL CODE PERTAINING THE STREET SWEEPING SERVICE CHARGE." It was MOVED by Councilman Gilb, seconded by Councilman Saelid and carried on roll call vote as follows that the reading of the full text be waived and ADOPTED. AYES NOES ABSENT: Councilmen Dring, Gilb, Haltom, Saelid, Pellegrino None None The City Attorney presented for the second time, explained the content and read the title of Ordinance No. 1704 entitled: "AN ORDINANCE OF THE CITY OF ARCADIA AMENDING THE ARCADIA MUNICIPAL CODE BY ADDING SECTION 2671.6 TO PART 7, CHAPTER 6, ARTICLE II THEREOF INDEF INITEL Y SUSPENDING A PORTION OF UTILITY USER TAX RATE AND REDUCING THE UTILITY USER TAX RATE FOR TELEPHONE, ELECTRICITY AND GAS FROM 7% to 5% FOR THE USUAL CURRENT EXPENSES OF THE CITY OF ARCADIA." It was MOVED by Councilman Haltom, seconded by Councilman Dring and carried on roll call vote as follows that the reading of the full text be waived and ADOPTED. AYES NOES ABSENT: Councilmen Dring, None None Gilb, Haltom, Saelid, Pellegrino I Requested an update on the projected surplus for June 30, 1980 and would like this information about June 17 so he could review it by June 24. Spoke to the type of ballot paper which was used for the April 8 local municipal election - that it appeared the discs fell out quite easily - especially when the ballot cards went through the votamatic. The City Clerk responded in part that the ballot paper is mandated and all cities having an election on that day used the same. She explained the process practiced in 'brushing' the ballot card for discs remaining on the ballot. Council- man Dring, felt a better quality card stock should be pursued. -6- 6-3-80 APPOINTMENTS June 17 SCHOOL BOARD EXECUTIVE SESSION CLAIM REJECTED I CLAIM REJECTED 25:0046 \ Appointments to the various Boards and/or Commissions will be made at the next regular meeting.
